INTRODUCTION/BACKGROUND:
On December 30, 2022 a motor vehicle collision resulted in a vehicle landing in a swimming pool.
Eriberto Delgado’s vehicle was struck in the collision. After the impact, Mr. Delgado exited his vehicle
and helped rescue the driver whose vehicle was submerged in a nearby residential swimming pool.
FINDINGS/CONCLUSIONS:
The Mayor, Mount Vernon Police Chief, and Mount Vernon Fire Chief want to publicly recognize Mr.
Delgado’s heroic efforts to risk his own safety for the life and safety of another person.

SUBJECT: REAPPOINTMENT OF LIBRARY BOARD MEMBER LYNE OLSON
RECOMMENDED ACTION:
The Library Board of Directors and the Library Staff recommend the reappointment of Lyne Olson to the
Library Board.
INTRODUCTION/BACKGROUND:
After Finishing her first term in December, the Library Board of Directors and the Library Staff
unanimously recommended the reappointment of Lyne Olson to her board seat. Lyne was initially
appointed on May 3rd, 2018, and has served the library well over the last years, helping the library
navigate Covid, service changes, and the quest for a new library. In addition, Lyne is an active library
volunteer who has built kits, shelved books, prepared crafts, and so much more. As a resident of Mount
Vernon and a great community member, we highly recommend Lyne for her second term.
FINDINGS/CONCLUSIONS:
After a background check and a fantastic term of service, Lyne meets the qualifications to continue to be
a great Library Board member.
RECOMMENDATION:
We recommend the reappointment of Lyne Olson to the Library Board.

RECOMMENDED ACTION:
Staff recommends that Council hold a closed record public hearing and make a motion to authorize the
Mayor to sign the accompanying resolution approving the above-identified expansion of a non-
conforming structure.
INTRODUCTION/BACKGROUND:
The Applicant wishes to convert a structure built without benefit of City permits into a covered porch complying
with applicable setback requirements. The new covered porch will be located on the east side of the existing
home. A portion of the existing structure built without permits will be removed entirely to result in the covered
porch being set back the required 18’ from the edge of the existing private road. The existing mobile home is
classified as non-conforming because its front yard setback is less than what is required within this mobile home
park.
MVMC Chapter 17.102 has a process by which the City Council (upon recommendation by the Hearing
Examiner) can grant special permission to enlarge or expand an existing non-conforming structure
and/or use so long as certain criteria are met.
The proposal property has an address of 1400 N 30th Street #86 (within the Skagit Valley Mobile
Manner), and its parcel numbers are P25273 and P25419.
FINDINGS/CONCLUSIONS:
On January 5, 2023, an open record hearing was held before the Hearing Examiner. The Examiner
recommended approval of the application in his Findings of Fact, Conclusions of Law and
Recommendation accompanying this memo dated January 5, 2023. No request for reconsideration of
the Examiner’s recommendation of approval was received by the department.
The Hearing Examiner’s recommendation is submitted together with the attached proposed Resolution,
the Staff Report, and all of the Exhibits that the Examiner relied upon in making his recommendation.
RECOMMENDATION:
Staff recommends Council move to adopt a resolution approving the expansion of a non-conforming
structure.

RESORT, AMEND #1 ENGR20-0316
RECOMMENDED ACTION:
The Hearing Examiner recommends that Council make a motion to authorize the Mayor to sign the
accompanying Resolution approving a waiver to otherwise required transportation concurrency
improvements for the subject development.
INTRODUCTION/BACKGROUND:
The City approved a CUP (May 2021) and Minor Modification (September 2022) for construction of a
160 stall Recreational Vehicle (RV) Resort including; a welcome/reception area, clubhouse with spa
facilities, laundry and shower facilities; playground; and picnic shelters on the below-described 19.48
acre site. modified Access to the site will be provided via an extension of College Way from Freeway
Drive. The resort will be served by roughly 7,500 linear feet of 25-foot wide private roadway; 1,675
linear feet of PUD water; and 6,290 linear feet of sanitary sewer. Each stall will have water and sewer
hookups.
The project site address is 324 W College Way and is located just to the west of Lowes hardware store. It
is described by the Skagit County Assessor as Parcel numbers P26279 and P26054, and is a portion of the
west half of Section 18, Township 34, Range 4, W.M. Please see the following vicinity map that
identifies the approximate site boundaries with red dashed lines.

As part of the original approval process, the applicant requested, and Council approved, a concurrency
waiver that exempted the Applicant from having to construct ¾ street improvements along Riverbend
Road. Since that waiver was approved, it has been determined that an additional waiver for the
entrance at College Way is also required.
The City’s traffic concurrency regulations contain the following exemption that allows City Council to
grant an exemption from all (or any portions) of otherwise required transportation improvements when
the Council finds that a development provides overriding public benefits:
“The city council may grant a development an exemption from all or any portions of the
concurrency LOS requirements upon adopting a finding that the development proposal
provides overriding public benefits [MVMC 14.10.060(B)]”.
FINDINGS/CONCLUSIONS:
West College Way is classified by the City as a Neighborhood Street. It currently functions as a de facto
driveway providing access to commercial development (Lowe’s on the north and the old Best Western
Motel and Los Compadres y Los Amigos on the south).
The current right of way for this section of W College Way is only 40 feet wide. The right of way in this
area is constrained and is too narrow to allow for the improvements that would be required for ¾ street
improvements. The applicant proposes a 24 foot wide pavement section with a 5 foot sidewalk on the
north (connecting with the existing sidewalk) and a 4 foot wide planter strip on the south with the
exception for the western 110 feet where the street section would transition back to the existing
pavement section. The proposal also includes a variable width retaining wall (2 to 3 feet in width).
Standard ¾ street improvements would consist of a 30 wide pavement section; 5 foot wide sidewalk and
4 foot wide planter strip.
The subject development will generate a total of 43 PM peak hour trips. The traffic impact fees the
Applicant is required to pay would have been $48,375.00 if paid in 2021. Traffic impact fees are subject
to an inflationary increase every year; which means that since the applicant will be paying the fees in
2023 or later, they will be slightly higher.
The West College Way extension is located at the westernmost edge of City in an area that is almost
built out and is surrounded by a mix of commercial uses. The proposed street section is similar to and
consistent with the existing portion of West College Way that extends west from Freeway Drive.
Attached is the Transportation Concurrency Review for this project that contains the complete code
analysis for the subject project and other relevant details.
RECOMMENDATION:
Council makes a motion to authorize the Mayor to sign the accompanying Resolution that would:
• Exempt the Applicant from having to construct ¾ street improvements along W College Way.
• Require the Applicant to comply with the remaining recommendations from the attached
January 11, 2021 Concurrency Report.

SUBJECT: POLICE LIEUTENANTS’ SALARIES
RECOMMENDED ACTION:
Staff recommends that Council authorize the Mayor to sign the Resolution creating a minimum wage
differential between the Police Lieutenants and Police Sergeants salary steps.
INTRODUCTION/BACKGROUND:
Police Lieutenants are non-represented employees.
In July of 2015, former Human Resources Director Kandy Bartlett requested Council approve a policy
that creates a wage differential between the police lieutenant and police sergeant salary steps. This
policy created a 13% differential between the base police sergeant salary and first year police lieutenant
salary. It also created a 17% differential between the base police sergeant salary and the second year
police lieutenant salary. The purpose of the policy was to eliminate salary compression between the
police sergeant salaries and the police lieutenant salaries.
FINDINGS/CONCLUSIONS:
When there is not a Police Guild collective bargaining agreement in effect on January 1 of a year, the
police lieutenants do not receive a cost of living adjustment, as their salaries are tied to the police
sergeant salaries.
When a collective bargaining agreement is approved by Council during the year, the police sergeants will
receive negotiated wage increases retroactive to the beginning of the contract cycle. Police lieutenants,
because they are non-represented, are not eligible for retroactive wages.
To mitigate the loss of wages, the City is recommending language that creates a minimum 13% and
minimum 17% wage differential between police lieutenant and police sergeant salary steps and to allow
the police lieutenants to receive the same cost of living adjustment that other non-represented
employees receive in years that there is not a Police Guild collective bargaining agreement in effect on
January 1.
RECOMMENDATION: Staff recommends that Council authorize the Mayor to sign the Resolution
creating a minimum wage differentials between Police Lieutenant and Police Sergeant salary
steps.

The Second Amendment to the Lease Agreement shall be for a term so long as the Site Lease agreement
is in effect.
The amendment agreement’s rent compensation is for an additional payment to the City of $6,000
dollars annually.
The rent shall increase by 3.5 percent annually.

INTRODUCTION/BACKGROUND:
The scope of work for the original contract provided on-call surveying services to the Public Works
Department primarily for surveying data needed to design street and curb ramp improvements and
other Public Works projects with an annual budget of $50,000 per year. The MRSC professional service
roster was utilized to identify candidates for this contract and three local companies were solicited for
statements of qualifications; Harmsen, LLC was selected as the preferred candidate and offered a
contract.
FINDINGS/CONCLUSIONS:
Harmsen is still providing these services on a variety of active projects. Public Works is proposing to
extend their current contract for an additional year (December 31, 2023) and include an additional
budget of $50,000 as part of the approved annual contract budget ( $50,000/year over 3 years = a total
$150,000). Public Works intends to reopen the solicitation for 2024 On-call Survey Services later this
year in the November/December timeframe.
RECOMMENDATION:
Motion to authorize the Mayor to amend the professional services agreement with Harmsen, LLC to
provide on-call surveying services to extend the duration of the contract through December 31, 2023,
and increase the contract amount to $150,000.

Project through the Washington State purchasing contract, supplied by Western Systems, Inc.
INTRODUCTION/BACKGROUND:
Transpo Group has completed the design phase of the Hoag/Laventure Intersection Improvement
Project and the City will be advertising for construction in the very near future. This project will signalize
this intersection with protected left turn lanes, eliminate the sidewalk gaps leading to the intersection,
upgrade all the ADA ramps and approaches, and rehabilitate the pavement. Last year Public Works, with
council approval, purchased the signal poles and mast arms from Valmont Industries from the
Washington State Purchasing Contract. This product was a “long lead item” which took over 20 weeks to
order, manufacture, and deliver to the City. These long lead items can cause significant project delays
which are avoided with a pre-construction purchase.
FINDINGS/CONCLUSIONS:
Over the past year, signal control cabinets have become another long lead item that has been causing
project delays in other jurisdictions in Washington State; delivery times have increased to over 15
weeks. Because of this trend, Public Works is recommending a state contract purchase of the signal
control cabinet as the project goes to bid so delivery will coincide with the anticipated construction
schedule and not risk the associated delays to the project. The quote for this purchase consists of two
parts because one of the controller modules, one of several, is not listed on the state contract but is
required for a complete functional cabinet.
RECOMMENDATION:
Motion to authorize the Mayor to purchase the signal (control) cabinet designed for the Hoag/Laventure

part of this work for the City. Additionally, Dr. Lee has assisted the City for a number of years with peer
review of critical area reports and permits since the City does not have a critical area biologist on staff.
Lastly, Dr. Lee will be assisting staff with updates to our Shoreline Management Master Plan mapping,
and implementation of the City’s ‘door 2’ approach that satisfies the performance standards of the
Biological Opinion issued by National Marine Fisheries Services (NMFS).

street trees installed on public property due to the negative impacts improperly installed trees can have
to City infrastructure and nearby private property.
Mr. Barborinas’ services include all aspects of arboricultural consultation such as tree appraisals, hazard
tree assessment, tree and plant selection, inspection and approval, landscape installation monitoring for
compliance, tree protection plans, tree code review and other consultation services as related to trees
and plants as requested by staff when necessary.
