A REGULAR MEETING OF THE CITY OF MOUNT VERNON CITY COUNCIL HELD
ON WEDNESDAY, FEBRUARY 23, 2022. Scheduled for 7:00 pm. In the City Council
Chambers City Hall, Mount Vernon, New York.
*** Due to the ongoing pandemic this meeting was held in the council chambers, with virtual
participation via ZOOM and CMVNY Facebook. The meeting was not closed to the public
however, the maximum number of in-person occupant was limited ***

Council President Derrick Thompson called the meeting to order and provided house-keeping
rules, including in case of emergency. He then asked councilman Poteat to lead the council in the
Pledge of Allegiance. Council President then proceeded to the Public Speakers session of the
evening (listed below as public comment).
PUBLIC COMMENT
Cynthia Crenshaw - residing at 315 Mundy Lane, Mount Vernon, NY, appeared in person. She
stated that the single-family home chart that was distributed that shows the yearly property tax,
which also shows sewer rents, garbage charges, reflects a difference of $3M plus, she asked that
the council please explain the difference. She also stated that the average social security check
$1437, coming out of a pandemic and right into inflation is ridiculous that the residents are being
charge these fees. She asked about the disclosure of the fulltime salary of the council members.
She is extremely concerned of the various charges and the community coming out of the
pandemic and into an inflation. She urged the citizen to take Mount Vernon back.
Debra Hunt – residing at 33 North 3rd Avenue, Mount Vernon, NY – appeared in person. She is
concerned about homeless people loitering in the community as it is dangerous, and some have
committed homicide. She hopes all elected officials can work together to reduce the homeless
population and to get help to those who needs it.
Chris McDonough – residing at 17 Vernon Place, Mount Vernon, NY – appeared in person. He
informed the council body that he had 7 questions; 1. What is the mean, median, mode and range
of salaries for the city employees, break it down by department? (1b) what are the salaries of
employees in comparable neighboring cities when the low range justification for salaries increase
are invoked? (2) What percentage of salary increases in the 2022 budget are discretionary and
what’s the total dollar amount of said increases (3) Instead of hiring more people what initiatives
have been undertaken to improve training so that the good people who works for the City can
become more productive and happier, when people are productive they are happy. (4) What is
the estimate of the actual annual cost of the water fee will be per customer annually (5) Sewer
rents- What precisely is the plan for that? (6) Exactly what the ARPA has been spent on? (7)
How will this $5M hole be filled when we don’t have the ARPA money to do that/How much of
the ARPA fund will we need to put in the budget if all discretionary cost was removed.
Lauren Carter -appeared via zoom. She said that she just wanted to raise her objection once
more to the budget as it is proposed. She hopes her comments as well as the comments from all
stakeholders have been taken into consideration. As per salary she is aware that the council
cannot reduce or even increase them because that’s done during the BOE process, but there are
couple of things that the council can take action on in that regard. She concluded by posing a
question of where are the benefits for the tax increase?
Raymond Copeland residing at -appeared in person. Commissioner Copeland thanked the
council for allowing him to speak. He asked that the council take a trip through Mount Vernon
to observe the things the residents comes to speak on. He spoke about is his health and how the
car wash near his house affects his health and wellbeing. The loud noise from the car wash
affects his peace, the loud music is blasted all day long from their speakers. He has called the
police department several times and issued violations, but the car still does not heed to the
violations. He has to yell to speak to his family in his house. He has no peace from the constant
noise.
Council President Comment - Council President Thompson informed the public that because the
meeting started late, he will afford the public an opportunity to speak even if they did not sign up
to speak. He asked repeatedly if anyone would like to speak but receive no response, therefore
the meeting proceed as standard.
Mary Harris residing at 222 West 2nd Street, Mount Vernon, NY. Ms. Harris said that she lived
in an aged community of homeowners, she stressed that they are having a hard time just
surviving, they pay their taxes and have contributed to help the city grow and thrive. The new
fees are too high. She lamented that they are struggling terribly just to survive. She said that she
feels as if she is being forced out of Mount Vernon. She and her family have no where to go, she
bought her house to stay here.
Brian Johnson – Corporation Counsel for the City of Mount Vernon - appeared in person. He
spoke about the budget and the law department. He stressed that if he is not able to defend the
City then the tax will increase more than they are now, if said that the lawyers in the law
department are very good lawyers but they are not spatialized and so he must employ outside
counsel which cost money but is needed to address the myriads of lawsuits plaguing the city
from prior administrations.

OTHER BUSINESS
Executive Session – To discuss personnel matters – Discussing the resignation letter received
from Mr. William Holmes (city clerk) and how they will proceed thereafter. The council body
thank Mr. Holmes for his service and wished him luck on his future endeavors. The council then
entered into a vote to receive his resignation letter and end his service with the clerk’s office
effective immediately.

DAY IN THE CI1Y OF MOUNT VERNON
WHEREAS, by letter dated February 17, 2022, Mayor Shawyn Patterson-
Howard, MPA, of the City of Mount Vernon requests that the City Council enact
legislation to establish the first Monday in March as COVID-19 Memorial Day in
the City of Mount Vernon; and
WHEREAS, the Mayor has made it clear that Covid-19 has had a
disproportionate impact on the residents of the City of Mount Vernon, including
our seniors, and residents who work in the health care industries that provided
essential work during this pandemic. COVID has continued to exacerbate
inequities already prevalent in our system that we must address; and
WHEREAS, this Ordinance serves to designate the first Monday in March
as COViD-19 Memorial Day in the City of Mount Vernon in remembrance of
those who have lost their lives in an honor of those who are forever marked by
COVID and continue to suffer from the impact of this virus; Mount Vernon lost
more than 95 lives have been lost to the deadly virus of COVID-19; NOW,
THEREFORE,
The City of Mount Vernon, in City Council convened, does hereby ordain
and enact:
Section l The City Council designates the first Monday in March as
COVID-19 Memorial Day in the City of Mount Vernon.

new local laws, Local Law 2, which establishes a new Sewer Rent to be paid by the
residents of Mount Vernon, and Local Law 3, which establishes a new Refuse
Sustainability Fee also to be paid by the residents of Mount Vernon; and
WHEREAS, the two new charter provisions require establishment of a new
section of the City Code that enurnerates these new fees; and
WHEREAS, the letter has requested that the Honorable City Council amend
the code [charter] provision, City of Mount Vernon Part II, General Legislation
Entitled "Chapter 126. Fees and Deposits" by adding another article entitled
"Article VI. Sewer Rents and Refuse Sustainability Fees" to conespond with the
new Charter provisions, Chapter C. Article IX. Department of Public Works, I 12-b
entitled, "Sewer Rents" and, Chapter C. Article IX Department of Public Works,
112-c entitled, "Refuse Sustainability Fee;" NOW, THEREFORE,

J AN ORDINANCE AUTHORIZING THE MAYOR
TO ENTER INTO AN AGREEMENT WITH
NEW YORK ST ATE UNIFIED COURT SYSTEM
WHEREAS, by letter dated February 17, 2022, the Chief of Staff (Office of
the Mayor) has requested legislation authorizing the Mayor to enter into an
agreement with New York State Unified Court System for the purpose of cleaning
and maintaining the "Court Facilities" housed within the Mount Vernon Police
Court Complex. Chapter 686 of the Laws of 1996 requires the State of New York
to contract with political subdivisions of the State for the cleaning and minor
emergency repairs of that subdivision's court facilities; and
WHEREAS, the City of Mount Vernon is responsible for furnishing and
maintaining its court facilities and is eligible for reimbursement for those expenses
at a rate of 100% of cleaning fees and 25% of maintenance fees for the court portion
of the Police Court Complex. Historically, Mount Vernon has been the only City in
the entirety of New York State (towns and villages are not eligible) that has opted
not to enter into the "696 Contract" and seek reimbursement from the State for these
expenses; and
WHEREAS, with permission, the City can enter into a retroactive contract
with the State for the tern'i of April 1, 2018 through March 31, 2021 (the State
executes all 696 Contracts on the same 5-year cycle) to formally acknowledge the
City's responsibility under the law and facilitate the reimbursement of the expended
funds. The State has expressed a willingness to assiSt the City in recouping any
eligible funds that were previously expended during the contract period; NOW,
THEREFORE,
The City of Moiu'it Vernon, in City Council convened, does hereby ordain
and enact:
Section 1. The Mayor is hereby authorized to enter into a 696
Agreement by and between the New York State Unified System ("UCS") located at
25 Beaver Street, New York, NY 10004 and the City of Vernon ("Municipality") for
a five (5) year cycle cornrnencing on April 1, 2018 through March 31, 2023.
Section 2. This ordinance shall take effect upon its approval by the
Board of Estimate and Contract.

WHEREAS, funding for the aforesaid defiu'iding/funding of positions are
available in Budget Code A1410.101. The "Senior Accountant" position has a Min-
Max Salary of $67,008.44 - $97,687.62; and
WHEREAS, the title of Senior Accountant became effective on Monday,
December 6, 2021 ; and salary should also take effect on that date; NOW, THEREFORE,

TO ENTER INTO A SERVICE AGREEMENT WITH
THE WESTCHESTER COUNTY YOUTH BUREAU
AND THE BOARD OF LEGISLATORS
WHEREAS, by letter dated February 16, 2022, the Executive Director of the
Youth Bureau has requested legislation authorizing the Mayor to enter into a service
agreement with the Westchester County Youth Bureau and the Board of Legislators in
the amount of $163,976.00 to support the following programs: Safe Haven, Youth
Empowerment Employment and Step Up. Anticipated service agreements commence
January 1, 2022 through December 31, 2022 and is based upon the Mount Vernon
Youth Bureau continuance of contract compliance, appropriation of funds to the Youth
Bureau, and execution of the service agreement; and
WHEREAS, Safe Haven's After-School, Summer Program and Saturday
STEAM ($84,513.00) provides free academic support, social emotional development
and STEAM enrichment activities to children grades 3 through 6 at Grimes and Parker
Elementary Schools. The Youth Empowemient Programs ($48.706.00) provides 6-
weeks paid job readiness, training, or hands-on work-based experience to disconnected
and at-risk youths ages 14-21. The Step-Up Program ($30,757.00) provides counseling,
job readiness and training, 6-weeks paid summer academy, mentoring, exposure to
community service and conflict resolution; NOW, THEREFORE,

Section 1. The Mayor is hereby authorized to enter into an agreement with
the Westchester County Youth Bureau and the Board of Legislators commencing
January 1, 2022, through December 31, 2022.

SITUATION AT 35 SOUTH 8"' AVENUE
WHEREAS, by letter dated February 16, 2022, the Commissioner of
Buildings has informed this City Council that the building located at 35 South 8'
Avenue has been demolished because it was determined to be unsafe, and dangerous
to the life, safety, or morals or general health and welfare to the City's inhabitaxits;
and
'iX7HEREAS, public property and the peace, health, safety and welfare of the
City's irffiabitants were affected by the conditions that existed at 35 South 8' Avenue;
NOW, THEREOFRE,
The City of Mount Vernon, in City Council convened, does hereby ordain and
enact:
Section 1. The City Council hereby declares that was an emergency
situation existed at 35 South 8" Avenue, which was unsafe, dangerous and
jeopardized the health, welfare and safety of the City's inhabitants, thereby creating a
public emergency, which required immediate attention.
Section 2. Pursuant to Section 73 of the City Charter and Section 103 of
the General Municipal Law, the competitive bidding requirement was hereby waived
for the emergency work needed.
Section 3. The Mayor is hereby authorized to execute an agreement with
Webb Development Services Corporation for full demolition, site clearance including
removal of debris that harbored vermin and other species at cost not to exceed
$49,000.00.
Section 4. Funds for the aforesaid will not exceed the sum of $49,000.00
are available in Budget Code A3620.443 (Emergency Funds), 2022 Budget.
Section 5. This ordinance shall take effect upon its approval by the Board
of Estimate and Contact.

at 9 Carleton Avenue, Mount Vernon, NY 10550 to dispose of the vehicles. J. Bass
and Son will pay $125.00 per vehicle disposed of, with an expected total from the
