MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING DECEMBER 1, 2009 1. Mayor Robert Mezzo called the meeting to order at 6:30 p.m. with the following in attendance: BURGESSES: RESIDENTS: 6 T. K. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the minutes of the regular meeting of November 3, 2009. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of November. Each member received copies for review. 5. Motion by Deputy Mayor Rossi and seconded by Burgess Neth to recess to Executive Session at 6:32p.m. for discussion on the following: Collective Bargaining (UPSEU) inviting in Attorney N. W. Hess III. Motion was rescinded. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to recess to Executive Session at 6:33p.m. for discussion on the following: Real Estate (Potential Lease), Collective Bargaining (UPSEU) inviting in Attorney N. W. Hess III. Mayor Mezzo reconvened the meeting at 7:00 p.m.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – December 1, 2009 6. The following motion emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize the Mayor to enter into a memorandum of agreement dated November 19, 2009 between the Borough of Naugatuck, the Borough of Naugatuck United Public Service Employees Union Local 424 Unit 15 and Mrs. Celia Urbano. 7. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses add to the agenda discussion/possible action on the authorization of a pre- renovation environmental service. 8. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Director of Public Works Jim Stewart to enter into an agreement to authorize pre-renovation environmental consulting services not to exceed $2,700. 9. Public Comment Residents spoke on the following issues: • the elimination of municipal trash removal for multi-rental properties • the Board of Education Chairman’s behavior was appalling at the last meeting • no tax increase for residents due to the Board of Education situation • there are stones on Field Street and Harlow Court. 10. Burgess Comments/Sub-Committee Reports Burgess Campbell stated he was upset executive session at the recent Board of Education meeting was over two and a half hours. He said people sat and waited with children. He asked if there was anything they could do as a Board about the situation with the Board of Education. Deputy Mayor Rossi asked the Board to take a vote of no confidence in the Superintendent of Schools. She said there is no faith or confidence in the superintendent. The Deputy Mayor would like to move forward in a positive manner. She said next year is going to be a difficult budget. She understands the vote of no confidence has no legal bearing but as leaders of this town she feels the Board needs to take a stand. VOTED: Motion by Deputy Mayor Rossi and seconded by Burgess Campbell to add to the agenda for a vote of no confidence from this Board in the current leadership at the Board of Education. VOTED: Motion by Deputy Mayor Rossi and seconded by Burgess Campbell to make a symbolic vote of no confidence in our Superintendent by the Board of Burgesses. Burgess Comments/Sub-Committee Reports continued Burgess Scully spoke on proceeding with plans for the work at Jesse Camille’s. Burgess Fragoso said she will investigate to see if there is a way the Superintendent can be made to step down. She thanked the teachers, the unions, non union people and Wayne for all they have done toward finding a solution. She wants to work with the Board of Education to move forward so they are able to resolve it on their own. Burgess Burns thinks everyone should band together to find a resolution to the Board of Education situation. He said Wayne and the Mayor are fine gentlemen working toward a solution. Burgess Woodfield asked if anyone in Hartford was able to help with the Board of Education issue. Burgess Neth said the Board of Mayor and Burgesses have no power or authority to make the Superintendent resign. The members of the Board of Education are. Burgess Ciacciarella said Attorney McSherry is working on an ordinance for Union City. The Odor Evaluation Study was discussed at the WPCA meeting. Upgrades are required to alleviate odor problems. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve and set the salary of the Animal Control Officer at $30,000. in accordance with Chapter 90 Bargaining Unit as recommended by Jeannette Deschesnes, Director of Human Resources. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses refer to the Joint Boards of Mayor and Burgesses and Finance Board a transfer request of $4,990. from Contingency to Naugatuck Youth Services for The Supply and Installation of a Fire Alarm System as recommended by Mike Massicotte, Facilities Manager. 18. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution and charter revision to Article IV, Officers and Employees, Division 1 Generally, Secs. 2-141 – 2-150 Reserved: WHEREAS, the Borough of Naugatuck (the “Borough”) may establish one or more trust funds to hold and invest contributions and assets of the Borough’s retiree employee health and life systems pursuant to Section 7-450(a) of the General Statutes of Connecticut (the “Statute”); and WHEREAS, the Statute requires that such trust shall be authorized by ordinance; and WHEREAS, the Board of Mayor and Burgesses desires to establish such trust or trusts and fund such trusts with money from its General Fund. NOW, THEREFORE, BE IT RESOLVED that: 1. The Amendment to the Borough’s Code of Ordinances, attached hereto (the “Amendment”), is hereby approved. The Borough Clerk is directed to publish such Amendment at least twice in accordance with Section 63, subsection 45 of the Charter of the Borough. 2. The Board hereby recommends to the Board of Finance that it approve the transfer of $750,000 from the Borough’s General Fund, specifically the Internal Services Fund entitled “Town Insured Fund” to the trust or trusts which shall be established pursuant to the Amendment and that such funds shall be allocated to the trust or trusts as determined by the Controller of the Borough. AMENDMENT That the Code of Ordinances (the “Code”), Borough of Naugatuck, Connecticut (the “Borough”) is hereby amended by adding a section, to be Section 2-141, which section reads as follows:  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – December 1, 2009 §2-141. Retiree Health Care Trusts. A. In accordance with Conn. Gen. Stat. § 7-450(a), the Borough hereby establishes one or more Trust Funds (collectively the “Trusts”) to hold and invest all contributions and assets of the Borough’s retiree health and life benefit plan or plans (the “Plan”). The Board of Mayor and Burgesses of the Borough shall have the authority to amend or terminate the Trusts. B. The Trusts shall be for the purpose of funding current and future post- employment health care and life benefits for eligible retired employees in accordance with the Plan. For purposes of this section, employee shall mean any employee and former employee entitled to participate in the Plan. The Trusts may also be used for the purpose of funding any other post-employment health and life benefit plans as the Borough may establish. C. The Trusts shall be administered by the Pension Board described in Section 2.153. The Pension Board shall have such powers and duties as set forth in Section 2.153 and the terms of the Trusts, including directing the investment of the assets of the Trusts. D. As soon as possible after the enactment of this section, the Pension Board shall have a trust agreement or agreements drawn to create the Trusts. E. The Pension Board shall serve as the trustees (the “Trustee”) of the Trust. The Trustee shall have such powers and duties as set forth in the terms of the Trust, including, but not limited to, making payments or other disbursements in accordance with the Plan and the terms of the Trusts. F. The Pension Board shall serve as the Plan Administrator of the Plan and shall have such powers and duties as set forth in the Plan with respect to the administration of the Plan, including, but not limited to, providing all proper instructions and directions to the Trustee regarding disbursements from the Trusts. Discussion regarding the need to update and revise Ordinance 87, Sec. 3.5-1 – 3.5-11, Alarm Systems in the Naugatuck Code of Ordinances. 20. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the following resolution for the Naugatuck Day Care Center: RESOLVED, that ROBERT A MEZZO, MAYOR, BOROUGH OF NAUGATUCK, is empowered to enter into or amend contractual instruments in the name and on behalf of the Borough of Naugatuck, with the Department of Social Services of the State of Connecticut for a Child Day Care program if such an agreement is offered and to have the corporate seal affixed to all documents required as a part of any offered agreement and RESOLVED: that the Borough of Naugatuck hereby adopts as its policy to support the nondiscrimination agreements and warranties required under Connecticut General Statutes 4a-60(a)(1), as amended in State of Connecticut Public Act 07-245 and section 9 (a) (1) of Public Act 07-142, as those statutes may be amended from time to time. Public Comment Residents spoke on the following issues: • bringing in one of the top people in the world to help with the waste water treatment plant • the Board of Education issue • broken windows at the floor level in the lobby 22. Burgess Comments/Sub-Committee Reports Burgess Kuczenski voted no for the Animal Control Officer because he feels we should hire someone from town. He also would like to see the Sidewalk Ordinance published in the paper for property owners. Burgess Ciacciarella wished everyone a Happy Holiday. He also wanted to congratulate the DARE essay winners. Burgess Neth spoke about the apartments with trash issues. He wished everyone a happy holiday. Burgess Woodfield wished everyone Happy Holidays.  -11- Minutes – Board of Mayor and Burgesses Regular Meeting – December 1, 2009 Deputy Mayor Rossi thanked the Veterans for the excellent parade and ceremonies. She thanked Chief Edson, Officer Fidanza and Officer Scoffield on a phenomenal job with the DARE program. She commended Jim Stewart for a good job with the snow meeting. The Deputy Mayor thanked Ray Lennon for coordinating the budget workshops and the Mayor for organizing the Triboard meetings. She thanked the teachers’ union for their concessions. The Deputy Mayor acknowledged Anne Butler, VNA Director, for her thirty-two years of service to the Borough. (Deputy Mayor Rossi’s comments are attached as submitted.) Mayor Mezzo wished everyone a Happy Holiday. Burgess Burns felt they did a fine job with the Veterans Day Parade. He gave kudos to Pat Scully and the Catholic War Veterans. He wished everyone a Merry Christmas and Happy New Year. Burgess Fragoso spoke about the multi dwelling trash pick up. She suggested private roads should not have trash pick up. She thanked Town Hall employees for the silent auction and all the events they put on. She thinks it builds morale. Burgess Fragoso also thanked the Ecumenical Council of Churches for the food baskets this season. She challenged the young people in the audience to come back to Naugatuck after they graduate from college and keep the town going. She wished everyone a Blessed Christmas and a Healthy New Year. Burgess Scully would like to see the Triboard meetings continue. He congratulated the young people for standing up and voicing their opinions. He wished everyone a Very Merry and Blessed Christmas and a Happy New Year. Burgess Campbell said he supports Burgesses Ciacciarella and Kuczenski in voting no for the Animal Control Officer. He thanked the teachers for the concessions. He discussed the lack of trust with the Board of Education come budget time. He said their biggest asset is Wayne McAllister. He wished everyone a Happy Holiday. 23.
