MINUTES REGULAR MEETING BOARD OF MAYOR AND BURGESSES FEBRUARY 4, 2025 The Borough of Naugatuck held the Board of Mayor and Burgesses meeting on a hybrid basis. Everyone was welcomed to attend in person, by Zoom Webinar or by phone. 1. Mayor “Pete” Hess called the regular meeting to order at 7:01 p.m. with the following in attendance: BURGESSES: PRESS: R. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the minutes of the special meeting of January 2, 2025 and the regular meeting of January 7, 2025. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the monthly reports of January. Each member received copies for review. 5. Mayor’s Opening Comments Mayor Hess said the newspaper reported several towns lost grants including Naugatuck. The good news is that the funds have been restored to Naugatuck. It would have been $700,000 lost. He said it is all back in place. NVCOG is monitoring the situation. 6. Public Comment – None 7. Chief Kyle Kelley gave the monthly update on the Naugatuck Ambulance Corps (NAC). NAC responded to 438 calls last month and provided 40 mutual aid requests. Chief Kelley met with the mayor, the controller and the NAC Board to discuss a budget for next fiscal year. NAC is looking toward the future and planning for growth in the town, especially with the assisted living facility opening in a few months.  -2- Minutes – Board of Mayor and Burgesses – Regular Meeting – February 4, 2025 8. Mayor Hess discussed the Modified Five-Year Road Improvement Plan. He said in the past, LOCIP money was used to purchase salt and build catch basins with outside contractors instead of paving roads. In 2017, the public works department turned into a real construction crew, even building our own catch basins. Every year money was increased in the budget for road paving. Each road is rated and that is how it is determined the order in which roads get paved. The plan is to finish paving all roads in town over the next five years. This does not include LOTCIP bigger projects like Rubber Avenue and North Main Street. LOCIP money is $500,000 a year which we now use on paving roads. Mayor Hess said we budget one million dollars on road paving a year. After the five years, they will have to review the plan to keep roads in good condition. 9. Mayor Hess said he would like to have a working Facade Improvement Subcommittee. The subcommittee will consist of burgesses, someone from the building inspector’s office and the land use office. They would start taking applications and evaluate them to make sure they comply with the ordinance. There is $300,000 set aside from TIF funds. Mayor Hess appointed Burgess Meghan Smith and Burgess Julie Rosenblatt to the Facade Improvement Subcommittee. 10. There was discussion about the Naugatuck Senior Center and the Appointment of a Senior Center Activity Committee. Mayor Hess said some Senior Center members approached him upset with the lack of activities at the senior center. He asked Burgess Gallo and Burgess Rosenblatt, senior center liaisons, to investigate the situation. They reviewed the membership. Three hundred Naugatuck seniors are members at the Prospect Senior Center. Some of those members stated it was because there are activities in Prospect. There are 2000 members in Prospect, 90% are active and 300 active members are Naugatuck residents. There are 700 members in Naugatuck, 18% are inactive in Naugatuck. It was suggested to do a survey to get feedback on why they are attending Prospect instead of the senior center in their own town. Both burgesses will work with Senior Center Director Harvey Frydman to increase activities, look at the hours of operation and develop a budget. 11. Mayor Hess discussed how the budget for Fiscal Year 2025/2026 is developed. The process will begin next week. The budget is started from scratch, a zero-based budget. They go through every department and every line item. Each department head presents their budget to the Board of Finance workshops. Burgesses usually attend the workshops. After a proposed budget is crafted, it is then presented to the burgesses sitting jointly with the Board of Finance which is the Joint Boards. There is a public hearing and then the Joint Boards adopt the budget. All of the workshops are public meetings. This is the final year of the three-year phase in of revaluation. Mayor Hess said they targeted a mill rate under forty mills. 12. Mayor Hess gave a report on the Borough of Naugatuck Development Plans. Underground pipes on Church Street should be installed by the end of next week. Then sidewalk construction and paving should be completed by June. Mayor Hess said people don’t understand why it seems we are doing ten years of work in two years. The borough has been working diligently with the state and the federal government to acquire the money. The money has to be spent within two years. The train station and train platform along with housing on Parcel B can’t happen until all the new utilities are upgraded. We are doing everything we can to help downtown businesses. There is a new municipal parking lot with more parking spaces. Professional inspectors are watching everything, every day. 13. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Mayor Hess to sign a renewal contract with Sullivan & LeShane, Inc., 287 Capitol Avenue, Hartford, CT 06106 to work with the borough as its registered lobbyist from March 1, 2025 to February 28, 2026 in the amount of $40,000. 14. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a contract for an “Online Registration Program” with MyRec.com, 129 Burr Pond Rd, Pittsford, Vermont 05763 in an amount of $823.75 as recommended by Recreation Director Emily Osterberg. Motion tabled. 15. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses recess to the Retirement Board at 8:01 p.m. Mayor Hess reconvened the meeting at 8:03 p.m. 16. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the reappointment of Adam M. Bronko (R), 34 Fairfield Court, Naugatuck, CT 06770 as a regular member of the Board of Assessment Appeals, term to expire February 1, 2028. 17. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses approve the reappointment of Rimas Balsys (R), 33 Phoenix Avenue, Naugatuck, CT 06770 as a member of the Water Pollution Control Authority, term to expire February 1, 2030. 18. Mayor Hess said we are going to convey a piece of Water Street to the state so they can build the train platform and the train station. Water Street will be a town road at the beginning and the end of the road. The middle of Water Street will be state property. We need to follow a statutory process to discontinue the road and convey it to the state. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses refer to the Planning Commission the Discontinuance of Water Street from the proposed ending of the public road as shown on the map this evening which  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – February 4, 2025 is a map of the Borough of Naugatuck, Lot 6, Water Street, Naugatuck Connecticut prepared by MCA, Martinez Couch and Associates LLC, from its conception to where it commences again approaching the Naugatuck Event Center and to refer to the Planning Commission for an 8-24 referral and then back to the borough board to vote to discontinue the road. 19. Motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses adopt the following resolution approving the Borough of Naugatuck’s application to the Connecticut Department of Energy and Environmental Protection for a Declaration of Notice of Activity and Use Limitation, and to authorize the Mayor on behalf of the Borough of Naugatuck to execute the NAUL application; as if read: WHEREAS, the Borough of Naugatuck (the “BON”) is aware of certain environmental conditions on the real property it owns located at Lot 6, Water Street, Naugatuck, Connecticut (the “Property”); and WHEREAS, in order to comply with the State of Connecticut remediation regulations, the BON must submit an application to the Connecticut Department of Energy and Environmental Protection (“DEEP”) for a Notice of Activity and Use Limitation (the “NAUL”). The NAUL is a legal interest in the Property that will restrict usage of the Property so that residential uses cannot take place on the Property, as are further described in the NAUL; and WHEREAS, upon the approval of the NAUL application, the NAUL will be recorded on the land records of the BON; and NOW, THEREFORE BE IT RESOLVED THAT: (i) The foregoing recitals are true and correct and are incorporated herein by this reference as if fully set forth. (ii) The Board of Mayor and Burgesses hereby consents to and authorizes the Mayor of the BON to submit the NAUL application to DEEP on behalf of the BON, including the Parcel Owner Statement and any other documents required in connection with the NAUL. (iii) The Mayor, pursuant to the authority granted under the BON Charter and this Resolution, is authorized on behalf of the BON to execute and deliver to DEEP the NAUL application, the NAUL, and any such other documents, certificates or agreements that the Mayor, in his judgment and after consultation with counsel, may deem to be necessary or desirable to effectuate the foregoing resolution, in the name of the BON and to do any and all other acts to effectuate the foregoing, including the recording of the approved NAUL on the land records of the BON. Motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses adopt the following resolution regarding joining the Connecticut Municipal Redevelopment Authority as a Member Municipality; as if read: WHEREAS, the Connecticut Municipal Redevelopment Authority (the “Authority”), a body politic and corporate, constituting a public instrumentality and political subdivision of the State of Connecticut has been established pursuant to section 8-169ii of the Connecticut General Statutes (the “General Statutes”); and WHEREAS, the Authority was created for the performance of an essential public and governmental function, including for the purposes set forth in section 8-169jj of the General Statutes to: (1) stimulate economic and transit-oriented development, as defined in section 13b-79kk of the General Statutes, within Connecticut Municipal Redevelopment Authority development districts; (2) encourage residential housing development within development districts; (3) manage facilities through contractual agreement or other legal instrument; (4) stimulate new investment within development districts and provide support for the creation of vibrant, multidimensional downtowns; (5) upon request of the legislative body of a member municipality, or the legislative bodies of the municipalities constituting a joint member entity, as applicable, in which a development district is located, work with such municipality or municipalities to assist in development and redevelopment efforts to stimulate the economy of such municipality or municipalities; (6) upon request of the Secretary of the Office of Policy and Management and with the approval of the chief executive officer of a member municipality, or the chief executive officers of the municipalities constituting a joint member entity, as applicable, in which a development district is located, enter into an agreement to facilitate development or redevelopment within such development district; (7) encourage development and redevelopment of property within development districts; (8) engage residents of member municipalities, or municipalities constituting a joint member entity, as applicable, and other stakeholders in development and redevelopment efforts; (9) market and develop development districts as vibrant and multidimensional; and (10) provide financial support and technical assistance to municipalities to develop housing growth zones; and WHEREAS, according to Section 8-169ll of the General Statutes, a municipality may, by certified resolution of the legislative body of the municipality, opt to join the Authority as a member municipality, provided such municipality holds a public hearing prior to any vote on such certified resolution; and  -6- Minutes – Board of Mayor and Burgesses – Regular Meeting – February 4, 2025 WHEREAS, the BOROUGH of NAUGATUCK (the “BON”) held such a public hearing on the 4th of FEBRUARY, 2025 pursuant to the Notice attached hereto; and WHEREAS, the BOARD OF MAYOR AND BURGESSES has found that joining the Authority as a member municipality would support the BOROUGH OF NAUGATUCK’S efforts to stimulate economic development and foster the purposes outlined in Section 8- 169jj within NAUGATUCK and accordingly desires to join the Authority as a member municipality; and WHEREAS; the BOROUGH OF NAUGATUCK desires to further authorize THE MAYOR to enter into a memorandum of agreement or other similar agreements with the Authority to create one or more development districts within THE BOROUGH OF NAUGATUCK to advance the purposes contained in Section 8-169jj. NOW THEREFORE BE IT RESOLVED THAT: Section 1. The BOARD OF MAYOR AND BURGESSES hereby approves the BOROUGH OF NAUGATUCK joining the Authority as a member municipality. Section 2. THE MAYOR is authorized to take or cause to be taken such actions, including, but not limited to, the negotiation and execution of any memorandum of agreement on behalf of the BOROUGH OF NAUGATUCK with the Authority and any other agreements, instruments and documents, that such official deems necessary, appropriate or desirable to implement the terms of any such memorandum of agreement and consummate the intention of this and the resolution. Mayor and Burgess Comments/Sub-Committee Reports Burgess Gallo reported that a Naugatuck manufacturing company was introduced to the high school principal for possible inclusion in the manufacturing program. She discussed the negative comments on social media regarding Naugatuck. She said we are moving forward in a good direction. Burgess Marenghi congratulated the boys and girls indoor track teams for winning the NVL Championships for the fourth year in a row. He met with Waterbury Alderman Kelly Zimmerman, the Waterbury Arts Collaborative and the Naugatuck Arts Commission. He said it was a good meeting. He spoke at the Fair Rent Commission about the housing construction happening in town. Burgess Rosenblatt said her brother is involved in a housing project in Illinois. They buy apartment buildings and rent to people of median income who can’t afford to buy a house. The people must rent the apartment for two years. Half of the monthly rent is saved and after two years they can use it toward a down payment on a house in the town they rented. Burgess Smith commented on the social media discussion. She said as burgesses they can openly show support for businesses in town by posting on social media. Congratulations to the track program. Burgess Neth-Kunin gave a list of upcoming events. February 27th is Dominican Mayor for the Day honoring Francis Santana at 10 a.m. March 12th is the Dibble Award honoring Larry Erickson at Aria. March 21st is PSC Trivia Night at St. Michael’s Church Hall. March 22nd is the Young Entrepreneurs at City Hill Middle School at 10 a.m. March 22nd the CT Partnership for Children is holding a prom at the Crystal Room. March 29th Naugatuck Outreach Partnership is holding a Pocketbook Bingo. April 25th Jane Doe No More is holding a Pocketbook Bingo. April 29th the Exchange Club is holding their Community Champions Banquet at the Crystal Room. Burgess Neth brought up the issue of data centers. Electricity costs are high. He asked if fuel cells are an option for a data center. He asked about the former Lewis Engineering property which is private property.  -9- Minutes – Board of Mayor and Burgesses – Regular Meeting – February 4, 2025 Deputy Mayor Vitale is sad people do not attend meetings to get good information. He would like to see boards/commissions start the ZOOM portion of the meetings five meetings earlier in case there is an issue signing on so people do not miss the beginning of the meeting. 24. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Mayor Hess to enter into a Right of First Refusal Agreement for a 3.5 acre parcel of land owned by the Borough of Naugatuck leased to Sunset Farms where they would have the opportunity to buy the parcel if the borough intends to sell it. There is no intention to sell the land. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses accept a Conveyance of Land from Morgan Development on a 2.33 acre piece of land off Bear Paw Road that is accepted in lieu of taxes. VOTED: Unanimously on a motion by Deputy Mayor Vitale and seconded by Burgess Rosenblatt that the Board of Mayor and Burgesses authorize Mayor Hess to enter into Two Land Lease Agreements with Tarpon Towers III LLC for 10,000 square feet of land for each parcel, one being off New Haven Road, the former Matty’s Paving site, and the other being borough owned property behind the police station near the new animal control center at the top of the hill, as discussed in executive session. 26.
