(required action – ordinance) (staff contact – Doug Volesky) COMMITTEE MEETING Public Works and Library 6:00 p.m. Next Ordinance 3871 Next Resolution 1042 AGENDA ITEM: A  AGENDA ITEM: B DATE: August 23, 2023 TO: Mayor Boudreau and City Council FROM: Peter Donovan, Special Projects Manager SUBJECT: OVERVIEW OF CRISIS STABILIZATION CAMPUS RECOMMENDED ACTION: None INTRODUCTION/BACKGROUND: In January 2014, the City of Sedro-Woolley, Port of Skagit, and Skagit County entered into a long-range vision for the North Cascades Gateway Center campus with the Port acting as the lead agency. In late December 2016, the Washington State Department of Enterprise Services and the Port reached an agreement to transfer this state-owned property to the Port, requiring the relocation of behavioral health facilities from the site. The first facility to be relocated will be an Evaluation and Treatment (E&T) Center. The Telecare North Sound E&T located at 1803 North Sound Drive, Sedro-Woolley provides intensive mental health and psychiatric treatment services in a safe, welcoming environment for adults experiencing a mental health emergency. Skagit County has been working with the North Sound Behavioral Health Organization, Telecare, Pioneer Human Services and other regional partners to find a new location for the Evaluation and Treatment Center and other behavioral health facilities. This will allow for the continued provision of these critical healthcare services. Skagit County and the North Sound Behavioral Health Organization worked with consultants Denna Vandersloot and Slalom Consulting to help plan for the transition of Evaluation & Treatment services, as well as substance use disorder treatment services, from the North Cascades campus. Skagit County owns a number of sites within the City of Sedro-Woolley. Based on a checklist of criteria for siting this project, Skagit County is considering application for permit for a Type One Essential Public Facility (EPF) to be located on an undeveloped property on the north side of WA-20 approximately halfway between Hodgin Street and Holtcamp Road in Sedro-Woolley, Washington. The proposed project consists of 3 parcels, P104178, P76502 and P76503, totaling approximately 8 acres, and is located in the northwest corner of Section 13, Township 35 North, Range 04 East. The project is for stabilization facilities and will include development of a 16-bed Evaluation and Treatment program and a 24-bed Secure Detox program, each in a separate stand-alone one-story building, with associated parking. Skagit County is working with BCRA Design to envision and plan the proposed facilities. FINDINGS/CONCLUSIONS: Skagit County Public Health officials will present an overview of the Crisis Stabilization project to City Council. INTRODUCTION/BACKGROUND: On July 20, 2023, an open record hearing was held before the Hearing Examiner for the subject rezone. The applicants Richard and Deborah Thurman propose to rezone approximately 3.44 acres from a zoning designation of Multifamily Residential (R-3) to Multifamily Residential (R-4). The proposed zoning designation is consistent with the site’s Comprehensive Plan designation of Medium High Density Multifamily. The proposal properties (P25029, and P25030) are located at 2210 N LaVenture Road within a portion of the NW ¼ of Section 16, Township 34 North, Range 04 E, WM in Skagit County, Washington. FINDINGS/CONCLUSIONS: The Hearing Examiner recommended approval of the application in a report dated August 3, 2023. No request for reconsideration of the Hearing Examiner’s recommendation of approval was received by this department. The Hearing Examiner’s recommendation is submitted together with the attached proposed Ordinance, the Staff Report, and all of the Exhibits that the Examiner relied upon in making his recommendation. RECOMMENDATION: Staff recommends that Council move to adopt an Ordinance approving the 2210 N LaVenture rezone. INTRODUCTION/BACKGROUND: A Master Plan is needed for future improvements to the City’s wastewater treatment plant (WWTP). Over the next 15 years the City will need to make improvements to accommodate a growing population and provide necessary maintenance. Improvements include, but are not limited to: adding a carport, influent building, administrative and storage buildings, primary clarifier, aeration basins, secondary clarifiers, high-rate clarification, and digester. The approximate 32-acre WWTP site is addressed as 1525, 1515, 1401, 1410 Britt Road & 1015 W Hazel St, is described by Skagit County Assessor as parcels P28974, P29206, P28763, P28808, P28805, P29207, P28918, P29208, P28794, P28791, P28792, P28900, P28793, P28795, P29165, P29233 & P29166, is located to the west and east of Britt Rd and south of Skagit River, and is in the NW ¼ of Section 30, Township 34 N, Range 04 E, W.M. FINDINGS/CONCLUSIONS: This project has completed the required public process up to the closed record public hearing this evening. The Hearing Examiner recommended approval of the Master Plan in a recommendation that is included with a proposed Resolution for Council consideration. The Hearing Examiner’s recommendation was sent to the applicant and parties of record with no requests for reconsideration of his recommendation. RECOMMENDATION: Council move to authorize the Mayor to sign the accompanying Resolution that will approve the WWTP’s Master Plan with the conditions recommended by staff and the City’s Hearing Examiner. FINDINGS/CONCLUSIONS: TAMJAC is limited liability company with extensive experience in handling the federal (HUD) regulations associated with CDBG entitlement programs. TAMJAC has a reputation for providing professional and efficient CDBG services to cities. The proposed agreement is for a 1-year term. The agreement is capped at $5,000 monthly. 100% of the contract amount will be paid with CDBG pass-through funding. RECOMMENDATION: A motion to authorize the Mayor to enter into a one-year agreement with TAMJAC, LLC for CDBG consulting services. ATTACHED: Draft Agreement  AGENDA ITEM: G DATE: August 23, 2023 TO: Mayor Boudreau and City Council FROM: Peter Donovan, Special Projects Manager SUBJECT: CDBG AGREEMENT FOR PUBLIC SERVICES RECOMMENDED ACTION: Motion INTRODUCTION/BACKGROUND: Welcome Home Skagit is a nonprofit agency that operates, among other services, a daytime shelter and resource center at 2529 N. Laventure Road (Salem Lutheran Church) in Mount Vernon. City Council approved a portion (5.6%) of the City’s 2023-24 CDBG annual allocation for Welcome Home Skagit, to be used for operations of a day shelter and resource center for unsheltered Mount Vernon residents. FINDINGS/CONCLUSIONS: The proposed agreement formalizes the expectations surrounding the distribution of CDBG funding in exchange for services to be provided. The total amount of the one-year agreement is $18,612. This allocation was previously approved (May 10, 2023) by Council as part of the City’s 2023-24 Annual Action Plan. RECOMMENDATION: A motion to authorize the Mayor to enter into a one-year agreement with Welcome Home Skagit for day shelter and resource center operations in Mount Vernon. ATTACHED: Draft Agreement  AGENDA ITEM: H DATE: August 23, 2023 TO: Mayor Boudreau and City Council FROM: William Bullock, P.E. - City Engineer SUBJECT: PROFESSIONAL SERVICES AGREEMENT: COMPREHENSIVE SEWER PLAN RECOMMENDED ACTION: Staff recommends entering into a Professional Services Agreement with HDR Engineering for planning, modelling, and development services for 2025 Sewer Comprehensive Plan for an amount not to exceed $567,850. INTRODUCTION/BACKGROUND: The City last adopted a Sewer System Comprehensive Plan in 2003 and has been operating from that forecast and baseline methodology established over 20 years ago. The Public Works department has performed updates and modelling to various sections of that plan when preparing to implement various system upgrades throughout the years; but we have not performed a comprehensive assessment of the collection system and the WWTP to realign future needs with growth and new regulation requirements in two decades. This planning effort will Include: • Review/update system inventory and GIS data (collection and WWTP) • Evaluation of current and future planning data, demand forecasting, and system analysis • Evaluation of nutrient reduction capabilities and other regulatory requirements • Develop and update Wastewater Capital Improvement Plan • Develop a suitable financial program This plan will also review and recommend updates to City Code, future plan updates, and additional areas of future system development. FINDINGS/CONCLUSIONS: The HDR Engineering team has been the primary engineering consultant for the Mount Vernon WWPT and pump stations for the past several years and as a result has the most diverse knowledge about our systems. HDR has assisted a number of other cities throughout the state with sewer comprehensive planning and has the full suite of expertise to develop all of the plan components within HDR; all part of making them the preferred candidate. The scope and fee for the required professional services is not to exceed $567,850. RECOMMENDATION: Motion to authorize the Mayor to execute a Professional Services Agreement with HDR Engineering for the development of the 2025 Comprehensive Sewer Plan for an amount not to exceed $567,850. ATTACHED: Scope and Fee  AGENDA ITEM: I DATE: August 23, 2023 TO: Mayor Boudreau and City Council FROM: William Bullock, P.E. - City Engineer SUBJECT: BID AWARD – WASTEWATER TREATMENT PLANT SHOP BUILDING RECOMMENDED ACTION: Staff recommends a motion to award the construction contract for the WWTP Shop Building Project to Valdez Construction of Oak Harbor, WA in the amount of $1,601,536. INTRODUCTION/BACKGROUND: There are currently several pieces of equipment, vehicles, and generators that are stored outside in the weather. This new shop building at the WWTP will provide an enclosed structure to both house these assets and a provide a covered space to perform required maintenance out of the weather. Additionally, this structure will be incorporating 140 solar panels to power the building and meet energy code requirements at a higher than required level. FINDINGS/CONCLUSIONS: The necessity for this shop building has been planned for the past several years and will effectively extend the life of City equipment and vehicles. The structure is 40’x100’, includes 5 sizable vehicle bays, and an upper storage loft. The low bid was provided by Valdez Construction Inc. in the amount of $1,601,536 RECOMMENDATION: Staff recommends Council award the construction bid for the WWTP Shop Building Project to Valdez Construction of Oak Harbor, WA in the amount of $1,601,536. ATTACHED: Bid Tabulation  AGENDA ITEM: J DATE: August 23, 2023 TO: Mayor Boudreau and City Council FROM: Doug Volesky, Finance Director SUBJECT: HUD, SECTION 108 LOAN FOR MVLC PROJECT - ORDINANCE RECOMMENDED ACTION: Staff recommends Council approve Ordinance No. 3872 that approves and authorizes a loan guarantee contract and related documents under section 108 of the Housing and Urban Development Act to provide funds for the MVLC project and delegating authority to execute and deliver the note and related documents to the Mayor. INTRODUCTION/BACKGROUND: The Mount Vernon Library Commons Project is a multi-use municipal facility that is located within an economically distressed census tract; and will serve the residents of an area that has a high concentration of low-to-moderate income users by providing them with access to a new library, a community center, 3 floors of parking, a significant number of electric vehicle and bicycle parking infrastructure, as well as park-and-ride capacity. It is well-documented that libraries have a positive impact on poverty—ensuring that marginalized populations have convenient access to information, literacy resources, and connection to community services. Additionally, the City’s downtown area master plan identifies the project as a significant economic development catalyst. The location of the project meets the national objective of area benefit because the public facility will be located within an economically distressed census tract, and because the combined percentage of Low-Middle Income residents in the city of Mount Vernon is 54.59%. The facility will, therefore, serve a high concentration of our City’s low-to-moderate income (LMI) residents. The City put in a request for loan guarantee assistance under Section 108 of the Housing and Community development Act of 1974, and has been approved in the amount of $1,700,000. This funding will be used for the eligible activity of constructing the library portion of the Library Commons facility. FINDINGS/CONCLUSIONS: The City’s next step is to receive Council’s approval for this loan guarantee assistance contract, note and other related documents and for Council to grant delegating authority to execute and deliver these documents to the Mayor. Once all of these documents are completed and approved by the Mayor, the City then can request the loan funding. RECOMMENDATION: City staff is requesting Council’s approval of Ordinance No. 3872 of the City of Mount Vernon, Washington, approving and authorizing a loan guarantee contract and note and related documents under section 108 of the Housing and Urban Development Act of 1974, as amended to provide funds for the Mount Vernon Library Commons Project and Delegating Authority to execute and deliver the note and the contract and related documents to the Mayor.
