CALL TO ORDER Chair Capriles called the Environmental Planning Commission (EPC) meeting to order. 2. ROLL CALL Present 7 - Commissioner Pamela Baird, Commissioner Robert Cox, Commissioner Hehmeyer, Commissioner Ellen Kamei, Commissioner Lisa Matichak, Vice Chair John Scarboro, and Chairperson Margaret Capriles. Absent 0 3. MINUTES APPROVAL 3.1 Minutes Approval Motion - M/S Cox / Scarboro - That the EPC: Approve the minutes for September 7, 2016. Chair Capriles opened the floor for public testimony asking if anyone from the public wished to speak. No members of the public wished to speak. The motion carried on the following vote: Yes: 7 - Commissioner Baird, Commissioner Cox, Commissioner Hehmeyer, Commissioner Kamei, Commissioner Matichak, Vice Chair Scarboro, and Chairperson Capriles. Chair Capriles opened the floor for public testimony asking if anyone from the public wished to speak. No members of the public wished to speak. The motion carried on the following vote: Yes: 7 - Commissioner Baird, Commissioner Cox, Commissioner Hehmeyer, Commissioner Kamei, Commissioner Matichak, Vice Chair Scarboro, and Chairperson Capriles. No: 0 4. ORAL COMMUNICATIONS FROM THE PUBLIC - None. 5. PUBLIC HEARING 5.1 Zoning Ordinanc Update - Non Conforming Uses and Structures. Planner Pancholi gave an oral report and responded to questions raised by the EPC. Chair Capriles opened the floor for public testimony asking if anyone from the public wished to speak. No members of the public wished to speak. The EPC deliberated this item. MOTION - MS - Kamei / Scarboro - That the EPC: Adopt a resolution recommending that the City Council approve zoning text amendments to article XVII, Section 36.06.80 and Section 36.06.85, of the Mountain View City Code, relating to seismic retrofits of legal nonconforming soft-story structures. MOTION - MS - Cox / Baird - That the EPC: Adpopt the policy as recommended and add to future EPC agendas. Yes 7 - Commissioner Pamela Baird, Commissioner Robert Cox, Commissioner Hehmeyer, Commissioner Ellen Kamei, Commissioner Lisa Matichak, Vice Chair John Scarboro, and Chairperson Margaret Capriles. Recommendation: That the EPC approve the minutes for September 21, 2016. Attachments: September 21, 2016 Minutes Copies of the minutes for the above-noted meetings have been delivered to Commissioners and copies are available at City Hall. If there are no corrections or additions, a motion is in order to approve these minutes. 4. ORAL COMMUNICATIONS FROM THE PUBLIC This portion of the meeting is reserved for persons wishing to address the Commission on any matter not on the agenda. Speakers are limited to three minutes. PUBLIC HEARING 5.1 Zoning Ordinance Update - Non Conforming Uses and Structures. Consideration of amendments to the Zoning Ordinance (Title 36 of the City Code) Section 36.06.80 (Nonconforming uses of structures or buildings) and Section 36.06.85 (Nonconforming structures or buildings) to allow seismic upgrades to non-conforming structures containing soft, weak, or open fronts. Recommendation: Provide recommendations to the City Council on proposed text amendments to the Zoning Ordinance (Title 36 of the City Code) Section 36.06.80 (Nonconforming uses of structures or buildings) and Section 36.06.85 (Nonconforming structures or buildings) to allow seismic upgrades to non-conforming structures containing soft, weak, or open fronts. The proposed amendments to the Zoning Ordinance are categorically exempt from environmental review under the California Environmental Quality Act (CEQA) based on Section 15301 (“Existing Facilities”), Section 15302 (“Replacement or Reconstruction”), and Section 15305 (“Minor Alterations in Land Use Limitations”), and because it does not “have the potential for causing a significant effect on the environment”-Section 15061(b)(3). Attachments: Staff Report Exhibit 1 6. NEW BUSINESS 6.1 EPC Meeting Time Limits. Recommendation: Consider adopting a policy regarding a meeting time limit. Attachments: Staff Memo 7.
