AN ORDINANCE AUTHORIZING THE MAYOR TO
ENTER INTO AN AGREEMENT WITH IAPRO.
WHEREAS, by letter dated February 3, 2021, the Commissioner of tlie
Department of Public Safety l'ias requested legislation authorizing the Mayor to
enter into an agreement witli IAPro - the Computer Software Program utilized by
tlie Internal Affairs Unit at the annual cost of $2,164.86; NOW, THEREFORE,
Tlie City of Mount Vennon, in City Council convened, does hereby ordain
and enact:
Section 1. The Mayor is liereby authorized to enter into an agreement
with IAPro - the Computer Software Program utilized by the Internal Affairs Unit
at the annual cost of $2,164.86.
Section2. Costfortheaforesaidinanarx'iountnottoexceed$2,164.86is
available in Budget Code A3120.449 (Investigations aiid Trials), Police Department
2021 Budget.
Section 3. This ordinance shall take effect upon its approval by the
Board of Estimate & Contract.

WHEREAS, pursuant to Section 153 of the Charter of the
tQ City of Mount Vernon, the Corporation Counsel, with the written .
consent of the Mayor, may employ counsel at such compensation
as may be agreed upon by the Board of Estimate and Contract in
the conduct of proceedings in which the City is a party; and

WHEREAS, by letter dated February 21, 20:23J,the
Corporation Counsel has recommended that this Board employ and
retain the Wagstaff Firm, p.c. by terminating the firm's existing
retainer and entering into a new outside counsel agreement now
includes the firm's Principal's William O. Wagstaff, Ill to represent
the City as Special Counsel for the City's disciplinary hearings;
NOW THEREFORE, be it
RESOLVED, that William O. Wagstaff, Ill as Principal
Counsel be retained at the rate of $350.00 per hour and $250.00
per hour for associate counsel; and be it further
RESOLVED, that funds are available in Budget Code
A1420.405 (Contracted Outside Service) Law Department, 202'l
Budget; and be it further
RESOLVED, that this resolution shall take effect
immediately.

bAR g 2 2021 WHEREAS, pursuant to Section 153 of the Charter or the

Square, Esq. PLLC as independent counsel to the former Water
Commissioner Benjamin Marable in his legal defense in the federal
action entitled Anthony Della Mura v. City of Mount Vernon, Case
Number 19 CV 8699; and
WHEREAS, Chapter 50, Personnel Policies, Article IV.
Defense and Indemnification of Officers and Employees §50-44
Right to defense by the City entitles Mr. Marable to his choice of
firm to represent him in this matter; NOW THEREFORE, be it
RESOLVED, that R-Square, Esq. PLLC, Royce Russell,
Esq. be retained at the rate of $350.00 per hour for all work
performed in the office and $375.00 for court appearances and
work performed outside of the office. Expenses such as, but not
limited to, copying, mailings, and the production of documents that
require outsourcing are billed separately; and be it further
RESOLVED, that funds are available in Budget Code

WHEREAS, on March 7, 2019, ALLEN BROWN filed a Notice of Claim
against the City of Mount Vernon for violation of his civil rights which allegedly
occurred on December 9, 2018; and
WHEREAS, the City of Mount Vemon was served with a summons and
complaint on June 17, 2019; and
WHEREAS, the Corporation Counsel hereby recommends that the Board of
Estimate and Contract approve the settlement of the aforesaid claim in the amount
of $13,500.00; NOW, THEREFORE, be it
RESOLVED, that the aforesaid claim of ALLEN BROWN be settled for the
siun of $13,500.00and that said settlement be and the same hereby is approved,, and
be it further
RESOLVED, that said sum be paid out of Code A1930.494 (Judgments &
Settlements), Law Department 2021 Budget.

agreement with Sedgwick Claims Management Services, Inc. for the period of
January 1, 2021 through December 31, 2021; and
WHEREAS, Sedgwick Claims Management Services, Inc. provides claims
adjusting and administrative services on behalf of the City; and
WHEREAS, the annual fee for the aforesaid service is $42,350.00. In
addition to the annual fee and the allocated loss expenses, to continue to report in
regard to the CMS reporting, the separate annual fee is $2,400.00; NOW,
THEREFORE,
The City of Mount Vernon, in City Council convened, does hereby ordain
and enact:
Section 1. The Mayor is hereby authorized to enter into a claims
servicing agreement with Sedgwick Claims Management Services, Inc. to provide
claims adjusting and administrative services on behalf of the City.
Section 2. Cost for the aforesaid is in the amount of $42,350.00. In
addition to the aru'iual fee and the allocated loss expenses, to continue to report in
regard to the CMS reporting, the separate annual fee is $2,400.00 is available in
Budget Code A1910.469 (Insurance Claims) Law Department 2021 Budget.
Section 3. This ordinance shall take effect upon its approval by the
Board of Estimate and Contract.
