MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES MAY 3, 2016 1. Mayor N. Warren “Pete” Hess called the regular meeting to order at 6:01 p.m. with the following in attendance: BURGESSES: PRESS: R. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of April. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully to recess to Executive Session at 6:02 p.m. for discussion on the following: Real Estate Negotiations (Prospect Street School, property bordering Water Street and Cedar Street) Collective Bargaining (UPSEU Dispatchers) Personnel (Fire Chief) and Pending Litigation inviting in Attorney E. Fitzpatrick, Attorney K. McSherry, Human Resources Director J. Lawlor and Naugatuck Economic Development Corporation CEO R. Pugliese. Mayor Hess reconvened the meeting at 7:24 p.m. 6. Public Comment  Inappropriate events proposed for Gunntown Passive Park because there is no public water and bathrooms.  Questioned why the seating was reduced in the high school auditorium.  Earth Day Celebration on the green sponsored by Grace Lutheran Church to be held Sunday, June 5, 2016.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2016 7. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve an extension for one year for The Revaluation and Reappraisal of all Real Property within the Borough of Naugatuck from October 1, 2017 to October 1, 2018. 8. VOTED: Unanimously on a motion by Burgess Hoff and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Caroline J. Hennessey (R), 46 Sande Avenue, Naugatuck, CT 06770 as an alternate member of the Zoning Commission, filling the expired term of W. Fowler, term to expire February 1, 2020. 9. VOTED: Unanimously on a motion by Burgess Hoff and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of George Amanze Williams (D), 816 Maple Hill Road, Naugatuck, CT 06770 as an alternate member of the Zoning Commission, filling the unexpired term of N. Mascola, term to expire May 1, 2017. George Amanze Williams was sworn in as an alternate member on the Zoning Commission by Mayor Hess. 10. VOTED: Unanimously on a motion by Burgess Hoff and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Sally Brouillet (R), 205 Osborn Road, Naugatuck, CT 06770 as an alternate member of the Planning Commission, filling the unexpired term of R. Clark, term to expire November 1, 2017. 11. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents for the Naugatuck Trail Grant as recommended by Public Works Director James Stewart. 12. Mayor Hess appointed the following members to a PSAP Regionalization Subcommittee (Public Safety Answering Points): Burgess Patrick J. Scully, Sr., Chairman Burgess Rocky Vitale Burgess Robert Burns Burgess Donald Wisniewski 13. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses refer the proposed sale of 6.92 acres at 0 William C. Rado, Sr. Drive, AKA Lot 13 Industrial Park II, to the Planning Commission for a report pursuant to Section 8-24 of the General Statutes subject to borough attorney approval.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2016 14. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents for the proposed sale of Prospect Street School as a mixed use/residential/commercial project, 100 Prospect Street, Naugatuck, CT 06770 to Format LLC, 1 Center Street, Suite 2A, Southington, CT 06489 in the amount of $300,000 based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes in a form approved by borough counsel. 15. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses refer to the Joint Boards of Mayor and Burgesses and Board of Finance a transfer request of $35,672.01 from Contingency to the Northwest CT Public Safety Communication Center Account as recommended by Controller Robert W. Butler, Jr. 16. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses authorize the mayor to execute an employment agreement for Ellen Murray, Fire Chief from March 27, 2016 through June 30, 2020. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Jackson that the Board of Mayor and Burgesses approve a settlement of the Naugatuck Ambulance Corporation litigation in accordance with the following terms and conditions, as if read: 1. Naugatuck Ambulance Corporation (NA) shall convey the property located at 246 Rubber Avenue, Naugatuck, CT to Borough of Naugatuck (BON) by way of warranty deed. 2. NA and BON shall enter into a lease agreement for the term of three (3) years, One Dollar per year, for the lease of the building at 246 Rubber Avenue. Terms of lease are as follows: a. NA shall pay for all utilities associated with the property: b. NA shall be responsible for all maintenance to the building, including the electrical, plumbing, heating and cooling systems, as well as maintenance of structure; c. NA shall maintain fire and liability insurance on the property and provide BON with a copy of the insurance certificate, naming BON as additional insured; 3. As a full and final settlement of all legal claims, the BON shall tender a check in the amount of $200,000 to NA on or before July 1, 2016. NA shall withdraw the case  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – May 3, 2016 against BON pending in Waterbury Superior Court. BON shall simultaneously withdraw its counterclaims. NA and BON shall execute mutual general releases. 4. BON shall be responsible to pay the E911 dispatch fee to Northwest CT Public Safety Communication Center, Inc. (Northwest) for April, May and June 2016. Payments shall be made directly to Northwest. Going forward, BON shall be responsible to pay the CMED, EMD and E911 dispatch fees to Northwest through the end of the contract period (June 30, 2017). BON will have no obligation to pay any stipend to NA, as NA will no longer be providing payment to Northwest for these services. 5. NA and BON will enter into a new agreement for the provision of emergency medical services, which will provide that BON will be responsible for all CMED, EMD and E911 fees. The agreement will also detail the level of service to be provided by NA and will include response time requirements and staffing requirements. 17. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses accept the applications submitted at the Public Hearing on April 27, 2016 for the Naugatuck YMCA, 284 Church Street, Naugatuck, CT 06770 and the United Way of Naugatuck and Beacon Falls, 270 Church Street, Naugatuck, CT 06770 to be incorporated in the Borough of Naugatuck’s 2016 Connecticut Neighborhood Assistance Act Program Application. 18. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign an agreement and any related documents with Milone & MacBroom, Inc. for the design of the DOT LOTCIP (Local Transportation Capital Improvement Program) Spring Street Project as recommended by Public Works Director James Stewart. 19. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses accept the Clean Energy Communities Municipal Pledge and authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents. 20. Discussion regarding the Borough of Naugatuck’s policy on hiring borough retirees. Discussion deferred. 21. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to request purchase and transaction documents from Eversource for town street lights. 22. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign an authorization letter for the Naugatuck Park and Recreation Department to apply for a Walmart Community Grant as recommended by Recreation Director Kim Eyre.  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2016 23. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a state/municipal grant agreement and any related documents with the CT Department of Transportation for the Local Bridge Program, Maple Street over Naugatuck River, Bridge #04214, State Project #9087-4000 as recommended by Public Works Director James Stewart. 24. Motion by Deputy Mayor Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses adopt the following resolution: RESOLVED, that the Board of Mayor and Burgesses authorizes the Naugatuck Board of Education to apply to the Commissioner of Administrative Services and to accept or reject a grant for the Roof Replacement Project for the Hillside Intermediate School. RESOLVED, that the proper Officers of the Employer shall act as soon as possible to notify employees of the Employer of the restatement of the Plan and Trust. RESOLVED, that the form of Plan presented to the Board of Directors is a restatement intended to meet the requirements of the Pension Protection Act of 2006 ("PPA '06"), the Heroes Earnings Assistance and Relief Tax Act of 2008 ("HEART"), the Emergency Economic Stabilization Act of 2008 ("EESA"), the Workers, Retiree, and Employer Recovery Act of 2008 ("WRERA") , as well as the required changes from the 2010 Cumulative List of Changes in Plan Qualification Requirements described in section 4 of Revenue Procedure 2005-66 as modified by Revenue Procedure 2007-44. Public Comment – None 37. Burgess Comments/Sub-Committee Reports Burgess Vitale reported the Easter Village had 1,700 visitors. There were discussions at the Park Commission meeting to establish a fee to use the fields, what type of fee and who will be charged. The Zoning Commission is stalling the process of Parcel C by going over the windows, the color of the building exterior and the overall design. Burgess Jackson complimented the students for doing a great job at the Borough Music Festival. Burgess Scully asked everyone to observe a moment of silence for past burgess, past police officer and past fire marshal Henry Kuczenski, Sr. Burgess Burns has received numerous complaints about the brick roadway around Hillside Intermediate School. Mayor Hess said he is spending most of his time preparing for meetings on Veolia and resolving those issues. Deputy Mayor Neth agrees with the public on the reduction of the auditorium seats but said the state determined it was necessary to obtain the grant funding. Burgess Hoff said the slope in the auditorium is not as steep as it was and is now ADA accessible. John Minicucci will be honored with the Raymond K. Foley award on May 11th. Burgess Donovan reported the Zoning Commission is concerned with the look of the building proposed for Parcel C. The developer said the cost of adding brick could put them out of business. She does not want to see the developers walk away from the project. A revised plan is being developed for the Prospect Street Design District. Burgess Herb discussed the specialized process of handling the treatment plant. 38.
