MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES AUGUST 2, 2016 1. Mayor “Pete” Hess called the regular meeting to order at 6:08 p.m. with the following in attendance: BURGESSES: PRESS: R. Burgess Herb led in the Pledge of Allegiance to the flag. 3. Motion by Burgess Herb and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the minutes of the special meetings of July 18, 2016 and July 21, 2016. Each member received copies for review. L. Jackson abstained. 4. VOTED: Unanimously on a motion by Burgess Herb and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of July. Each member received copies for review. 5. VOTED: Unanimously on a motion by Burgess Herb and seconded by Burgess Scully to recess to Executive Session at 6:10 p.m. for discussion on the following: Real Estate Negotiations (Industrial Park/Land Acquisition, Rubber Avenue Property, Property bordering Water Street and Cedar Street), Personnel (Deputy Fire Chief, Fire Marshal) and Pending Litigation inviting in Fire Chief E. Murray, Attorney A. Perillo and Naugatuck Economic Development Corporation CEO R. Pugliese. Mayor Hess reconvened the meeting at 7:20 p.m. 6. There were no motions emanating from Executive Session. 7. Public Comment Conservation Commission Chairwoman Melissa Leonard gave the board an update on the commission. Since holding their first meeting last December, they visited four open spaces on the Borough of Naugatuck’s Plan of Conservation and Development. VOTED: Unanimously on a motion by Burgess Herb and seconded by Burgess Scully that the Board of Mayor and Burgesses recess to the Retirement Board at 7:24 p.m. Mayor Hess reconvened the meeting at 7:25 p.m. 9. Mayor Hess appointed the following members to a Noise Ordinance Subcommittee to modify the existing Noise Ordinance: Burgess Rocky Vitale, Chairman Burgess Donald Wisniewski 180 East Waterbury Road 1100 Andrew Mountain Road ZEO/Town Planner Susan Goggin Attorney Tim Fitzpatrick Ex officio Ex officio Naugatuck Police Department Personnel, TBD 10. Mayor Hess appointed Pedro Pires (D), 153 Forest Street, Naugatuck, CT 06770 as a regular member of the Police Commission, filling the expired term of J. San Angelo, term to expire June 1, 2021. 11. Mayor Hess reappointed Peter Meleschnig, 76 East Waterbury Road, Naugatuck, CT 06770 as a member of the Building Code Board of Appeals, term to expire August 1, 2021. 12. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Daniel Simoes (U), 102 King Street, Naugatuck, CT 06770 as an alternate member of the Inland Wetlands Commission, filling the expired term of L. Johnson, term to expire January 1, 2019. 13. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of David Pires (R), 153 Forest Street, Naugatuck, CT 06770 as a regular member of the Golf Course Commission, filling the expired term of R. Savoy, term to expire June 1, 2019. 14. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Kelli Sargeant, 125 Ward Street, Naugatuck, CT 06770 as an elector of the Board of Education and AFSCME Pension Board, filling the vacancy of J. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to execute a service agreement between the Borough of Naugatuck and Naugatuck Ambulance, Inc. for the provision of emergency medical services, the form and content of which shall be subject to approval by borough counsel. 16. Motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to execute an insurance settlement agreement for the repair of the Naugatuck High School Track in the amount of $16,238 as negotiated by borough counsel and recommended by Controller Robert W. Butler, Jr. Motion withdrawn and deferred. 17. Mayor Hess appointed the Law Firm of Pullman & Comley LLC, 90 State House Square, Hartford, CT 06103 as Borough Bond Attorneys effective July 1, 2016 as recommended by Controller Robert W. Butler, Jr. 18. Motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the following resolution: WHEREAS, on June 14, 2004 the Borough of Naugatuck (the “Borough”) issued its General Obligation Bonds to finance a judgment to pay the costs of environmental site assessment testing, compliance design and remediation of certain Borough properties (the “Project”); and WHEREAS, the Project is complete and the Bonds have been paid by the Borough and are no longer outstanding; and WHEREAS, the proceeds of the Bonds were put in a separate account (the “Account”) to finance the Project; and WHEREAS, $782,601.06 remains in the Account; NOW THEREFORE, be it resolved that the amount of $782,601.06 be transferred from the Account to the General Fund to reimburse the General Fund for payment of a portion of the debt service on the Bonds and that the Account be closed. Motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the following resolution: RESOLVED, that the Board of Mayor and Burgesses hereby recommends to the Board of Mayor and Burgesses and the Board of Finance sitting jointly that the sum of $782,601.06 be appropriated for environmental remediation and redevelopment purposes including but not limited to the acquisition of land, environmental remediation, site assessment, site improvement, infrastructure improvement, demolition, alteration, remodeling, repair or reconstruction of existing building structures and all fees and costs related thereto including but not limited to planning, engineering, architectural, legal, financing and accounting expenses. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Hess to hire Appraisers or Environmental Consultants to analyze potential sites for acquisition by the Borough of Naugatuck for an Industrial/Commerce Park, a Microgrid Energy Park or other similar revenue generating projects. 21. VOTED: Unanimously on a motion by Burgess Donovan and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess, Treasurer Judith E. Public Comment Thanked the board for accepting the land on Rubber Avenue Extension and adding it to Gunntown Passive Park and Nature Preserve. 24. Burgess Comments/Sub-Committee Reports Burgess Hoff reported the Arts Commission works very hard hosting the summer concert series. She thanked them for their hard work and stated they need more help. She attended the Greater Waterbury Transit District meeting and the Elderly Commission meeting. Mayor Hess attended concerts in other towns and was very impressed. He is working with the Arts Commission to expand our concerts and the quality of performers. Burgess Donovan reported the Planning Commission approved the Tractor Supply Store. It will now go before the Zoning Commission. Burgess Herb said the proposed Tractor Supply Store will be at a high elevation similar to Walmart. It will be located in the New Haven Road Design District North and South. Burgess Vitale reported the Fire Department is sending three people to the academy. The Fire Marshal position has been posted. The Parks Commission will be showing Star Wars this Friday on Breen Field. The Dog Park Fundraiser will be August 26th at the Comedy Club on New Haven Road. The Arts Commission’s Annual Naugatuck Arts Festival will be held August 28th. Burgess Jackson welcomes everyone back to school on August 29th. Burgess Scully said the town did an excellent job on the Kosko Lane sewer project. The PSAP Subcommittee is waiting for information from contractors. They are meeting again on Thursday at the Fire Department. Burgess Burns asked if something is going to be done with the fountain on the green that was vandalized. Mayor Hess said he will be hosting Mayor Pete’s Downtown Festival on September 24th in lieu of a mayor’s ball. He wants to help Mission 22 which is an organization raising awareness to end veteran suicide in the United States. The mayor will lead a team of hikers on a 22 kilometer hike earlier in the day through the state forest ending at the Tuttle Building. After the hike, they will march downtown with a bagpipe band. There will be food downtown from various establishments in Naugatuck and music starting at 4 p.m. There will also be a car show and a YMCA cancer awareness spinning event. Mayor Hess stated Waterbury has six officers solely dedicated to blight. They spend hundreds of thousands of dollars enforcing blight. He is grateful to Mayor O’Leary for allowing his staff to attend the Naugatuck Blight Task Force Meeting to share their knowledge and experience. 25.
