VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth to recess to Executive Session at 6:03 p.m. for discussion on the following: Personnel (Golf Course/Pro Shop Manager), Real Estate (Naugatuck Event Center, 176 North Main Street) and Pending Litigation inviting in Finance Board Chairman D. Sheridan and Human Resources Director J. Lawlor. Mayor Hess reconvened the meeting at 7:21 p.m. 6. The following motions emanated from Executive Session.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – January 2, 2018 VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to enter into an employment agreement for a three year term with the Golf Course/Pro Shop Manager. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses sell the borough property at 176 North Main Street, Naugatuck to the Nasufis for $10,000 as is. 7. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses recess to the Retirement Board at 7:22 p.m. Mayor Hess reconvened the meeting at 7:24 p.m. 8. Public Comment Residents spoke on the following:  Read out loud the usage rules for Gunntown Passive Park  Naugatuck River testing found cancer causing compounds, waiting for full results  Conservation Commission needs full authority over passive land  Conservation Commission wants a walking tour of the land off of Nichols Avenue 9. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Seth Bronko (R), 73 Lewis Street, Naugatuck, CT 06770 as a regular member of the Board of Finance, filling the expired term of E. Fennell, term to expire July 1, 2020. Burgess M. Bronko abstained. 10. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Alexander Olbrys (R), 40 Nicole Drive, Naugatuck, CT 06770 as a regular member of the Board of Finance, filling the unexpired term of S. Stirk, term to expire June 1, 2018. 11. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Visar Tasimi (D), 23 High Ridge Road, Naugatuck, CT 06770 as an alternate member of the Board of Finance, filling the unexpired term of A. Campbell, term to expire June 1, 2018. Mayor Hess swore in Seth Bronko, Alexander Olbrys and Visar Tasimi to the Board of Finance.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – January 2, 2018 12. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Joseph Savarese (D), 145 Union City Road, Naugatuck, CT 06770 as a regular member of the Board of Finance, term to expire July 1, 2020. 13. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Christine Kuczenski (D), 310 North Hoadley Street, Naugatuck, CT 06770 as a member of the Board of Assessment Appeals, term to expire January 1, 2021. 14. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses award the bid for the “On Site Respiratory Clearance Examinations – Fire Department” to Trinity Health of New England, St. Mary’s Hospital D/B/A Occupational Health Center, 1312 West Main Street, Waterbury, CT 06708 in the amount of $26,000, locking in the price for three (3) years, and authorize Mayor Hess to execute all contracts and related documents as recommended by Fire Chief Ellen Murray. 15. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses waive the bid and award the “Annual Glycol System Testing & Maintenance – Police Department” to Cascade Water Services, Inc., 113 Bloomingdale Road, Hicksville, NY 11801 in the amount of $2,100 as recommended by Chief of Police Christopher Edson and to accept Cascade Water Services as an approved vendor for the coming calendar year. 16. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses waive the bid and award the “Plumbing Repair to Cell #2 – Police Department” to Cyrious Plumbing, 24 James Place, Wolcott, CT 06716 in the amount of $1,612.25 as recommended by Chief of Police Christopher Edson and to accept Cyrious Plumbing as an approved vendor for the coming calendar year. 17. Deputy Police Chief Joshua Bernegger gave an update on the Traffic Study Report, NVCIT Case Number 2017-15, Field Street/Jones Road, Naugatuck. He said a stop sign can’t be put in the middle of the intersection without putting delineators around it. It will cost $925 to purchase twenty-five delineators. They will be spaced five feet apart. Atlantic Pavement Marking quoted $1,500 to do the line striping work. Mayor Hess asked why the line painting is not being done by town employees. The deputy chief said we do not have the equipment to paint the proper lines. Deputy Chief Bernegger will get an additional quote from Safety Marking for the line striping work.  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – January 2, 2018 18. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses authorize Mayor N. Warren "Pete" Hess to apply for a State of Connecticut Department of Energy & Environmental Protection (DEEP) Microgrid for the Borough of Naugatuck and further authorizes the mayor to submit the necessary responses to the DEEP Microgrid application as required by the State of Connecticut. 19. Motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses adopt Ordinance #130 – Child Safety Zone, Section 13-13 in Article I, In General, Chapter 13, Offenses and Miscellaneous Provisions hereby creating new Sections 13-14 – 13-25 Reserved of the Code of Ordinances of the Borough of Naugatuck, Connecticut, which reads as follows, as if read: ORDINANCE # 130 Chapter 13, Offenses and Miscellaneous Provisions, Article I, In General, Section 13-13 Child Safety Zone of the Code of Ordinances of the Borough of Naugatuck, Connecticut is hereby to read as follows: Sec. 13-13. Child Safety Zone (a) Purpose. Since the Borough of Naugatuck has a compelling interest in protecting children from the threat of sexual abuse from sex offenders, it is hereby resolved that, to preserve and promote the health, safety and general welfare of the children of the Borough of Naugatuck, it is in the common interest to enact reasonable regulations restricting sex offenders from entering Child Safety Zones. (b) Definitions. As used in this section, the following terms shall have the meanings indicated: Child Safety Zone (1) Any park, school, playground, recreation center, event center, swimming pool or wading pool, gymnasium, sports field, trail, passive recreation area, open space parcel, or sports facility, which: a. Is under the jurisdiction of any department, agency or authority of the Borough of Naugatuck, including, but not limited to, the Board of Education of the Borough of Naugatuck, the Park and Recreation Commission or the Conservation Commission. b. Is leased by the Borough of Naugatuck to another person for the purpose of operating a park, school, playground, recreation center, event center, bathing beach, swimming pool or wading pool, gymnasium, sports field, trail, passive recreation area, open space parcel, or sports facility; (2) “Child Safety Zone” includes any and all buildings, land, parking area or other improvements located on the same parcel on which each of the aforementioned facilities is located, but does not include any public street or public sidewalk located on the outside boundary of Child Safety Zones.  -5- Minutes – Board of Mayor and Burgesses – Regular Meeting – January 2, 2018 Sex Offender (1) A person who has been convicted or found not guilty by reason of mental disease or defect of 1) a criminal offense against a victim who is a minor, 2) a nonviolent sexual offense, 3) a sexually violent offense, or 4) any felony that the court finds was committed for a “sexual purpose,” as those terms are defined in Subdivisions (2), (5), (11) and (12) of Section 54-250 of the Connecticut General Statutes, as amended, and who is required to register with the Commissioner of Public Safety pursuant to Section 54-251, 54-252, 54-253 or 54-254 of the Connecticut General Statues, as amended; or (2) A person who has been convicted or found not guilty by reason of mental disease or defect in any other state, in a federal or military court or in any foreign jurisdiction of any crime the essential elements of which are substantially the same as any of the crimes specified in Subdivision (2), (5), and (11) of Section 54-251 of the Connecticut Statutes, as amended, and which requires registration as a sexual offender in such other state or in the federal or military system, and who resides in this state on and after October 1, 1998. (c) Prohibited acts; exceptions. (1) It shall be unlawful for a sex offender to be present in a Child Safety Zone. (2) Exclusions. This prohibition shall not apply to the following: a. To any person whose name has been removed from the Connecticut Department of Public Safety’s Sex Offender Registry or from the registry of any other state or in the federal or military system by act of a court or by expiration of the term. b. To any person entering into a facility in a child safety zone for the sole purpose of voting in any municipal, state or federal election or referendum, provided that the person leaves the facility immediately after voting. c. To the extent that the conduct prohibited by this section is in conflict with any sentence or order of probation or parole imposed upon a sex offender. d. To any person who enters a child safety zone for the purposes of dropping off or picking up his or her own child, provided that the person leaves the child safety zone immediately after dropping off or picking up his or her child. e. To any person who enters a child safety zone for the purpose of meeting with an adult, such as a teacher, administrator or nurse, to discuss his or her own child’s medical, educational or general welfare, provided that the person leaves the child safety zone immediately after completing the meeting or discussion. f. To any person who is lawfully employed in a position that might require providing services within such child safety zone, as defined herein, for the purpose of providing such employment services. Said person may provide services in the scope of employment only at the discretion of such person’s probation or parole officer or, if such person is not on probation or parole, at  -6- Minutes – Board of Mayor and Burgesses – Regular Meeting – January 2, 2018 the discretion of the Chief of Police of the Borough of Naugatuck. (d) Notice. The Chief of Police or his/her designee shall make reasonable efforts to provide prompt, actual written notice of the enactment of this section (which notice shall contain a copy of the section) to all persons who are listed on the Sex Offender Registry as of the effective date of this section as well as those persons who are added to the Sex Offender Registry thereafter, which persons’ addresses (as shown on the Sex Offender Registry) are within the Borough of Naugatuck. Such notice requirement may be satisfied by the mailing of such notice by registered or certified mail, return receipt requested, to the last known address of such person as listed on the Sex Offender Registry or as otherwise known to the Chief of Police or his/her designee. The failure of any person to receive such actual written notice shall not be a defense to a violation of this section. (e) Enforcement; penalties for offenses. (1) If a police officer reasonably believes that a sex offender is in a Child Safety Zone in violation of this section, the officer shall require that the suspected sex offender to provide his/her name, address and telephone number. If it is established that the individual is a sex offender, then the officer may issue an infraction ticket to the offender and require the offender to leave the Child Safety Zone. (2) Any person in violation of this section shall be fined in the amount of $250 for each violation or the maximum imposed by state statute. (f) Child Safety Zones. Each Child Safety Zone may be identified by a sign conspicuously posted at the primary entrance to the Child Safety Zone and any building within the Child Safety Zone. In addition, the Borough of Naugatuck will make available a map outlining each Child Safety Zone in the Borough of Naugatuck and a document listing each Child Safety Zone at the Mayor’s Office and the Borough of Naugatuck Police Department. All Child Safety Zones similar to the map mentioned above and the document listing each Child Safety Zone in Naugatuck will be placed on the Borough of Naugatuck web site for viewing. (g) Registry. (1) The Borough of Naugatuck Police Department will maintain a sexual offender registration book of Borough of Naugatuck sexual offender registrants. It should be known as the “Borough of Naugatuck Sexual Offender Registry” (Registry). (2) The Borough of Naugatuck Sexual Offender Registry will be available for public view and shall be kept in the records area. Upon request by an individual present at the Borough of Naugatuck Police Department, the Registry shall be made available for viewing. The Borough of Naugatuck will not make copies of any part of the Registry; specific Registry information shall not be given out over the phone.  -7- Minutes – Board of Mayor and Burgesses Regular Meeting – January 2, 2018 (3) Although the Connecticut Department of Public Safety by Connecticut General Statute is responsible for maintaining the Sex Offender Registry, the Borough of Naugatuck Police Department will still be required to maintain a copy of the registration information for all registrants residing within its jurisdiction in the Borough of Naugatuck Sexual Offender Registry. (4) When a local registrant is released from the obligation to register, the Connecticut Department of Public Safety shall notify the Borough of Naugatuck Police Department that the person is no longer a registrant. The Borough of Naugatuck Police Department shall then remove and destroy all Registry information pertaining to the person and shall make no further disclosure of such information. (h) Severability; effect on other provisions. Any provision of this section held to be unconstitutional or superseded by state law or regulation shall not serve to invalidate the remaining unaffected provisions hereof. No provision of this section shall serve to validate any activity otherwise prohibited by state or local law or lawfully enacted zoning regulations. ROLL CALL VOTE: FOR OPPOSE ABSTAIN Mayor N.W. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses designate the week of January 22nd through January 26th as “Great Kindness Week” in the Borough of Naugatuck. 21. Motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses adopt the following DEMHS Blanket Resolution as recommended by W. Francis Dambowsky, Director of Emergency Management and Homeland Security; as if read: RESOLVED, that the Board of Mayor and Burgesses may enter into with and deliver to the State of Connecticut Department of Emergency Services and Public Protection, Division of Emergency Management and Homeland Security any and all documents which it deems to be necessary or appropriate; and FURTHER RESOLVED, that N. Warren “Pete” Hess, as Mayor of the Borough of Naugatuck, is authorized and directed to execute and deliver any and all documents on  -8- Minutes – Board of Mayor and Burgesses Regular Meeting – January 2, 2018 behalf of the Naugatuck Board of Mayor and Burgesses and to do and perform all acts and things which he deems to be necessary or appropriate to carry out the terms of such documents, including, but not limited to, executing and delivering all agreements and documents contemplated by such documents. Public Comment Board of Finance Chairman Dan Sheridan invited the burgesses and anyone from the public to attend the Board of Finance budget workshops every Monday evening starting January 22nd. 26. Burgess Comments/Sub-Committee Reports Burgess Herb reported the Conservation Commission is very excited about the Nichols Avenue property. He attended the winter concert at the high school and said the high school band is phenomenal. The high school basketball team is doing a spectacular job. Burgess Wisniewski thanked the three newly appointed regular members of the Board of Finance for volunteering their time. Burgess Hoff asked the mayor for an update on the Maple Street Bridge, the Salem Bridge, the arrival of the Goodwill Truck and the IT Committee report. Mayor Hess said they have the report from the consultant and are implementing the IT project in phases. There is a meeting tomorrow to discuss the Maple Street Bridge. The Goodwill truck will be on the Elm Street side of the Naugatuck Event Center but will not be there until March or April. Burgess Neth said he is skeptical of bricks on the roadway over the Maple Street Bridge. Deputy Mayor Taf Jackson asked the mayor for an update on Parcel C. She asked if signs will go up for the new ordinance. The high school girls’ basketball team is doing well. She congratulated the mayor on receiving the Lewis Dibble Award. Burgess Vitale said the Park Department held the first ever Santa and Animals Event. He said there will be a discussion next month regarding the taping of meetings. Lieutenant Ronald Hunt retired and Detective Jay Pugliese was promoted to sergeant. The Litter Committee will be meeting again on January 16th. Burgess Bronko wished everyone a Happy New Year. Burgess DeOliveira wished everyone a Happy New Year. Burgess Burns congratulated the mayor on receiving the Lewis Dibble Award. 27.
