CALL TO ORDER: 3:31 P.M. 1.A. Roll Call: Present: 4- Councilmember Gentry, Councilmember Mott, Councilmember Sedgley, and Mayor Techel Absent: 1- Vice Mayor Inman 2. AGENDA REVIEW AND SUPPLEMENTAL REPORTS: City Clerk Roberts announced that staff requested that the noticed Closed Session be cancelled and that Item 14 B be continued to the December 5th Regular City Council meeting. She stated since the latter was a noticed public hearing, public comment should be allowed when the item was considered during the Evening Session. 3. SPECIAL PRESENTATIONS: 3.A. 1148-2017 Arbor Day City Councilmembers read the proclamation. Tree Commissioners Huttinger and Sauer were present to accept the proclamation, along with City Parks and Trees Facilities Manager Perazzo. 4. PUBLIC COMMENT: James Hinton, resident, spoke regarding his attendance at a recent cannabis workshop held in Sacramento. Olivia Dodd, representing Arts Council Napa Valley, thanked Council for their consideration of Item 5B. Councilmember Mott commented briefly on Item 5D. Approval of the Consent Agenda A motion was made by Councilmember Mott, seconded by Councilmember Sedgley, to approve the Consent Agenda with Item 5C removed for discussion. The motion carried by the following vote: Aye: 4- Gentry, Mott, Sedgley, and Techel Absent: 1- Inman 5.A. 1090-2017 Adopted Resolution R2017-140 amending the City Classification Plan by adopting a new Classification Specification and Salary Range for Parking Programs Manager. Enactment No: R2017-140 5.B. 1110-2017 Arts Council Napa Valley Advisory and Advocacy Services Adopted Resolution R2017-141 authorizing a $15,000 transfer from the General Fund to the Nonrecurring General Fund; and authorizing the City Manager to execute an Agreement for Services with Arts Council Napa Valley in an amount not to exceed $15,000 for art advisory and advocacy services associated with matching funds for a grant from the Hewlett Foundation. Enactment No: R2017-141 5.C. 1127-2017 Extension of Pro Tem City Manager Appointment James Hinton, resident voiced concerns regarding the Police Chief's added responsibilities as City Manager Pro Tem and commented on school board meeting issues. A motion was made by Councilmember Mott, seconded by Councilmember Sedgley, to adopt Resolution R2017-142 extending the appointment of Police Chief Steve Potter to serve as the Pro Tem City Manager through January 16, 2018. The motion carried by the following vote: Aye: 4- Gentry, Mott, Sedgley, and Techel Absent: 1- Inman Enactment No: R2017-142 5.D. 1096-2017 Grant from Napa Valley Community Foundation Authorized the Finance Director to accept a grant from the Napa Valley Community Foundation, via the Kaiser Northern California Community Benefit Program in the amount of $588,000. CITY OF NAPA Page 2 Printed on 11/9/2017 CITY COUNCIL MEETING MINUTES - Final October 17, 2017 5.E. 1132-2017 Monthly Budget and Investment Statement Received and filed the Monthly Budget and Investment Statement as of August 31, 2017. 5.F. 1134-2017 Pavement Management Program Adopted Resolution R2017-143 authorizing an additional appropriation of $43,000 for the Pavement Management Program. Enactment No: R2017-143 5.G. 1138-2017 Traffic Safety Program Grant Funding Adopted Resolution R2017-144 authorizing acceptance of a grant from the Office of Traffic Safety, State of California, and authorizing a budget appropriation of $115,000 for the Selective Traffic Enforcement Program Grant for Fiscal Year 2017-2018. Enactment No: R2017-144 6. ADMINISTRATIVE REPORTS: 6.A. 1146-2017 Southern Lake-Napa Unit Complex Fire The City's response to the South Lake-Napa Unit Complex Fire, including information regarding damage assessments and current status reports were provided by Police Chief Potter, Napa County Assistant Fire Chief, City of Napa Fire Chief Brassfield, and Joy Eldridge Water Division Manager. Councilmember comments ensued. Mayor Techel called for public comment. None were provided. 6.B. 1144-2017 Fiscal Year 2016/17 Fourth Quarter Report Brian Cochran, Finance Director, provided the information regarding the Fourth Quarter Financials report for the City of Napa. Comments and questions ensued. A motion was made by Councilmember Sedgley, seconded by Councilmember Gentry, to Receive and file the Fourth Quarter Report for Fiscal Year 2016/17. The motion carried by the following vote: Aye: 4- Gentry, Mott, Sedgley, and Techel Absent: 1- Inman 6.C. 1136-2017 Process to fill one upcoming Council Vacancy City Clerk Roberts briefed City Council regarding their options to fill the upcoming vacancy that would occur as a result of Councilmember Inman's CITY OF NAPA Page 3 Printed on 11/9/2017 CITY COUNCIL MEETING MINUTES - Final October 17, 2017 departure prior to her term ending November 2018. She provided the requirements to fill a vacancy as prescribed in the City Charter, the cost for a special election, history of previous appointments, and information regarding Councilmember Inman's assignments on county and regional boards and commissions. Mayor Techel called for public comment. James Hinton, resident, stated a Special Election should be called. Councilmember Sedgley suggested that Council consider Councilmember Inman's assignments to boards and committees prior to the Council deliberating on the appointment process; Mayor Techel and Council agreed. NOMINATION COMMITTEE APPOINTMENT Councilmember Mott moved, seconded by Mayor Techel, to appoint Councilmembers Sedgley and Gentry to the City of Napa Nomination Committee. The motion was carried unanimously. LAFCO APPOINTMENT Councilmember Mott moved, seconded by Councilmember Gentry, to recommend that Councilmember Sedgley serve Councilmember Inman's remaining term on LAFCO. The motion was carried unanimously. Discussion ensued regarding the appointment process, including the advantages of appointing a former councilmember, current or former planning commissioners, and the timing constraints involved. It was agreed that holding a Special Election in June of 2018 to elect a Councilmember to serve until November 2018 would not be in the best interest of the City. Councilmembers Mott and Gentry stated they were comfortable with an appointment of a former councilmember; Mayor Techel agreed. Councilmember Sedgley stated he was opposed to making it strictly a former councilmember and stated that opening up to current or former planning commissioners or those that were previously appointed to Council or those that were currently campaigning for municipal office would be his preferred choice. A motion was made by Councilmember Gentry, seconded by Councilmember Mott, to approve an appointment process to fill the vacancy created by Councilmember Inman's departure which would be open to former elected city councilmembers only, and to have applicants complete an application, set November 14th to consider and make the appointment, and to cancel the November 21st Regular City Council meeting. After the vote, it was agreed to provide a "scaled back" application similar to the 2014 appointment process, hold a special meeting on November 14th for interviews and appointment, and to cancel the November 21st Regular City Council meeting. 7. COMMENTS BY COUNCIL OR CITY MANAGER: Councilmembers praised the response to the fire event; Mayor Techel stated the event was very humbling and she was very proud of the way in which employees and emergency personnel responded. 8. Bernie Narvaez, Parks and Recreation Advisory Commissioner, expressed his thanks to the first responders and their response to the wildfires. 14. PUBLIC HEARINGS/APPEALS: 14.A. 1057-2017 Big Ranch Road Widening Project Mayor Techel announced the item. Assistant Engineer Rosa Corona provided the staff report. Councilmembers provided disclosures. Mayor Techel called for public comment. Patrick Band, with Napa County Bicycle Coalition, voiced concerns that the plan did not include both north and south bike lanes and stated he supported incorporating Class 2 bike lanes in both directions. Michael Imfeld, owner of 2033 Big Ranch Road, voiced concerns regarding noise mitigation, no sound wall, and what he perceived as proper analysis of the impact of sound to the residents. BRR (inaudible), voiced concern that her home and four others would be impacted by increased sound and urged Council to vote no and bring the item back after a proper sound analysis. There being no other comments from the public, Councilmember Mott moved to close the public hearing, seconded by Councilmember Gentry. The motion was carried unanimously (Inman absent). Council proceeded with questions regarding bike lanes and sound walls. Jack LaRochelle, Public Works Director, commented on a pedestrian bridge and the second bike lane which were not included in this particular project. Phil Ault, consultant, stated the increase in sound would be barely perceptible. In response to a question, staff stated the road was considered a minor arterial. Discussion continued on the merits of the project. A motion was made by Councilmember Mott, seconded by Councilmember Sedgley, to adopt Resolution R2017 145 approving the Big Ranch Road Widening Project Preliminary Design and to adopt a Final Initial Study/Mitigated Negative CITY OF NAPA Page 6 Printed on 11/9/2017 CITY COUNCIL MEETING MINUTES - Final October 17, 2017 Declaration and Mitigation Monitoring Reporting Program in accordance with CEQA. The motion carried by the following vote: Aye: 4- Gentry, Mott, Sedgley, and Techel Absent: 1- Inman Enactment No: R2017-145 14.B. 1087-2017 Amendment to Processes for Hotel Use Permits and Design Review Permits Mayor Techel stated that staff had requested continuance to the December 5th City Council meeting. She called for any member of the public who wished to speak to come forward, no one came forward. A motion was made by Councilmember Gentry, seconded by Councilmember Mott, to continue the item to the December 5, 2017 Regular City Council meeting. The motion carried by the following vote: Aye: 4- Gentry, Mott, Sedgley, and Techel Absent: 1- Inman 15. COMMENTS BY COUNCIL OR CITY MANAGER: Councilmember Gentry stated she understood that the bike lane issue was important to the Bike Coalition, and asked them to continue to be involved in projects. 16.
