VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of January. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth to recess to Executive Session at 6:34 p.m. for discussion on the following: Real Estate (Creation and Location of Tax Incremental Financing District, Building Lot on Auburn Street) and Pending Litigation. Public Comment A herbologist from South Africa visited Gunntown Passive Park. Al White will be honored as the Earth Day Mayor of the Day on April 20th at 10 a.m. 10. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute a memorandum of understanding for an Information Sharing Initiative known as the “Northeast Law Enforcement Information Exchange (Northeast LInx)” as recommended by Deputy Police Chief Joshua Bernegger. 11. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses amend the motion below on the agenda. Motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution regarding a National Fitness Court Grant Application, as if read: WHEREAS, the Borough of Naugatuck has submitted a Grant Application to National Fitness Campaign for the construction of an outdoor Fitness Court®, which is free for public use, and; WHEREAS, subject to the conditions herein, the Borough of Naugatuck will accept a $30,000 National Grant from National Fitness Campaign to promote and implement an outdoor Fitness Court®, and; WHEREAS, the Borough of Naugatuck will use its best efforts to secure funding, which will be available and committed to this program including partnerships between the Borough of Naugatuck, National Fitness Campaign, and community sponsors to construct and maintain the outdoor Fitness Court®, and; WHEREAS, the Borough of Naugatuck will commit to construction and launch of the outdoor Fitness Court® by the end of the 2019 calendar year, provided that it raises sufficient funding through community sponsors, in an amount not less than $45,000 and is further approved by the Joint Boards, and;  -3- Revised Minutes – Board of Mayor and Burgesses – Regular Meeting – February 5, 2019 WHEREAS, the Board of Mayor and Burgesses believes the outdoor Fitness Court® is an important recreation facility to support the health of the community by making “world- class” fitness free on Linden Park, to fund an outdoor bodyweight circuit training Fitness Court®, and to earn local and national recognition as a leader in providing affordable health and wellness. NOW THEREFORE, BE IT RESOLVED, that the Board of Mayor and Burgesses will collaborate with National Fitness Campaign to implement the construction of an outdoor Fitness Court® and make fitness free to community residents and visitors, subject to the funding contingency referenced herein. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Judy Anderson (R), 1013 Weid Drive, Apt. 101, Naugatuck, CT 06770 as a regular member of the Board of Assessment Appeals, term to expire February 1, 2022. 15. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Jeffrey Hanson (U), 46 Fairwood Road, Naugatuck, CT 06770 as a member of the Water Pollution Control Authority, filling the expired term of S. Discussion/possible action to extend the contract to USA Recycling for “Curbside Trash and Recycling Pick-up” along with “Dumpsters” at town buildings. VOTED: Unanimously on a motion by Burgess Bronko and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Hess to sign a contract extension with USA Recycling for a five-year period for “Curbside Trash and Recycling Pick-up” as recommended by the Assistant to the Public Works Director Sandra Ribeiro. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Bronko that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a contract with USA Recycling for “Dumpsters” at town buildings for a one-year period as recommended by the Assistant to the Public Works Director Sandra Ribeiro. 19. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to enter into an agreement regarding a “Community Showcase Video Program” with CGI Communications, Inc., 130 E. Main Street, Rochester, New York 14604. 20. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents for “Ultra-Low Sulfur #2 Heating Oil” to East River Energy, 401 Soundview Road, P.O. Box 388, Guilford, CT 06437 in the amount of $2.1050 fixed prepay price per gallon for 30,000 gallons as recommended by Controller Allyson W. Bruce. 22. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents for “Regular Unleaded Gas” to East River Energy, 401 Soundview Road, P.O. Box 388, Guilford, CT 06437 in the amount of $1.8400 fixed prepay price per gallon for 3,500 gallons as recommended by Controller Allyson W. Bruce. 23. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses authorize Mayor Hess to execute all contracts and related documents for “Regular Unleaded Gas – Police Department” to East River Energy, 401 Soundview Road, P.O. Box 388, Guilford, CT 06437 in the amount of $1.8400 fixed prepay price per gallon for 68,500 gallons as recommended by Controller Allyson W. Bruce. 24. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses approve the use and assign uncommitted funds from the Five Year Capital Project Account to a new fund for the Roof Replacement Project at City Hill Middle School including the Roof HVAC Units in the amount of $490,085 as recommended by the Five Year Capital Committee. 25. Motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses adopt the following Fair Housing Resolution, as if read: WHEREAS, All persons are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, Federal fair housing laws require that all individuals, regardless of race, color, religion, sex, handicap, familial status or national origin, be given equal access to all housing-related opportunities, including rental and homeownership opportunities, and be allowed to make free choices regarding housing location; and  -6- Revised Minutes – Board of Mayor and Burgesses – Regular Meeting – February 5, 2019 WHEREAS, Connecticut fair housing laws require that all individuals, regardless of race, creed, color, national origin, ancestry, sex, marital status, age, lawful source of income, familial status, learning disability, physical or mental disability, sexual orientation, or gender identity or expression be given equal access to all housing-related opportunities, including rental and home ownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, The Borough of Naugatuck, CT is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice. NOW THEREFORE, BE IT RESOLVED, That the Borough of Naugatuck hereby endorses a Fair Housing Policy to ensure equal opportunity for all persons to rent, purchase, obtain financing and enjoy all other housing-related services of their choice on a non-discriminatory basis as provided by state and federal law; and BE IT FURTHER RESOLVED, That the chief executive officer of the Borough of Naugatuck or his/her designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck and for advising such person of the right to file a complaint with the State of Connecticut Commission on Human Rights and Opportunities(CHRO) or the U.S. Department of Housing and Urban Development (HUD) or to seek assistance from the CT Fair Housing Center, legal services, or other fair housing organizations to protect his or her right to equal housing opportunities. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses add to the agenda discussion/possible action regarding the replacement of flooring in the Senior Center Men’s Bathroom. 27. The Senior Center Men’s Bathroom floor is in poor condition with several missing tiles. It has become a tripping hazard. Controller Allyson Bruce told the board that Facilities Manager Mike Massicotte had a contractor look at the floor. He suggests leveling the existing tile floor and covering it with vinyl for a cost of $600. Burgess Mike Bronko does not recommend that alternative. Burgess Bronko and Finance Board Member Seth Bronko went to the Senior Center to look at the condition of the floor and give Senior Center Director Harvey Frydman an estimate. Burgess Bronko said the floor needs to be removed and a hardie board substrate needs to be put down and tile flooring on top. He said a  -7- Revised Minutes – Board of Mayor and Burgesses Regular Meeting – February 5, 2019 contractor will not know the extent of the work needed until after the existing floor is removed. He thinks the floor can be replaced with tile for approximately $5,000. VOTED: Unanimously on a motion by Burgess Vitale and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses approve replacement of the Men’s Room Floor at the Senior Center for a price not to exceed $5,000. 28. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses add to the agenda the appointment of a member to the Building Committee for schools. 29. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses authorize Mayor Hess to appoint Kevin Dion, BOE Facilities Manager, 497 Rubber Avenue, Naugatuck, CT 06770 as a member of the Building Committee for schools. 30. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses add to the agenda a motion to authorize the controller to refund a tax refund. 31. Mayor Hess went to Portugal this past month on vacation. He enjoyed meeting the people of Portugal. He met with the mayor of Vila Pouca and discussed the possibility of forming a sister city relationship with Naugatuck. We have a large Portuguese community in Naugatuck. Vila Pouca is a valley town with a community similar to Naugatuck. Granite is their biggest product. The Trail of Santiago runs through the town. VOTED: Unanimously on a motion by Burgess Neth and seconded by Deputy Mayor Taf Jackson that the Board of Mayor and Burgesses begin discussions with Vila Pouca, Portugal on a Sister City Arrangement. 35. Public Comment Finance Board Chairman Daniel Sheridan said the Fitness Court should be placed in the capital budget. He asked if the Goodwill Truck is coming back to town. He said the handicapped spot in the back parking lot and the step up into town hall is not visible and needs to be repainted. 37. Mayor and Burgess Comments Mayor Hess said the Wastewater Treatment Plant contract is a twenty-year contract expiring in the year 2022. The borough is going through an RFP process. We need to choose a company by the end of this year. Jim Binder is our lead consultant. The mayor is very comfortable with Mr. Binder and his vast knowledge of our contract. Burgess DeOliveira said there will be an essay contest this Saturday at the American Legion Hall. Our state senators and representatives will hold office hours from 12 p.m. to 2 p.m. this Saturday at town hall. Burgess Herb and his family will be receiving a state citation for their many years of service as owners of Cindy’s Market. Burgess Vitale said the Historical Society will hold their annual fundraiser, Savor CT, this Saturday from 7 p.m. to 10 p.m. at the Portuguese Club. Deputy Mayor Taf Jackson wished John Lauer and Michael Favale congratulations on their retirement. She thanked them for their years of service to Naugatuck. 38.
