MINUTES - FINAL OF THE NEW BRAUNFELS CITY COUNCIL - SPECIAL REGULAR MEETING OF MONDAY, DECEMBER 12, 2022 AGENDA CALL TO ORDER Mayor Pro-Tem Bowers called the meeting to order at 4:01 p.m. CALL OF ROLL: CITY SECRETARY Present 6 - Councilmember Andres Campos, Councilmember Christopher Willis, Mayor Pro Tem Harry Bowers, Councilmember Lawrence Spradley, Councilmember Jason Hurta, and Councilmember James Blakey Absent 1 - Mayor Rusty Brockman 1. WORKSHOP A) Presentation of the proposed FY 2023 Street Maintenance Plan. Mayor Pro-Tem Bowers read the aforementioned item. Greg Malatek presented this item providing a PowerPoint and answered questions from Council. B) Presentation and possible direction to staff to amend the existing golf cart and neighborhood electric vehicles ordinance to include off-highway vehicles. Mayor Pro-Tem Bowers read the aforementioned item. Greg Malatek presented this item providing a PowerPoint. Greg asked Chief Keith Lane to provide additional information. Greg and Chief Lane addressed questions from Council. The following individuals spoke at this time and addressed questions from Council: Casey McDonald and Kelly Lagedrost. Council agreed to address the safety issues first with this topic and bring this back to Council. Mr. McDonald and Mr. Lagedrost provided their vehicles for Council to observe and ask additional questions. Monday, December 12, 2022 New Braunfels City Council - Special Regular Meeting  Mayor Pro-Tem Bowers recessed at 5:16 p.m. to allow Council to go outside and view the vehicles. Mayor Pro-Tem Bowers reconvened at 5:32 p.m. 2. EXECUTIVE SESSION In accordance with the Open Meetings Act, Texas Government Code, Ch. 551, the City Council may convene in a closed session to discuss any of the items listed below. Any final action or vote on any executive session item will be taken in open session. A) Deliberate Issues Regarding Economic Development Negotiations in accordance with Section 551.087 of the Texas Government Code. 1. Texas State Technical College B) Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code, specifically: · Cause No. 2022-0386D, City of New Braunfels, Texas vs. IN REM 420 BUS 35 N, New Braunfels, Texas 78130; and JIMON INC. D/B/A River Ranch RV Park Resort C) Deliberate the appointment, evaluation, duties, discipline, or removal of the City Manager in accordance with Section 551.074 of the Texas Government Code. Mayor Pro-Tem read the aforementioned Executive Session items A. and B. only and recessed into Executive session at 5:32 p.m. 3. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE.
