MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES OCTOBER 2, 2018 1. Mayor “Pete” Hess called the regular meeting to order at 6:05 p.m. with the following in attendance: BURGESSES: PRESS: L. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the minutes of the regular meeting of September 4, 2018. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the monthly reports of September. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth to recess to Executive Session at 6:06 p.m. for discussion on the following: Personnel (Borough Engineer), Collective Bargaining (AFSCME Police Union, IAFF Firefighters Union, AFSCME Street Department Union, UPSEU White Collar Union), Real Estate (Port of Naugatuck) and Pending Litigation inviting in Human Resources Director John Lawlor. Mayor Hess reconvened the meeting at 7:14 p.m. 6. The following motion emanated from Executive Session.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 2, 2018 VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor “Pete” Hess to enter into an employment agreement for the position of borough engineer as discussed in executive session. 7. Public Comment – None 8. Mayor Hess said there are immediate needs, short term needs and long term needs for additional space in the town hall. Building Inspector Bill Herzman approached the mayor regarding the need for more space in his department. Mr. Herzman said his office cannot accommodate storing more building documents. They purged all the documents they could and have begun storing documents in the hallway outside of his office. He said there is no place to review construction plans with an applicant in his office. He would like the board to consider options to relieve their immediate need for space. Wendy Murphy from the Naugatuck Probate Court said they are willing to move their office should an appropriate location or space be offered. The building department could expand into the probate court office which would solve their needs. It was also mentioned additional storage space is needed for the Assessor’s Office, the Finance Department and the Borough Clerk’s Department. 9. Mayor Hess reappointed Robert E. Lauer (D), 51 Tanglewood Lane, Naugatuck, CT 06770 as a regular member of the Code of Ethics Commission, term to expire October 1, 2020. 10. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the reappointment of Elizabeth Forlenzo (U), 365 Spring Street, Naugatuck, CT 06770 as a regular member of the Park Commission, term to expire October 1, 2023. 11. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the reappointment of Mary Connolly, 27 Carolyn Circle, Naugatuck, CT 06770 as a member of the Naugatuck Valley Health District, term to expire October 1, 2021. 12. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the reappointment of Adam Bronko, 34 Fairfield Court, Naugatuck, CT 06770 as a member of the Naugatuck Valley Health District, term to expire October 1, 2021. 13. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses approve the reappointment of Robert Genovese, 157 Birch Lane, Naugatuck, CT 06770 as a member of the Human Resource Development Board, term to expire October 1, 2021. 16. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses accept AT&T Corporate Headquarters, 208 S Akard Street, Dallas, TX 75202 as an approved vendor for “Cellular & Data Services” to the Police Department/Animal Control for fiscal year 2018-2019 and to authorize Mayor Hess to execute all contracts and related documents as recommended by Police Chief Christopher Edson. 20. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses rescind the action of the board made on June 5, 2018, item #39 in the meeting minutes, regarding the suspension of the principle on certain motor vehicles as recommended by Tax Collector James Goggin. 23. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses adopt the following resolution regarding an Inter-Municipal Agreement between the Borough of Naugatuck and the City of Waterbury, as if read: Motion amended. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses adopt the following resolution regarding an Inter-Municipal Agreement between the Borough of Naugatuck and the City of Waterbury with modifications as noted below, as if read: WHEREAS, the Board of Mayor and Burgesses has reviewed a proposed Inter-Municipal Agreement between the Borough of Naugatuck and the City of Waterbury for the sharing of taxes and the development of properties in the Borough of Naugatuck and the City of Waterbury; WHEREAS, the Inter-Municipal Agreement contains provisions for the development, extension of public utilities and eventual disposition of an interest in real property owned by the Borough of Naugatuck as described in the Inter-Municipality (the “Property”); WHEREAS, the Borough of Naugatuck Planning Commission passed a resolution on September 10, 2018 approving the proposed development, extension of public utilities and eventual disposition of the Property pursuant to CGS 8-24;  -6- Minutes – Board of Mayor and Burgesses – Regular Meeting – October 2, 2018 WHEREAS, the Board of Mayor and Burgesses received written correspondence from the Planning Commission containing a report regarding a resolution made by the Planning Commission pursuant to CGS 8-24; and WHEREAS, the Board of Mayor and Burgesses held a duly noticed public hearing on October 2, 2018 in accordance with local protocols as described in CGS 7-148bb, with regard to the tax sharing agreement component located in Article IX of the Inter- Municipal Agreement. NOW, THEREFORE BE IT RESOLVED: That the Board of Mayor and Burgesses hereby approves the Inter-Municipal Agreement with modifications between the Borough of Naugatuck and the City of Waterbury for the development, extension of public utilities and eventual disposition of the Property; and FURTHER RESOLVED: That the Board of Mayor and Burgesses hereby approves the specific provisions contained in Article IX of Inter-Municipal Agreement regarding tax sharing between the Borough of Naugatuck and the City of Waterbury as modified; and FURTHER RESOLVED: That the Mayor of the Borough of Naugatuck or his designee shall execute same; and FURTHER RESOLVED: That the Mayor of the Borough of Naugatuck, with the consent of Borough Attorney, may make minor revisions to the Inter-Municipal Agreement; and FURTHER RESOLVED: That the Mayor of the Borough of Naugatuck has full authority to do all other actions necessary to effectuate the Inter-Municipal Agreement. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to execute an Intergovernmental Agreement between the forty-one municipalities that comprise the Local Workforce Development Area under the Workforce Innovation and Opportunity Act of 2014, as amended. 26. Motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to execute the renewal of a lease agreement between the Connecticut Department of Transportation and the Borough of Naugatuck for the use of land on Hotchkiss Street. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to sign a document with Eversource through Davis Hill Development LLC, 105 Prospect Street, Greenwich CT 06830 to approve an ZREC application for a solar panel grant and possible installation at Maple Hill Elementary School as recommended by the Building Committee. 28. Mayor Hess discussed a National Fitness Court Grant Application. He explained it would be a year round, weather protected, outdoor gym. The borough is eligible for a $30,000 grant. We would have to make a $30,000 to $40,000 investment. The rest of the funding would be obtained through sponsors by the company. The organization is suggesting putting the gym at Linden Park. There was discussion whether the Park Commission should have input on the matter. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses refer the proposed National Fitness Court Grant Application to the Park Commission for review. 29. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses add to the agenda a motion for Public Works Director James Stewart to accept a fee in lieu of final paving. 30. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to accept a fee in lieu of final paving from Earthworks Excavating and Landscaping, Inc., 10 Fox Hollow Road, P.O. Public Comment – None 33. Burgess Comments/Sub-Committee Reports Burgess Bronko received a complaint regarding loud music being played at 2 a.m. in the old Continental Room. The resident complained that his house was rattling from the loud music. He was told the church is renting out the space. Burgess Bronko asked Deputy Chief Bernegger to look into the matter. Burgess DeOliveira thanked the fire department for allowing him to participate in the live burn at the old Vinny’s Restaurant. Burgess Vitale saw several dead geese on the road in the industrial park on Sunday morning. He said it looked as if someone had intentionally drove into the flock. He is glad the fire department is up to speed on inspections now that we have a fire inspector. Burgess Herb reported the Conservation Commission is participating with Kevin Zak and his efforts with Waterbury. Burgess Wisniewski congratulated everyone who participated in the Mission 22 Hike. Burgess Neth said everyone did a great job on the festival. He asked where we are in the process of hiring a new police chief. Deputy Mayor Taf Jackson said she had a great time at the festival. There were 350 seniors in attendance at Senior Day. The Deputy Mayor applauded Senior Center Director Harvey Frydman for doing such a wonderful job. Burgess Burns thanked everyone on behalf of the Burns family for the cards, gifts and well wishes he received while recuperating from his fall. Mayor Hess said the 102nd Army Band Ripcord will be invited back to play at next fall’s festival. He is proud of Burgess Herb for finishing the Mission 22 Hike. The hike was in memory of Jason Litke. Mayor Hess commends him for serving our country. He said there are beautiful parts of Naugatuck that are unseen unless you walk the trails. People would be amazed to see how beautiful it is. 34.
