VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the minutes of the regular meeting of August 2, 2011. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the monthly reports of August. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to recess to Executive Session at 6:02 p.m. for discussion on the following: Real Estate (Negotiations), Collective Bargaining (Police Bargaining Unit Proposals) inviting in Human Resources Director J. Deschesnes, Attorney E. Fitzpatrick and Controller Wayne McAllister. Mayor Mezzo reconvened the meeting at 7:00 p.m.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 6. There were no motions emanating from Executive Session. 7. Public Comment – None 8. Burgess Comments – Open Topic Deputy Mayor Rossi thanked Mayor Mezzo, Chief Hanks, Deputy Chief Murray, Second Assistant Chief Russell, Chief Edson, Deputy Chief Bernegger, Jim Stewart, Bob Roland and Ed Carter for their tireless efforts during Hurricane Irene. She also thanked the residents for their patience. She spoke about the positive community spirit that came through the hurricane’s aftermath. The Deputy Mayor Rossi thanked the Elks Lodge for always remembering September 11th. Mayor Mezzo thanked the Deputy Mayor, Bob Roland, Dave Heller, Dr. Tindall- Gibson, Wayne Malicki, Fran Dambowsky and CL&P Local representative Dave Driver and CL&P Regional representative Matt Hickey for everything they did during and after the storm. For the first time in the borough, the same law firm is representing the borough and the Board of Education for all labor and employment matters. Burgess Burns thanked everyone for helping the Board of Education members with the start of the new school year. Burgess Scully thanked everyone for their hard work during and after the hurricane. He thanked Fran Dambowsky and his crew. 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Mary Ann Reilly, 170 Meadow Street, Naugatuck, CT 06770 as a regular member of the Human Resource Development Board, term to expire October 1, 2014. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Brian Newman, 211 Spring Street, Naugatuck, CT 06770 as a regular member of the Human Resource Development Board, term to expire October 1, 2014. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the reappointment of Michael Falcha, Jr. (D), 78 Tanglewood Lane, Naugatuck, CT 06770 as a regular member of the Park Commission, term to expire September 1, 2016.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 12. Mayor Mezzo appointed Stephanie Gunnoud Savoy (R), 1081 New Haven Road 2A, Naugatuck, CT 06770 as an alternate member of the Police Commission, filling the unexpired term of C. Ford, term to expire October 1, 2013. 13. Mayor Mezzo reappointed Andy Barnes (D), 16 Coventry Lane, Naugatuck, CT 06770 as an alternate member of the Police Commission, term to expire October 1, 2016. 14. Mayor Mezzo reappointed Theresa Swanson, 36 Fuller Street, Naugatuck, CT 06770 as a member of the Housing Authority, term to expire October 1, 2016. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the confirmation of the following appointment: Assistant Registrar of Vital Statistics: Term: From September 7, 2011 to July 1, 2013 Mrs. Terry Magnamo, 41 Bridle Trail Drive, Naugatuck, CT 06770 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, "National Preparedness Month" creates an important opportunity for every resident of the Borough of Naugatuck to prepare their homes, businesses, and communities for any type of emergency including natural disasters and potential terrorist attacks; and WHEREAS, investing in the preparedness of ourselves, our families, businesses, and communities can reduce fatalities and economic devastation in our communities and in our nation; and WHEREAS, the Federal Emergency Management Agency's Ready Campaign, Citizen Corps and other federal, state, local, tribal, territorial, private, and volunteer agencies are working to increase public activities in preparing for emergencies and to educate individuals on how to take action; and WHEREAS, emergency preparedness is the responsibility of every citizen of the Borough of Naugatuck and all citizens are urged to make preparedness a priority and work together, as a team, to ensure that individuals, families, and communities are prepared for disasters and emergencies of any type; and  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 WHEREAS, all citizens of the Borough of Naugatuck are encouraged to participate in citizen preparedness activities and asked to review the Ready campaign's websites at Ready.gov or Listo.gov (in Spanish) and become more prepared. THEREFORE, BE IT RESOLVED that the Board of Mayor and Burgesses hereby proclaim September, 2011 as National Preparedness Month, and encourages all citizens and businesses to develop their own emergency preparedness plan, and work together toward creating a more prepared society. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses designate the month of September, 2011 as National Alcohol and Drug Addiction Recovery Month in the Borough of Naugatuck. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses join The Leukemia & Lymphoma Society in designating the month of September, 2011 as Leukemia, Lymphoma & Myeloma Awareness Month in the Borough of Naugatuck. 19. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses proclaim the week of September 5-11, 2011 as National Patriotism Week in the Borough of Naugatuck. 20. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses proclaim the week of September 17-23, 2011 as Constitution Week in the Borough of Naugatuck. 21. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, the governing body of the Borough of Naugatuck expresses their support of the United State's Senate regarding coming together as a Nation and ceasing all work or other activity for a Moment of Remembrance beginning at 1:00 p.m. Eastern Daylight Time on September 11, 2011, in honor of the 10th anniversary of the terrorist attacks committed against the United States on September 11, 2001; and  -5- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 6, 2011 WHEREAS, at 8:46 a.m., on September 11, 2001, hijacked American Airlines Flight 11 crashed into the upper portion of the North Tower of the World Trade Center in New York City, New York; and WHEREAS, 17 minutes later, at 9:03 a.m., hijacked United Airlines Flight 175 crashed into the South Tower of the World Trade Center; and WHEREAS, at 9:37 a.m., the west wall of the Pentagon was hit by hijacked American Airlines Flight 77, the impact of which caused immediate and catastrophic damage to the headquarters of the Department of Defense; and WHEREAS, at approximately 10:00 a.m., the passengers and crew of hijacked United Airlines Flight 93 acted heroically to retake control of the airplane and thwart the taking of additional American lives by crashing the airliner in Shanksville, Pennsylvania, and, in doing so, gave their lives to save countless others; and WHEREAS, nearly 3,000 innocent civilians were killed in the heinous attacks of September 11, 2001; and WHEREAS, tens of thousands of individuals narrowly escaped the attacks at the Pentagon and World Trade Center and, as witnesses to this tragedy, are forever changed; and WHEREAS, countless fire departments, police departments, first responders, governmental officials, workers, emergency medical personnel, and volunteers responded immediately and heroically to those horrific events; and WHEREAS, the Fire Department of New York suffered 343 fatalities on September 11, 2001, the largest loss of life of any emergency response agency in United States history; and WHEREAS, the Port Authority Police Department suffered 37 fatalities in the attacks, the largest loss of life of any police force in United States history in a single day; and WHEREAS, the New York Police Department suffered 23 fatalities as a result of the terrorist attacks; and WHEREAS, the impact of that day on public health continues through 2011, as nearly 90,000 people are at risk of or suffering from negative health effects as a result of the events of September 11, 2001, including 14,000 workers and 2,400  -6- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 6, 2011 community residents who are sick, and tens of thousands of others whose health is being monitored; and WHEREAS, 10 years later, the people of the United States and people around the world continue to mourn the tremendous loss of innocent life on that fateful day; and WHEREAS, 10 years later, thousands of men and women in the United States Armed Forces remain in harm's way defending the United States against those who seek to threaten the United States; and WHEREAS, on the 10th anniversary of this tragic day, the thoughts of the people of the United States are with all of the victims of the events of September 11, 2001 and their families; and WHEREAS, the lives of Americans were changed forever on September 11, 2001, when events threatened the American way of life; and WHEREAS, in 2009, Congress and the President joined together to designate September 11 as a National Day of Service and Remembrance under the Serve America Act (Public Law 111-13; 123 Stat. 1460); and WHEREAS, in September 2009 and 2010, President Obama issued Proclamation 8413 (74 Fed. Reg. 47045) and Proclamation 8559 (75 Fed. Reg. 56463) proclaiming September 11, 2009, and September 11, 2010, respectively, as Patriot Day and National Day of Service and Remembrance; and WHEREAS, September 11 will never, and should never, be just another day in the hearts and minds of all people of the United States; NOW, THEREFORE BE IT RESOLVED that the governing body of the Borough of Naugatuck: (1) recognizes September 11, 2011, as a day of solemn commemoration of the events of September 11, 2001, and a day to come together as a Nation; and (2) offers its deepest and most sincere condolences to the families, friends, and loved ones of the innocent victims of the September 11, 2001, terrorist attacks; and (3) honors the heroic service, actions, and sacrifices of first responders, law enforcement personnel, State and local officials, volunteers, and countless others who aided the innocent victims of those attacks and, in doing so, bravely risked and often gave their own lives; and  -7- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 6, 2011 (4) recognizes the valiant service, actions, and sacrifices of United States personnel, including members of the United States Armed Forces, the United States intelligence agencies, the United States diplomatic service, homeland security and law enforcement personnel, and their families, who have given so much, including their lives and well-being, to support the cause of freedom and defend the security of the United States; and (5) reaffirms that the people of the United States will never forget the challenges our country endured on and since September 11, 2001, and will work tirelessly to defeat those who attacked the United States; and BE IT FURTHER RESOLVED that on the 10th anniversary of this tragic day in United States history the governing body of the Borough of Naugatuck calls upon all of the people and institutions of the United States to observe a moment of remembrance on September 11, 2011, including (i) media outlets; (ii) houses of worship; (iii) military organizations; (iv) veterans organizations; (v) airlines; (vi) airports; (vii) railroads; (viii) sports teams; (ix) the Federal Government; (x) State and local governments; (xi) police, fire, and other public institutions; (xii) educational institutions; (xiii) businesses; and (xiv) other public and private institutions; and BE IT FURTHER RESOLVED that the governing body of the Borough of Naugatuck encourages the observance of the Moment of Remembrance to last for one minute beginning at 1:00 p.m. Eastern Daylight Time by, to the maximum extent practicable ceasing all work or other activity; and marking the moment in an appropriate manner, including by ringing bells, blowing whistles, or sounding sirens. Ciacciarella Motion carried 9-0-0 Mayor Mezzo asked everyone to observe a brief moment of silence for all those who perished on September 11th and all those who have perished since defending our freedoms in Iraq and Afghanistan and those who continue to serve. 22. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the Temporary Access and Construction Easement for the  -8- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 purpose of repairing the breached drainage ditch to the property of Indian Hill South Homeowners’ Association, Inc. based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes; in a form approved by Borough Engineer Wayne Zirolli and subject to Land Use approvals. 23. Attorney Fitzpatrick and Public Works Director James Stewart discussed the negative referral from the Planning Commission pursuant to Section 8-24 of the General Statutes; regarding the Temporary Access and Construction Easement for the purpose of repairing clogged catch basins and driveway to the property of Carol Doody. No action was taken by the board. 24. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses refer the proposed Connecticut Water Company Quit Claim Deed to the Planning Commission for a report pursuant to Section 8-24 of the General Statutes. 25. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses designate the Naugatuck Economic Development Corporation (NEDC) as the official representative of the Borough of Naugatuck in connection with the application for the Sustainable Communities Regional Planning Grant. 26. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to permit the participation of the Borough of Naugatuck as a collaborator with regard to the Sustainable Communities Regional Planning Grant. 27. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution regarding the Appropriation and Bond Authorization of $81,000,000 for the Reconstruction and Renovation of the Naugatuck High School. RESOLVED, the Board of Mayor and Burgesses hereby adopts and recommends to the Board of Finance and the Board of Mayor and Burgesses and Board of Finance sitting jointly and the electors of the Borough of Naugatuck (the “Borough”) that:  -9- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 (i) the sum of $81,000,000 be appropriated for the cost of the reconstruction and renovation of the Naugatuck High School including, but not limited to, construction and reconstruction to the Naugatuck High School, the replacement of windows with energy efficient windows, replacement of all ceiling and floor tiles, the removal of hazardous materials, the construction of new athletic fields, the repair of drainage systems, the purchase and installation of new furniture, equipment and computers and all alterations, repairs and improvements in connection therewith, as well as engineering, architectural and temporary and permanent financing costs (the “Project”), and to meet said appropriation and in lieu of a tax therefor, bonds of the Borough be issued pursuant to the Charter of the Borough and Chapter 109 of the Connecticut General Statutes, as amended, or any other provision of law thereto enabling, in the amount of $81,000,000 or so much thereof as may be necessary after deducting grants or other sources of funds available therefor; and (ii) the Mayor and the Treasurer of the Borough be authorized to issue and sell temporary notes of the Borough not to exceed $81,000,000 in anticipation of the receipt of the proceeds from the sale of such bonds and to determine the amount, date, date of maturity, interest rate, form and other details of such notes or bonds, pursuant to the Charter of the Borough and Chapter 109 of the Connecticut General Statutes, as amended, or any other provision of law thereto enabling, provided that the proceeds from the sale of such notes shall be used for said purpose; and (iii) the Mayor and the Treasurer of the Borough shall sign the bonds or notes by either manual or facsimile signatures and that the law firm of Pullman & Comley, LLC is designated as bond counsel to approve the legality of the bonds or notes; and (iv) the Mayor is authorized to designate a bank or trust company to be the certifying bank, registrar, transfer agent and paying agent of the bonds or notes; to sell the bonds or notes at public or private sale; to deliver the bonds or notes; and to perform all other acts which are necessary or appropriate to issue the bonds or notes including entering into a continuing disclosure agreement pursuant to the Securities and Exchange Commission Rule 15(c)(2)(12). The Mayor and the Treasurer of the Borough are further authorized to bind the Borough pursuant to such representations and covenants as they deem necessary or advisable in order to maintain the continued exemption from federal income taxation of interest on the bonds or notes, including covenants to pay rebates of investment earnings to the United States in future years.  -10- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 BE IT FURTHER RESOLVED, that should the Board of Finance and the Board of Mayor and Burgesses and Board of Finance sitting jointly approve the resolutions to appropriate $81,000,000 and authorize the issuance of bonds for the Project (the “Resolution”), the Mayor is hereby authorized to submit the Resolution to an election of the electors of the Borough and the Borough Clerk is hereby directed to provide notice of such election to be held on November 8, 2011, between the hours of 6:00 a.m. and 8:00 p.m. for a yes or no vote under the following heading: Shall the Borough of Naugatuck appropriate $81,000,000 for the cost of the Reconstruction and Renovation of the Naugatuck High School, including, but not limited to, construction and reconstruction to the Naugatuck High School, the replacement of windows with energy efficient windows, replacement of all ceiling and floor tiles, the removal of hazardous materials, the construction of new athletic fields, the repair of drainage systems, the purchase and installation of new furniture, equipment and computers and all related costs and authorize the issuance of bonds and notes in the amount of $81,000,000 or so much as may be necessary after receiving grants or other funds available therefor to finance such appropriation? BE IT FURTHER RESOLVED, that the Borough reasonably expects to incur expenditures (the “Expenditures”) in connection with the capital project for which a general functional description is provided above. The Borough reasonably expects to reimburse itself for the cost of the Expenditures with the proceeds of general obligation bonds and notes of the Borough described above. The maximum principal amount of such debt (both bonds and notes) is not expected to exceed $81,000,000. This declaration of official intent is a declaration of official intent made pursuant to Treasury Regulation Section 1.150-2. BE IT FURTHER RESOLVED, that should the electors of the Borough adopt the Resolution, the Mayor, Burgesses, and the Treasurer and other proper officers and employees of the Borough are authorized to take all other action which is necessary or desirable to contract and complete the Project and to issue bonds, notes or other obligations to defray the aforesaid appropriation.  -11- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 BE IT FURTHER RESOLVED, that should the Board of Finance and Board of Finance and Board of Mayor and Burgesses sitting jointly approve the Resolution, the preparation, printing and distribution of a concise explanatory text and/or the dissemination of other neutral printed material in accordance with Section 9-369b of the Connecticut General Statutes is hereby authorized. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to appoint a Naugatuck High School Building Committee to work in conjunction with the Board of Education on the reconstruction and renovation of Naugatuck High School. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize the Board of Education and the Naugatuck High School Building Committee to hire an architect or engineer to prepare schematic drawings and outline specifications for the reconstruction and renovation of Naugatuck High School. Motion withdrawn. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize the Board of Education and the Naugatuck High School Building Committee to hire an architect or engineer to prepare schematic drawings and outline specifications for the reconstruction and renovation of Naugatuck High School pending a favorable outcome of the referendum. 31. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize the Board of Education to file an application for the Naugatuck High School Project with the State of Connecticut pending a favorable outcome of the referendum. 32. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the preceding three motions relative to Naugatuck High School are contingent on the Joint Boards of Mayor and Burgesses and Board of Finance funding. 33. The Borough of Naugatuck’s existing contract for Municipal Solid Waste with CRRA expires on November 15, 2012. Steve Diaz, Vice President of Covanta Energy, gave the board an overview of the company, its facilities, its incinerators in Wallingford and Bristol and a proposal to accept MSW from the borough. 34. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid for “Motor Vehicle Parts & Repair” to Naugatuck Auto Parts 50 Aetna St. Naugatuck, CT 06770 in the amount as shown on the bid, as recommended by Public Works Director James Stewart. 35. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid for “Leaf Hauling & Brush Grinding” to Greencycle of Connecticut, Inc, 232 Colt Highway, Farmington, CT 06032 as per bid, as recommended by Public Works Director James Stewart.  13- Minutes – Board of Mayor and Burgesses – Regular Meeting – September 6, 2011 36. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid for “Brush Hauling (including rental of 30yd. container)” to The Stone Construction Company, 168 Main St. South, P.O. Box 428, Southbury, CT 06488 as per bid, as recommended by Public Works Director James Stewart. 37. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for a “2-3 Yard Dump Truck” to Inter-State Ford Truck Sales, Inc., 45 Brainard Road, Hartford, CT 06114 in the amount of $48,491.00 as recommended by Public Works Director James Stewart. 38. Public Comment Board of Education Chair Dave Heller thanked the board for the discussion this evening regarding their support for the educational system and the renovation project. Superintendent of Schools Dr. Tindall-Gibson said the school year began today with 4310 students and 706 staff members. He thanked the board for their support on the project. 45. Burgess Comments/Sub-Committee Reports Burgess Jackson said the field space issue was settled at the Park Commission meeting.  -17- Minutes – Board of Mayor and Burgesses Regular Meeting – September 6, 2011 Burgess Ciacciarella said the Charter Revision Commission will be holding a Public Hearing on September 8th at 7 p.m. Deputy Mayor Rossi said TRIAD is hosting a tour of the Fire Department tomorrow. The fire department can win a $10,000 grant if enough people take a fire quiz online through Liberty Mutual. The department responded to 155 incidents between Sunday and Thursday, the week following Hurricane Irene. Normally in a month they respond to 120 incidents. There will be an EMS Subcommittee Public Hearing on September 19th at 7 p.m. (Deputy Mayor Rossi’s comments are attached as submitted.) Burgess Neth thanked the Old Corner Café and all the volunteers for participating in the pasta dinner after the hurricane. He received negative phone calls regarding the free ten gallons of gas from the borough. He commended the Mayor and his entire team for the fantastic job during the crisis. Burgess San Angelo thanked the Mayor for allowing the Missing Persons Vigil to be held in town hall due to the inclement weather. He spoke to people who were ecstatic will the Code Red calls from the Mayor during and after the storm. 46.
