MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES APRIL 5, 2016 1. Mayor N. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meetings of February 2, 2016 and March 1, 2016 and the special meetings of March 1, 2016 and March 16, 2016. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the monthly reports of March. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Burns to recess to Executive Session at 6:04 p.m. for discussion on the following: Real Estate Negotiations (Prospect Street School, property bordering Water Street and Cedar Street) and Pending Litigation inviting in Attorney E. Fitzpatrick, Attorney M. McVerry, Attorney K. McSherry, Property Owner R. Allen, Property Owner N. Abarzua and Naugatuck Economic Development Corporation CEO R. Pugliese. Mayor Hess reconvened the meeting at 7:03 p.m. 6. The following motion emanated from Executive Session. -2- Minutes – Board of Mayor and Burgesses Regular Meeting – April 5, 2016 VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses send to the Planning Commission for an 8-24 referral the sale of Prospect Street School as a mixed use/residential/commercial project. 7. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses recess to the Firemen’s Pension Plan “C” Board at 7:05 p.m. Mayor Hess reconvened the meeting at 7:07 p.m. 8. Public Comment  Upset the town is saying there is a deficit in the current budget, looking for accountability.  Congratulated Mayor Hess, the board and Alex Olbrys for securing grants to connect the trails.  Earth Day Mayor for the Day will be Saturday, April 23, 2016. 9. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a purchase and sale agreement for Prospect Street School, 100 Prospect Street, Naugatuck, CT 06770 with Format LLC, 1 Center Street, Suite 2A, Southington, CT 06489 in the amount of $300,000 as approved by borough counsel. Motion tabled. 10. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses refer the proposed sale of 41 Raytkwich Road to the Planning Commission for a report pursuant to Section 8-24 of the General Statutes subject to borough attorney approval. 11. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents for the sale of 41 Raytkwich Road and to effectuate the transfer from the Borough Development Corporation to the Borough of Naugatuck, subject to attorney review and approval. Motion tabled. 12. Mayor Hess appointed Lieutenant Ronald Hunt, 211 Spring Street, Naugatuck, CT 06770 as a member of the Northwest Regional Mental Health Board, filling the expired term of M. Price, term to expire May 1, 2017. 13. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the appointment of James L. Dunn, 174 Lincoln Street, Naugatuck, CT 06770 as a regular member of the Conservation Commission, filling the unexpired term of M. Mayor Hess reappointed Captain Steven Hunt, 211 Spring Street, Naugatuck, CT 06770 as a member of the Northwest Connecticut Public Safety Communication Center, Inc., term to expire April 1, 2018. 15. Mayor Hess reappointed the following alternate members to the Arts Commission, terms to expire April 1, 2018; as if read: Margie Paul-Gaston Ceasar J. Ruggeri 33 West Hill Terrace 70 Florence Street Naugatuck, CT 06770 Naugatuck, CT 06770 17. Mayor Hess was contacted by two residents regarding evening hours one night a week in the Tax Department. Tax Collector James Goggin said his department tried evening hours during the busy tax collection period but they didn’t get a good response. He thinks if hours are extended, other departments should be open as well because departments work in conjunction with each other. Mr. Goggin said different software is being implemented that will allow residents to access their tax information online. The board wants to see how well the new software is received before making a decision on extending hours. 18. Motion by Burgess that the Board of Mayor and Burgesses extend the due date for payment on Personal Property exemptions as recommended by Tax Collector James Goggin. Motion amended. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses extend the due date for payment on the Personal Property exemption for Parcel #008-0300, 322 Great Hill Road to a payment plan no greater than twelve months on past due as recommended by Tax Collector James Goggin. -4- Minutes – Board of Mayor and Burgesses Regular Meeting – April 5, 2016 19. Mayor Hess said he meets once a week with Tax Collector James Goggin and Assessor Carol Ann Tyler to discuss Remnant Parcels of Real Estate that are not generating tax revenue. The majority are small remnants of property that the borough is not and will not be getting any tax revenue. Some parcels may be given to the property owner of the adjacent property; some may be able to be sold. 20. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents for the Annual Site Host Agreement for Meals at the Senior Center through the Senior Nutrition Program administered by New Opportunities, Inc. 21. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses authorize Mayor Hess to sign the “CodeRed Next Services Agreement” with the Emergency Communications Network LLC, 780 Granada Boulevard, Suite 200, Ormond Beach, FL 32174 in the amount of $15,150 annually for the next three years, as recommended by NEMAC (Naugatuck Emergency Management Advisory Committee). 22. Motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents between the Borough of Naugatuck and Clough, Harbour and Associates for “Construction Engineering Services” for Maple Street Bridge over Naugatuck River, Bridge No. 04214 as recommended by Public Works Director James Stewart. Motion unanimously voted in favor. Burgess Jackson was not present for the vote. 23. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Hoff that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents between the Borough of Naugatuck and Siefert Associates for “Construction Inspection Services and Value Engineering” for Maple Street Bridge over Naugatuck River, Bridge No. 04214 as recommended by Public Works Director James Stewart. 24. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Burns that the Board of Mayor and Burgesses designate April 5, 2016 as National Service Recognition Day in the Borough of Naugatuck. 25. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Burns that the Board of Mayor and Burgesses designate April 2016 as Child Abuse Prevention Awareness Month in the Borough of Naugatuck. -5- Minutes – Board of Mayor and Burgesses Regular Meeting – April 5, 2016 26. Public Comment – None 30. Burgess Comments/Sub-Committee Reports Burgess Vitale reported the Park Department is getting fields ready for the upcoming season. The Inland Wetlands Commission approved Parcel C and the Dog Park/Community Garden on Andrew Mountain Road. He congratulated Anthony Salcito and Greg McKirryher for participating in the Naugatuck Education Foundation’s 5K Road Race in full firefighter gear. Burgess Jackson said tickets will not be sold at the door for the Borough Music Festival this year due to limited space in the high school auditorium. She thanked Mayor Hess for attending the invention convention at Cross Street Intermediate School. Burgess Hoff reported the Arts Commission scheduled the summer concerts on the green. She was happy to hear the Comedy Club on New Haven Road donated one hundred percent of the profits, $5,000, to the Habitat for Humanity fundraiser held there. Burgess Donovan reported the Zoning Commission approved the proposed train station restaurant. Burgess Herb said the Planning Commission was very picky when reviewing Parcel C. 31.
