City of Mount Vernon City Council Meeting Minutes October 9, 2024 Police Court Campus, 1805 Continental Place Mayor Donovan called the meeting to order at 7:01 p.m. Present Councilmembers: Beaton, Brocksmith, Carías, Hudson, Molenaar, Tercero, and Vander Stoep Staff Present: Special Projects Manager Sexton, Finance Director Volesky, City Attorney Rogerson, Library Director Huffman, IT Director Thomas, City Clerk Jensen, Fire Chief Brice, Assistant Fire Chief Harris, Parks and Enrichment Services Director Berner, and Police Chief Christman Citizens: 10 APROVAL OF AGENDA The agenda was approved as presented. COMMUNITY COMMENTS  Ed Johnson, Mount Vernon resident, spoke about downtown traffic and pedestrian safety and Library Commons construction.  Alfredo Juarez, Sedro-Woolley resident, spoke about the H2A program and Casa Granda Apartments; requests a study session or committee item for Council discussion.  Suzanne Butler, Mount Vernon resident, spoke about the sale of Casa Grande apartments. Approval of October 9, 2024, Claims numbered 27493- 27618 in the amount of $ 1,786,734.27 Councilmember Beaton moved to approve Consent Agenda Items A – C. Motion seconded by Councilmember Vander Stoep. Motion passed 7-0. REPORTS A. Committees 1. Public Works and Library– see committee minutes for details 2. Public Safety – see committee minutes for details B. Councilmember Comments  Councilmember Hudson, spoke about downtown vehicle and pedestrian traffic.  Councilmember Vander Stoep requested a discussion with WAFLA and H2A representatives at an upcoming committee. December committee  Councilmember Brocksmith asked Mr. Juarez to share the press release he referred to during community comments. C. Mayor’s Report  There will be a ribbon cutting ceremony and open house for the Fire Station 2 remodel on October 19th, 10am – 2pm  Annual Veteran’s Food Drive: The City is collecting donations of non-perishable food and household goods October 1st – November 11th D. Committee Agenda Requests  Affordable housing protection action and displacement policies discussion NEW BUSINESS A. Public Hearing and Approval of Ordinance – Off-Street Parking: Ms. Pratschner requested the confirmation of the interim off-street parking regulations approved on August 14, 2024, with Ordinance 3897. Mayor Donovan opened the public hearing.  Kevin Maas, Mount Vernon resident, spoke in favor of approval of the ordinance. Councilmember Tercero moved to adopt Ordinance 3897, confirming the off-street parking regulations approved on August 14, 2024. Motion seconded by Councilmember Carías. Motion passed 7-0. B. Approval of Agreement – Evergreen Mountain Bike Alliance: Ms. Berner requested approval of a landowner agreement with Evergreen Mountain Bike Alliance for collaborative maintenance projects on mountain bike trails. The group will perform the work with the use of a 2025 Recreation Conservation Office grant. Councilmember Beaton moved to approve an agreement with Evergreen Mountain Bike Alliance for collaborative maintenance projects on mountain bike trails. Motion seconded by Councilmember Molenaar. Motion passed 7-0. C. Approval of Agreement – Economy Fence Center: Mr. Volesky requested approval of an agreement with Economy Fence Center to remove and replace the gate, gate control system, and exterior fencing at the Police Court Campus. Councilmember Tercero moved to approve an agreement with Economy Fence Center to remove and replace the gate, gate control system, and exterior fencing at the Police Court Campus in the amount of $159,344.12. Motion seconded by Councilmember Beaton. Motion passed 7-0. D. Approval of Agreement – Highline Pavement Maintenance: Mr. Volesky requested approval of an agreement with Highline Pavement Maintenance to remove and replace paving and install bollards associated with the gate replacement project at the Police Court Campus. Councilmember Molenaar moved to approve an agreement with Highline Pavement Maintenance for pavement removal and replacement and bollard installation in the amount of $51,265.25. Motion seconded by Councilmember Hudson. Motion passed 7-0. Mount Vernon City Council October 9, 2024 Page 4 of 4 EXECUTIVE SESSION The meeting convened into Executive Session at 7:40 p.m. for a period of fifteen minutes to discuss with legal counsel matters relating to agency enforcement actions, or to discuss with legal counsel representing the agency litigation or potential litigation to which the agency, the governing body, or a member acting in an official capacity is, or is likely to become, a party, when public knowledge regarding the discussion is likely to result in an adverse legal or financial consequence to the agency. ADJOURNMENT Next Ordinance 3897 Next Resolution 1061 NEW BUSINESS ITEM: A DATE: October 9, 2024 TO: Mayor Donovan and City Council FROM: Stacie Pratschner, Development Services SUBJECT: Interim Off-Street Parking Regulations, 60-Day Hearing RECOMMENDED ACTION: Council holds a hearing, deliberates, and provides staff with direction regarding adoption of the accompanying Ordinance. INTRODUCTION/BACKGROUND: On August 14, 2024, Council declared an emergency necessitating immediate enaction of interim regulations related to off-street parking standards contained in Ordinance 3894 (attached). State law (RCW 36.70A.390 and RCW 35A.63.220) requires Council to hold a public hearing within 60 days of the enactment of interim regulations. The hearing tonight is the required 60-day hearing. FINDINGS/CONCLUSIONS: Please see the accompanying proposed Ordinance containing the findings and conclusions regarding the proposed Ordinance before Council this evening. ATTACHED: • Ordinance 3894 • Ordinance for Council’s consideration NEW BUSINESS ITEM: B DATE: October 9, 2024 TO: Peter Donovan and City Council FROM: Jennifer Berner, Parks & Enrichment Services Director SUBJECT: EVERGREEN MTN BIKE ALLIANCE LANDOWNER AGREEMENT-TRAIL MAINTENANCE RECOMMENDED ACTION: Staff recommends Council approve the Mayor to enter into the Landowner Agreement with Evergreen Mountain Bike Alliance for mountain bike trail maintenance. INTRODUCTION/BACKGROUND: The purpose of this agreement is to describe the terms, conditions, and obligations agreed upon between Evergreen Mtn. Bike Alliance, who is undertaking projects administered through the Recreation Conservation Office, (RCO), and the City, the landowner on which the property will take place. Mount Vernon is one of many cities that receives assistance from Evergreen Mountain Bike Alliance for mountain bike trail maintenance. The focus in Mount Vernon is Little Mountain Park. Evergreen will provide hours of volunteer labor of popular trails to mountain bikers, hikers, and equestrians throughout the region. The result is many miles of high-quality trail maintenance, engagement of community members in protecting and valuing our public lands, as well as generating and educating the next generation of trail stewards. Evergreen shall obtain permission from the City of Mount Vernon for each trail maintenance project prior to the commencement of work. This has been a past practice and has worked well. The agreement begins November 1, 2025, and concludes October 31, 2027. FINDINGS/CONCLUSIONS: None RECOMMENDATION: Staff request approval for the Mayor to enter into a Landowner Agreement with Evergreen Mountain Bike Alliance for collaborative maintenance projects on mountain bike trails. ATTACHED: Recreational Trails Program – Landowner Agreement for Maintenance Projects NEW BUSINESS ITEM: C DATE: October 9, 2024 TO: Mayor Donovan and City Council FROM: Doug Volesky - Finance Director SUBJECT: MOUNT VERNON POLICE COURT CAMPUS FENCING, GATE AND GATE CONTROLS REMOVAL AND REPLACEMENT PROJECT RECOMMENDED ACTION: City Staff recommends City Council authorize the Mayor to enter into a contract with Economy Fence Center to remove and replace the Police Court Campus antiquated gate, gate control system and exterior fencing for the amount of $159,344.12 which includes tax. This project is ARPA funded and previously approved by City Council. INTRODUCTION/BACKGROUND: Economy Fence will remove and install all fencing associated with the PCC, north and south gates, and automated gate control systems. FINDINGS/CONCLUSIONS: City Staff recommends City Council authorize the Mayor to enter into agreement with Highline Pavement Maintenance in the amount of $159,344.12 which includes tax. RECOMMENDATION: City Staff recommends City Council authorize the Mayor to enter into agreement with Highline Pavement Maintenance in the amount of $159,344.12 which includes tax. This project is ARPA funded and previously approved by City Council. ATTACHED: Cost Estimate and Draft Contract NEW BUSINESS ITEM: D DATE: October 9, 2024 TO: Mayor Donovan and City Council FROM: Doug Volesky - Finance Director SUBJECT: MOUNT VERNON POLICE PAVEMENT REMOVAL AND REPLACEMENT PROJECT RECOMMENDED ACTION: City Staff recommends City Council motion to authorize the Mayor to enter into a contract with Highline Pavement Maintenance to remove and replace all paving and install required bollards to facilitate a smooth transition when the antiquated gate, gate control system are removed and replaced for the amount of $51,265.25 which includes tax. This project is ARPA funded and previously approved by City Council. INTRODUCTION/BACKGROUND: Paving work is required at the north gate assembly that will include removing pavement curbing and bollards associated with the current gate system and replacing it with pavement and bollards that meet the new gates design specifications. This pavement preservation work is essential to the installation of the new gate system. FINDINGS/CONCLUSIONS: City Staff recommends City Council authorize the Mayor to enter into agreement with Highline Pavement Maintenance in the amount of $51,265.25 which includes tax.
