MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES MAY 7, 2024 The Borough of Naugatuck held the Board of Mayor and Burgesses meeting on a hybrid basis. Everyone was welcomed to attend in person, by Zoom Webinar or by phone. 1. Mayor “Pete” Hess called the regular meeting to order at 7:02 p.m. with the following in attendance: BURGESSES: PRESS: R. Burgess Kimberly Gallo led in the Pledge of Allegiance to the flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the minutes of the regular meeting of April 2, 2024. Each member received a copy for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the monthly reports of April. Each member received copies for review. 5. Mayor’s Opening Comments Mayor Hess said there is a possibility there will be a second meeting this month. The Spring Festival is this Friday and the rain date is Saturday. 6. Public Comment A resident said the rain is deteriorating the sidewalks over the years on Homestead Avenue. Conservation Commission Chairwoman Melissa Leonard spoke about the Algonquin Gas Line expansion on Maple Street. The gas is going overseas, it is not staying in the United States. Conservation Commission member Allison Sanchirico asked the board to sign the letter to the governor to stop the expansion of the gas line. -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – May 7, 2024 7. NAC Chief Kyle Kelley gave the monthly update on the Naugatuck Ambulance Corps (NAC). They are working on up staffing. A paramedic went to Middlebury four times in one day. They received a grant from the Saunders Trust Fund to purchase a stretcher and a Power-Load System. 8. Mayor Hess gave an update on the Borough of Naugatuck Development Projects. He said all projects are underway and on schedule. Downtown ARPA Project is on Church Street and Rubber Avenue with Eversource Gas here now. The stormwater drainage project is on the green. The green should be available for the summer. A second outdoor venue for the concerts would be on the back lawn of the Naugatuck History Museum. The Tuttle Building is not a viable source for electricity. He said they will be doing other things to make electricity viable. The Planning Commission approved the final subdivision plans for Naugatuck Industrial Park Phase III. The CCC Grant is for Water Street, Old Firehouse Road, a portion of Rubber Avenue and the new road. The design has gone out to bid. We will be awarding the bid for downtown infrastructure in June or July. Pennrose received financing and they should start construction in the fall. Construction for Parcel A should begin in 2025 once the train station commences construction. Retail 101 is moving out. A new lumber company will be utilizing their space. The Event Center will be utilized in the winter as long as parking isn’t needed in the front of the building. The Naugatuck River Greenway Trail design from Maple Street Bridge to Breen Field will be awarded this evening. A future project will be at the former Risdon site which will be a new public works department. The Amazon Project is on schedule. 9. Mayor Hess reappointed Marcelo Martins, 220 Park Avenue, Naugatuck, CT 06770 as a member of the Western CT Tourism District Board of Directors, term to expire October 1, 2025. 10. Mayor Hess reappointed Joseph Corona (U), 73 Hilltop Road, Naugatuck, CT 06770 as a regular member of the Fire Commission, term to expire May 1, 2029. 11. Chief of Police C. Colin McAllister is asking the board to adopt an Unlawful ATV Operation Ordinance. Surrounding towns have similar ordinances. He worked with the borough attorney to develop the language for Naugatuck. The ordinance is regarding the illegal use of ATVs, dirt bikes and mini bikes being driven on trails. Riders and horses have been injured on trails by ATVs. The ordinance would allow an unregistered ATV to be seized. Gas stations would be fined if selling gasoline to ATV owners if the ATV is not properly secured to a hitch or trailer. Mayor Hess asked for a legal notice to be prepared to proceed with a public hearing at the next regular meeting on the Proposed Unlawful ATV Operation Ordinance. 12. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the bid for contract FY25-B089 for “High Visibility Double Yellow Roadway Traffic Markings” to Atlantic Pavement Marking, Inc., 15 Industrial Road, Prospect, CT, 06712, as per bid as recommended by Police Chief C. Colin McAllister. -3- Minutes – Board of Mayor and Burgesses Regular Meeting – May 7, 2024 Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 13. Arts Commission Co-Chairs Francis Santana and Anthony Jones discussed the Final Mural Design at the Intersection of Maple Street and Water Street. Drawings incorporated on the mural were the industrial revolution, the river and Native Americans. They discussed the process and the pictures depicted on the final design. Matthew Conway from Rise Up for the Arts said a design needs to be submitted soon to the Department of Transportation (DOT). Tweaks can be made later but the DOT needs to get the design to various departments. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the Preliminary Design by Rise Up for the Arts for the Mural on the Railroad Walls, final design to be presented to the Board of Mayor and Burgesses for approval. 14. Executive Aide to the Mayor James McGrath discussed the Crestwood Drive Watermain Installation/Assessments Procedure. He said there are three levels of participation for residents on Crestwood Drive. One, is to not participate at all. Two, is to participate and keep their well. Three, is to participate and abandon their well. There will be a public hearing and all residents will have an opportunity to speak. Letters will be sent to every resident on Crestwood Drive informing them of the public hearing. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses will hold a Public Hearing on June 4, 2024 at 6 p.m. in the Hall of Burgesses, 229 Church Street and by Zoom Webinar to discuss the proposed assessments for the Crestwood Drive Watermain Installation Project and the terms associated with the proposed assessments for all residents residing on Crestwood Drive. 15. Motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses award a contract on the Greenway Design to Kleinfelder Northeast, Inc., 400 Capital Boulevard, Suite 104, Rocky Hill, CT 06067. Motion withdrawn. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses award a contract on the Greenway Design to Kleinfelder Northeast, Inc., 400 Capital Boulevard, Suite 104, Rocky Hill, CT 06067 in the amount of $441,000 subject to the approval of the borough attorney. 16. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the bid for contract FY25-B088 for “Pest Control Services” to Pest Control, Inc. dba Yale Termite & Pest Elimination Corporation, 69 Mott Street, Ansonia, CT 06401 as per bid as recommended by Public Works Director James Stewart. Contracts shall commence upon vendor completing all borough requirements and the purchase order is received by vendor. 25. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to approve a Change Order for contract FY24-B065 Downtown Community Connectivity Bike and Pedestrian Improvements Project with Priority Landscaping LLC, 258 Whisconier Road, Brookfield, CT 06804 in the amount of $143,058.00 includes the cost of asphalt patching for sidewalk construction on Central Avenue, additional costs being paid from FY2024 Townwide Sidewalk Account. 26. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to approve a Change Order for contract FY24-B065 Downtown Community Connectivity Bike and Pedestrian Improvements Project with Priority Landscaping LLC, 258 Whisconier Road, Brookfield, CT 06804 in the amount of $252,153.00 for the extension of sidewalks from Cedar Street to Division Street, additional costs being paid from Fee in Lieu of Paving payments from the Downtown Area. -9- Minutes – Board of Mayor and Burgesses Regular Meeting – May 7, 2024 27. Tax Collector James Goggin said he would like the board to pass a Delinquent Motor Vehicle Taxes Ordinance which would allow him to collect a fee for delinquent motor vehicle taxes to cover the cost of mailing reminders. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses set up a public hearing at 6:45 p.m. for the proposed Delinquent Motor Vehicle Taxes Ordinance. 28. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Public Works Director James Stewart to approve a Change Order for contract FY24-B054 Drainage Improvement at Fairchild Park and Cherry Street Project with Earthworks Excavating & Landscaping, Inc., 4 Woodruff Hill Road, Oxford, CT 06478 in the amount of $252,286.00 for the extension of the drainage system to Charles Street. The additional costs being paid from the State of Connecticut Department of Housing Small Cities GDBG Program Grant. 29. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Mayor Hess to extend Contract 19-12 as allowed in the bid documents for the FY2025 Paving Season with Cocchiola Paving, Inc., 18 Falls Avenue, Oakville, Connecticut, 06779 with the escalation base being set at $502.50 per English ton extending the unit price based on the 2019 bid as recommended by Public Works Director James Stewart. 30. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Controller Allyson W. Mayor and Burgess Comments/Sub-Committee Reports Burgess Neth-Kunin reported the Board of Education meeting will be held the third Thursday this month instead of the second Thursday. The Raymond K. Foley Award Ceremony will be held on May 14th honoring Jennifer and Kenneth Stone. Burgess Dambowsky said Memorial Day is a day of honor. Burgess Gallo said it was good to be back in person after her surgery. Burgess Marenghi said the Arts Commission concert series will be held on the back lawn of the Tuttle Building. The Historical Museum will be open prior to the start of the concerts. On May 18th at Linden Park will be a Trout Fishing Fundraiser for the high school fishing club. A very solemn service is held every year at 5:30 a.m. prior to the Memorial Day Parade. Burgess Marenghi said it is important to recognize those who made the ultimate sacrifice. Burgess Rosenblatt reported the Adult Education Graduation will be held on May 30th. Deputy Mayor Vitale said there will be a “Walk with Derek” Fundraiser at Jesse Camille’s Restaurant tomorrow. 33.
