MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES APRIL 3, 2012 1. Mayor Robert A. Mezzo called the regular meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: PRESS: T. K. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of March 6, 2012 and the special meeting of March 19, 2012. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of March. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to recess to Executive Session at 6:01 p.m. for discussion on the following: Real Estate (Property Negotiations), Personnel (Human Resources Director) inviting in Attorney N. W. Hess, III and Human Resources Assistant C. Rinaldi. Mayor Mezzo reconvened the meeting at 7:06 p.m. 6. The following motion emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute subordination agreements allowing borough property owners to refinance their first mortgage by  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – April 3, 2012 allowing the new mortgage to have priority over borough redevelopment and second mortgages provided that borough counsel verifies that there is no negative impact to the equity position of the Borough of Naugatuck. 7. Public Comment – Open Topic Residents congratulated the borough board on their decision to purchase land off of Andrew Mountain Road and expressed the need to form a Conservation Commission. 8. Burgess Comments – Open Topic Deputy Mayor Rossi congratulated everyone involved with the Kick Ball Tournament. She said it was a great way to put Naugatuck on the map. She congratulated the Irish Mayors for the Day. The Deputy Mayor said the Juvenile Review Board is an excellent option for students. 9. Mayor Mezzo reappointed Debbie Manfredi, 39 Olivia Lane, Naugatuck, CT 06770 as a member of the Day Care Board of Directors, term to expire April 1, 2013. 10. Mayor Mezzo reappointed Lois Labriola, 88 Timothy Road, Naugatuck, CT 06770 as a member of the Day Care Board of Directors, term to expire April 1, 2013. 11. Mayor Mezzo reappointed Dawn Luna, 7 Arlene Drive, Ansonia, CT 06401 as a member of the Day Care Board of Directors, term to expire April 1, 2013. 12. Mayor Mezzo reappointed Deborah Sabia, 76 Pilgrim Avenue, Waterbury, CT 06704 as a member of the Day Care Board of Directors, term to expire April 1, 2014. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Jocelyn Miller, 385 Park Avenue, Naugatuck, CT 06770 as a member of the Visiting Nurses Association Advisory Committee, filling the unexpired term of J. Nagrabski, term to expire June 1, 2014. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Erik Czerwiowski, 200 Andrew Mountain Road, Naugatuck, CT 06770 as a regular member of the Golf Course Commission, filling the expired term of G. Myers, term to expire June 1, 2013. 19. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses refer the proposed purchase by the Borough of approximately 146 acres off of Andrew Mountain Road to the Planning Commission for a report pursuant to Section 8-24 of the General Statutes. 20. Tax Collector James Goggin gave the board an overview of abandoned mobile homes and how it affects the borough with regard to the taxes. Mr. Goggin looked into the relationship the Town of Southington has with the owners of mobile home parks. He would like to establish a similar relationship in Naugatuck to prevent the loss of taxes. 21. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo and/or the Controller in consultation with the agent of record to transfer the Health Insurance Provider Services as deemed necessary.  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – April 3, 2012 22. Mayor Mezzo said a meeting was held last evening to hear comments from the public regarding the proposed revision to Article III – Code of Ethics Ordinance. After additional revisions are made based on the input, a revised copy will be given to the board for their approval. 23. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Fair Housing Resolution, as if read: BOROUGH OF NAUGATUCK FAIR HOUSING RESOLUTION WHEREAS, all persons are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, federal fair housing laws require that all individuals, regardless of race, color, religion, sex, handicap, familial status or national origin, be given equal access to all housing-related opportunities, including rental and homeownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, Connecticut fair housing laws require that all individuals, regardless of race, creed, color, national origin, ancestry, sex, marital status, age, lawful source of income, familial status, learning disability, physical or mental disability, sexual orientation, be given equal access to all housing-related opportunities, including rental and home ownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, the Borough of Naugatuck is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice; and NOW THEREFORE, BE IT RESOLVED, that the Borough of Naugatuck hereby endorses a Fair Housing Policy to ensure equal opportunity for all persons to rent, purchase, obtain financing and enjoy all other housing-related services of their choice on a non-discriminatory basis as provided by state and federal law; and BE IT FURTHER RESOLVED, that the chief executive officer of the Borough of Naugatuck or his designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck and for advising such person of the right to file a complaint with the State of Connecticut Commission on Human Rights and Opportunities (CHRO) or the U.S. Department of Housing and Urban  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – April 3, 2012 Development (HUD) or to seek assistance from the CT Fair Housing Center, legal services, or other fair housing organizations to protect his or her right to equal housing opportunities. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Fair Housing Policy Statement, as if read: It is the policy of the Borough of Naugatuck to promote fair housing opportunities and to encourage racial and economic integration in all its programs and housing development activities. Programs funded and administered by the Borough of Naugatuck must comply with the provisions of Section 46a-64c of the C.G.S., and with related state and federal laws and regulations that prohibit discriminatory housing practices. The Borough of Naugatuck or any sub-recipient of the Borough of Naugatuck will carry out an affirmative marketing program to attract prospective buyers or tenants of all majority or minority groups, without consideration of race, color, religion, sex, national origin, ancestry, creed, sexual orientation, marital status, lawful source of income, disability, age or because the individual has children in all programs and housing development activities funded or administered by the Borough of Naugatuck. Complaints pertaining to discrimination in any program funded or administered by the Borough of Naugatuck may be filed with the mayor. The municipality’s Grievance Procedure will be utilized in these cases. Complaints may also be filed with the Commission on Human Rights and Opportunity, Special Enforcement Unit, 21 Grand Street, Hartford, CT 06106, Telephone (860) 541-3403.A copy of this policy statement will be given annually to all Borough of Naugatuck employees and they are expected to fully comply with it. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Title VI Equal Opportunity Statement, as if read: The Borough of Naugatuck does not discriminate in the provision of services, the administration of its programs, or contractual agreements. The Borough of Naugatuck seeks to fully carry out its responsibilities under the Title VI Regulations. Title VI of the Civil Rights Act of 1964 prohibits discrimination on the grounds of race, color or national origin in programs and activities receiving federal financial assistance. Title VI provides that no person shall on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any programs covered by the regulations. This policy is effectuated through the methods of administration outlined in the Borough of Naugatuck’s Fair Housing Plan and is fully implemented to ensure compliance by the Borough of Naugatuck, as the recipient, and by sub- recipients. Public Comment – None 28. Burgess Comments/Sub-Committee Reports Burgess Neth reported that the schematic drawings for the high school renovation project are approximately 95% complete. There may be an additional cost to the project because a fire pump may need to be installed to increase the water pressure. The current system does not provide adequate service to the high school. Deputy Mayor Rossi said the Fire Department responded to 93 incidents last month. The Strategic Planning Action for Naugatuck (SPAN) Committee will being going back out to bid. Burgess Scully thanked the Mayor, Deputy Mayor, Mike Massicotte, the Fire and Police Departments for their part in a successful St. Patrick’s Day celebration. The Ordinance 83 Subcommittee is waiting for some additional information and will be sending a revised copy to the board for review. Burgess Ciacciarella wished everyone a nice Easter holiday. Burgess Jackson said the Housing Authority is conducting interviews for a new director. Their hope is to have someone in place by May. The Police Department has five people in the academy. She thanked the Park Commission, especially Jay Kuczenski, for a successful Kick Ball Tournament. The event raised $50,000. Burgess Jackson congratulated Sue and Jim Goggin for being honored with the Raymond K. Foley Award. She wished everyone a Happy Easter. 29.
