COMMISSION ON PUBLIC WORKS/UTILITIES COUNCIL ROOM JUNE 28, 2016 6:45 P.M. The Commission on Public Works/Utilities met in regular session, Chair Quicker presiding. On roll call: all members present. The minutes of the previous meeting were declared approved. Director of Public Works Flynn reported on two burials at the cemetery, equipment maintenance, picking up trash, mowing and weed whacking, cleaning pavilions, trimming and pruning trees, trimming around bridges, mowing residential lots, watering flowers, preparing ballfields, hauling brush and compost, cleaning storm sewers, crack sealing with the new tar kettle in the downtown parking areas, street line painting will begin soon, street sweeping, Grand Avenue final paving is complete and he will be on vacation July 5 to 13, 2016. Flynn thanked Cummins Filtration for holding their tire collection community service project (over 1,800 tires were collected). The City Clerk reported that the regular meeting of Tuesday, August 9, 2016, is also the Partisan Primary Election day. Discussion followed. The Pledge of Allegiance was recited. The minutes of the previous meetings were declared approved. Council Member Clough reported on the June 13, 2016 meeting of the Connect Communities Committee regarding: 1) discussion on logo designs, 2) selection of design #1, 3) discussed marketing signs, 4) discussed building inventory, 5) reviewed the annual report required by Wisconsin Economic Development Corporation (WEDC), 6) discussed WEDC yearly dues and recommended to pay the $200 dues and 7) discussed sponsoring training classes. Council Member Glassbrenner reported on the June 15, 2016 meeting of the Parks and Recreation Board regarding: 1) current activities of the Parks Department, 2) discussion on and recommendation to approve Boy Scout Joe Anason’s Eagle Scout Project to build a band shelter in Schuster Park to both the Planning Commission and Common Council and 3) discussion on and recommendation to approve creating a Dog Park by the old sewer plant on the end of W. Eighth Street to both the Planning Commission and Common Council. Council Member Neville reported on the June 16 and 23, 2016 meetings of the Heritage Days Committee regarding: 1) financial report, 2) discussed Miss Neillsville events and schedules, 3) discussed set-up, signs, banners and stage, 4) discussed the shirt order with JBC printing, 5) discussed General Beverage items, 6) discussed movie night, 7) discussed security, 8) discussed the parade, 9) discussed requesting Schuster Park hours to be extended to 1:00 a.m. on July 8 and 9, 2016; 10) financial report, 11) discussed Miss Neillsville, 12) discussed set-up, signs, banners, crafters and vendors, 13) discussed prizes for kid’s games and golf outing, 14) discussed golf carts, shuttle drivers and schedules, 15) discussed the parade, signage, pottery and Business After Five. Council Member Glassbrenner reported on the June 16, 2016 meeting of the Community Fire Hall Board regarding: 1) payment of bills, 2) building maintenance and lawn mowing and 3) approved the insurance renewal without terrorism coverage. Mayor Mabie reported on the June 22, 2016 meeting of the Planning Commission regarding: 1) discussion on the Boy Scout Joe Anason’s Eagle Scout Project to build a band shelter in Schuster Park-this has been reviewed and recommended by the Parks and Recreation Board, 2) approved and recommended on a split vote the construction of a band shelter in the Schuster Park 3) discussion on creation of a Dog Park by the old sewer plant on the end of W. Eighth Street-this has been reviewed and recommended by the Parks and Recreation Board and 4) approved and recommended the creation of a Dog Park on the end of W. Eighth Street. Council Member Counsell reported on the June 22, 2016 meeting of the Historic Preservation Commission regarding: 1) discussion on and approval of the Historic Architectural Tour Brochure with changes, 2) approved mailing the brochure to everyone included in the brochure and 3) discussed the Quality Plus Printing bill and approved paying up to $3,000 for 2,000 brochures. Mayor Mabie reported on the June 23, 2016 meeting of the Personnel Committee regarding: 1) discussion on and recommendation to increase the top pay rate for Other Part-time employees of the Cemetery and Parks Departments from $8. 63 to $10.00 per hour, 2) discussion on and recommendation to proceed with hiring a police officer and 3) a closed session regarding an employment accommodation request-adjourned in closed. Council Member Quicker reported on the June 28, 2016 meeting of the Commission on Public Works/Utilities regarding: 1) current activities, 2) rescheduled the regular Tuesday, August 9, 2016 meeting to Thursday, August 11, 2016 at 6:00 p.m. and 3) payment of bills. Mayor Mabie declared all reports filed as presented with the City Clerk. Mike Mahoney, 117 Oak Street, stated that he would like to take his ATV from his home two blocks from the trail, without having to load and trailer it to the trail on Grand Avenue. Mahoney presented a petition from his neighbors who had no problem with his request. Council Member Glassbrenner stated that WI State law does not allow ATV’s to be driven directly to a trail, but you can push it there. Chief of Police Klueckmann stated that the City cannot override state law, the City can open up more streets as trails, which would help with tourism. Discussion followed. Council Member Clough asked the Chief of Police to look into setting up as efficient grid trail system within the City, we do not want to open every road. Mayor Mabie asked if there were any questions on the Connect Communities Committee item (5). Motion Counsell, Second Neville, to accept the recommendation to pay the WEDC yearly dues in the amount of $200. All Aye. Director of Public Works Flynn stated the tentative location of the band shelter would be up by the tennis courts. Council Member Counsell expressed concern about having enough money on hand to complete the project. Motion Clough, Second Glassbrenner, to accept the recommendation to allow Boy Scout Joe Anason’s Eagle Scout Project to construct a band shelter in Schuster Park to proceed. All Aye. Motion Counsell, Second Quicker, to accept the recommendation to allow the creation of a Dog Park on the end of W. Eighth Street including fencing and fundraising for it. All Aye. Mayor Mabie asked if there were any questions on the Personnel Committee items (1 and 2). Mayor Mabie, on behalf of the Heritage Days Committee, requested extension of closing hours to be 1:00 a.m., and noise hours to 12:30 a.m. on Friday, July 8, 2016 and Saturday, July 9, 2016 in Schuster Park for the Heritage Days event. Motion Clough, Second Neville, to approve the request under Ordinance Section 7-8-4(a) and (c) for the Heritage Days Committee to extend the closing hours to 1:00 a.m. and the noise hours to 12:30 a.m. to allow the bands to play on Friday, July 8, 2016 and Saturday, July 9, 2016 in Schuster Park for the 2016 Heritage Days event. All Aye. The City Clerk presented the Wisconsin Department of Transportation Click-It or Ticket Equipment Grant funds in the amount of $4,000. Motion Counsell, Second Clough to accept and appropriate the $4,000 Click-It or Ticket Equipment Grant funds to Account No. 52100 Police Department Administration. All Aye. Mayor Mabie presented requests from Justin Black, Steven Stetzer and Theresa Grebinoski, 1209 Lloyd Street and Jon and Julie Counsell, 603 East Street for waivers under Ordinance Section 10-1-22 for raising chickens. Council Member Counsell excused herself from the discussion. Director of Public Works Flynn stated that he spoke with the residents at Lloyd Heights Manor, 1209 Lloyd Street back in 2015. The property is assessed as Agricultural in a Residential area, the previous owner had been allowed to have horses. They also have a letter signed by the Executive Director of Neillsville Retirement Community and multiple residents in support of retaining the animals for viewing. Director of Public Works Flynn stated that Jon and Julie Counsell, 603 East Street have requested to keep twelve chickens. They already have been allowed to have horses. City Attorney Wachsmuth read City Ordinance Section 10-1-22. Council Member Glassbrenner stated we could be opening a can of worms. Could we designate an acreage amount needed. City Attorney Wachsmuth stated a reason to grant a waiver would be, because they have substantial acreage. Council Member Glassbrenner asked if the ordinance needs to be changed. City Attorney Wachsmuth said you could change the ordinance, but then the case by case review basis would be lost. On a case by case basis, if there is a problem, it can be reviewed. Discussion continued. Motion Clough, Second Quicker, to grant permission for 1209 Lloyd Street to have non- commercial chickens, goats, ducks, pigeons, bunnies and horses, subject to review if complaints are received or excess numbers of animals occur, because of the large acreage and location of the property. Mayor Mabie presented the letter form Rick Summerfeld, Fire Prevention Coordinator, State of Wisconsin Department of Safety and Professional Service, regarding a substantial compliance audit for the 2% fire dues program. The Neillsville Fire Department is in substantial compliance with the State of Wisconsin SPS 314 Fire Prevention Code and the 2% fire dues program. The only concern was that the Fire Chief needs to be sworn into office. City Clerk Roehl reported that on June 17, 2016 the City was served a Notice of Circumstance on behalf of Debra Schoengarth regarding a fall on August 7, 2015 at 238 W. Fifth Street. This has been turned into the City insurance company. Temporary Amendment Request to “Class B” Retail Fermented Malt Beverages and Intoxicating Liquor License Applications: American Legion Post 73, Donald L. Harris, Agent, 6 Boon Boulevard – to add the east lawn to the license for the Heritage Days Mini-Rod Races event on July 8, 2016.
