SPECIAL MEETING
BOARD OF MAYOR AND BURGESSES
OCTOBER 16, 2019
1. Mayor “Pete” Hess called the special meeting to order at 6:03 p.m. with the following in
attendance:

2. Burgess Hoff led in the Pledge of Allegiance to the flag.
3. VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by
Burgess Neth that the Board of Mayor and Burgesses recess to Executive
Session at 6:04 p.m. for discussion on the following: Real Estate
(Acquisition of Lanxess Property) and Pending Litigation inviting in
Attorney Gary O’Connor.
Mayor Hess reconvened the meeting at 6:50 p.m.
4. The following motion emanated from Executive Session.
VOTED: Unanimously on a motion by Deputy Mayor Taf Jackson and seconded by
Burgess Neth that the Board of Mayor and Burgesses authorize mayor
Hess to take appropriate action to procure Pollution Liability Insurance
jointly with Lanxess Solutions US, Inc. relating to the acquisition,
remediation and development of the 86.5 acre Lanxess property with
limits of ten million dollars ($10,000,000) for a price not to exceed a total
of two hundred twenty-five thousand dollars ($225,000) for the ten (10)
year policy. Controller Allyson Bruce will be instructed to recommend an
appropriate transfer of funds from excess revenue.
For the record:
Burgess DeOliveira: “I think this is a very good deal and while we are paying the two
hundred or so thousand up front, I think once spread out over ten years, it is a huge
benefit for the town and it takes off a lot of liability that can occur at some point.”
5. VOTED: Unanimously on a motion by Burgess Hoff and seconded by Burgess
DeOliveira to adjourn the special meeting at 6:52 p.m.
