MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES JULY 5, 2022 Due to the COVID-19 Pandemic, the Borough of Naugatuck held the Board of Mayor and Burgesses meeting on a hybrid basis. Everyone was welcomed to attend in person, by Zoom Webinar or by phone. 1. Mayor “Pete” Hess called the regular meeting to order at 7:04 p.m. with the following in attendance: BURGESSES: PRESS: R. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses approve the minutes of the regular meeting of June 7, 2022 and the revised public hearing of May 10, 2022. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses approve the monthly reports of June. Each member received copies for review. 5. Mayor’s Opening Comments Mayor Hess said they will be spending extra time in executive session this evening discussing LANXESS and Parcel A and B. 6. Public Comment A resident spoke about environmental pollution from 5G and the negative effects on people. Finance Board Chairman Daniel Sheridan disagrees with waiving the bid for the skateboard park. He thinks it is a bad purchasing practice to waive bids. He also thinks the scooter program is dangerous with underage kids riding on them through town.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – July 5, 2022 7. Chief Kyle Kelley gave his monthly update on the Naugatuck Ambulance Corps (NAC). They responded to four hundred plus calls last month. There were over forty-four responses for mutual aid to Waterbury. They are getting a newer ambulance, which is currently in the paint shop, funded by the borough and a grant from ION Bank. 8. Mayor Hess reappointed Linda Ramos, P.O. Box 945, Naugatuck, CT 06770 as a member of the Blight Citation Hearing Board, term to expire July 1, 2025. 9. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses preapprove and authorize the Fiscal Year 23/24 Fleet Fund Purchase of five (5) police department vehicles, one (1) police department vehicle for undercover use, one (1) fire department SUV type vehicle and one (1) town department SUV type vehicle as recommended by Controller Allyson Bruce. Vehicles require additional lead-time due to the automotive industries production line delays. 10. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses approve United Concrete Products, Inc., 173 Church Street, Yalesville, CT 06492 to continue to provide goods and/or services for Fiscal Year 2022/2023 and to authorize Mayor Hess to execute all contracts and related documents as recommended by Public Works Director James Stewart. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 11. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a contract to “Provide Social Work Services to the Naugatuck Police Department” with Stokes Counseling Services, 16 Hillside Avenue, Naugatuck, CT 06770 for Fiscal Year 2022/2023 as recommended by Police Chief C. Colin McAllister. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 12. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a contract to “Repair/Replace the Roof to Town Hall Located at 229 Church Street, Naugatuck” with Diamond Roofing Specialist, Inc., 99 Brookside Road, Waterbury, CT 06770 for Fiscal Year 2022/2023 as recommended by Public Works Director James Stewart. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a contract to “Repair/Replace the Roof to the Youth Services Building Located at 13 Scott Street, Naugatuck” with Diamond Roofing Specialist, Inc., 99 Brookside Road, Waterbury, CT 06770 for Fiscal Year 2022/2023 as recommended by Public Works Director James Stewart. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 14. Motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses waive the bid and authorize Mayor N. Warren “Pete” Hess to enter into a construction contract to build a Skateboard Park at Linden Park with Rampage LLC, 1625 Railroad Avenue, Bridgeport, CT 06605 in an amount not to exceed $250,000 as recommended by Public Works Director James Stewart. Burgess Bronko opposed. 15. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses waive the bid for the purchase of a “Used Toro GreensPro 1260 Turf Roller Model #44913, Serial #403400709” to Robert Dumser C/O Sunset Hill Golf Club, 13 Sunset Hill Street, Brookfield, CT 06804 in the amount of $14,000 as recommended by Public Works Director James Stewart. 16. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to enter into a contract with the City of Waterbury and the Waterbury Fire Department for the sale of the “2000 Pierce Ascendant 105’ Aerial Apparatus” for the purchase price of $95,000 as recommended by 1st Assistant Fire Chief Walter Seaman. 17. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to sign a contract with Axon Enterprise, Inc., 180 East Sky Harbor Circle, Phoenix, AZ 85034 for the purchase of an additional “Sixteen (16) Axon Body Cameras for the Naugatuck Police Department” for Fiscal Year 2022/2023 in order to comply with recent police accountability legislation as recommended by Police Chief C. Colin McAllister. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses add to the agenda a motion to extend the street light maintenance service contract. 20. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses extend the Street Light Maintenance Service Contract 19-20 with Turri-Masterson, Inc., 766 Riverside Drive, Torrington, CT 06790 for an additional three years as per Section 13 of the contract including 6.49% CPI adjustment for the first year of the contract extension, contract extension to expire June 30, 2025 as recommended by Public Works Director James Stewart. 21. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses add to the agenda a motion to authorize the mayor to sign a Summer Employment Program Grant for Naugatuck Youth Services. 22. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor N. Warren “Pete” Hess to execute all contracts and related documents for a Summer Employment Program Grant through the Northwest Regional Workforce Investment Board in the amount of $146,775.38, as well as budget amendments to allow for additional funding at a later date, managed by Naugatuck Youth Services, Inc. as recommended by Naugatuck Youth Services Executive Director Kristin Mabrouk.  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – July 5, 2022 23. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses add to the agenda a motion regarding the HVAC in the Police Department Evidence Room. 24. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses conditionally approve Mayor Hess to sign a contract to repair the “HVAC in the Police Department Evidence Room” contingent upon the Standard Building Committee’s approval of the quote for the project and vendor. 25. Public Comment – None 26. Burgess Comments/Sub-Committee Reports Burgess Neth-Kunin reported that a Board of Education member resigned so there is an opening on the board. Burgess Dambowsky said everyone did a good job on the fireworks. Burgess Vitale said there will be a fundraiser at the VFW in Waterbury this Friday for former town bus driver, Judy Harper, whose husband passed away. Battle of the Badges between the police department and fire department will take place this Saturday at 6 p.m. A Pep Talk will be hosted by the Naugatuck Police Department on June 16th from 10 a.m. to 2 p.m. Burgess Marenghi thinks everyone involved did an outstanding job on the fireworks. The summer concerts are receiving positive feedback. Burgess Smith asked if the All-State Track and Field athletes could be recognized on the green before the start of one of the summer concerts. Deputy Mayor Neth said there has been very good dialogue in the Parcel B Committee. He thinks we need to see if the scooter system is right for downtown. 27. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin to recess to Executive Session at 8:56 p.m. for discussion on the following: Real Estate (LANXESS Property, Parcels A, B, Y & Z, Bank of America, Acquisition of Land for Downtown Parking, Tax Incremental Financing District, Sale of Former Recycling Center – Rubber Avenue) and Pending Litigation inviting in NVRDC Director Thomas Hyde. Mayor Hess reconvened the meeting at 10:13 p.m. 28. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor Hess to sign all appropriate closing documents to acquire the 86.5 acres LANXESS site as discussed in executive session.  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – July 5, 2022 29. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses authorize Mayor Hess to sign an application for a Community Investment Fund Grant for eight million dollars ($8,000,000) to construct the road network and bring utilities to the LANXESS Property. 30. The following motion emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Neth and seconded by Burgess Neth-Kunin that the Board of Mayor and Burgesses extend the closing date on the acquisition of the LANXESS Parcel through September 1, 2022. 31.
