Regular Council Meeting February 9, 2026 Page 1 of 5 Page 3 of 26 BUSINESS APPOINTMENT OF DISTRICT 5 ALDERPERSON Noah Wiedenfeld provided an overview of the steps taken by City staff following Ron Volkert’s resignation from the District 5 Alderperson position in January after 21 years of service. Staff published a Class 2 notice of the vacancy in the Star-Observer, posted the vacancy on the City of New Richmond website and Facebook page, and emailed current board and commission members to notify them of the opening. Eligibility requirements were also explained. Applications were submitted by two eligible residents, Craig Scott and Scott Grady. Both applicants attended the meeting, provided additional introductions, and answered questions from the Council. A ballot vote was conducted, and Scott Grady was selected by majority vote. Alderman Grady will serve as the District 5 Alderperson for the remainder of the current term, which runs through April 2028. BIDS - ASH TREE REMOVAL & STUMP GRINDING Noah Wiedenfeld reported on the recent bid opening for the removal of 68 ash trees located within the public right-of-way. The bids were opened on January 16, 2026, a total of nine bids were received. City staff and the Public Works Committee recommend moving forward with the low bid from SavATree in the amount of $43,100.00. There was discussion regarding the extreme range of bid amounts. Mike Montello made a motion to authorize staff to award the contract for the removal of 68 ash trees within the public right-of-way to SavATree as the lowest responsible bidder in the amount of $43,100.00. Greg Gartner seconded the motion. Carried unanimously. BIDS - CURED-IN-PLACE-PIPE LINING (CIPP) Noah Wiedenfeld reminded that at the January 12 meeting, the City Council authorized staff to solicit bids for Cured-in-Place Pipe (CIPP) lining for approximately 1,953 linear feet of sanitary sewer main. Following this approval, staff issued a Request for Proposals (RFP) for the project and one bid was received from Visu-Sewer. It was explained that they also completed the CIPP lining work for the City in the prior year and staff were satisfied with the quality of their work and overall performance. Mike Montello made a motion to approve the low bid from Visu- Sewer LLC in the amount of $86,181.25, for the Cured-in-Place Pipe (CIPP) lining project. Thomas Weinmeyer seconded the motion. Carried unanimously. AUTHORIZATION TO SOLICIT BIDS - LEAD SERVICE LINE REPLACEMENTS Noah Wiedenfeld reported that Ordinance No. 631 (October 2025) established the City’s Lead Service Line Replacement Program to comply with DNR requirements to replace all lead service lines by 2037. Staff have identified twelve properties requiring standalone lead service line replacement. The project is included in the 2026 CIP and covers public-side replacements; property owners are responsible for private-side replacements per ordinance. Regular Council Meeting February 9, 2026 Page 2 of 5 Page 4 of 26 At this time, staff are requesting authorization to solicit bids for the replacement of lead service lines at the twelve identified properties to ensure compliance with DNR requirements and the City’s adopted Lead Service Line Replacement Ordinance. Bids will be presented in March to the Utility Commission and City Council. Staff will coordinate with affected property owners upon approval. Greg Gartner made a motion to authorize City Staff to solicit bids for the replacement of lead service lines at the twelve identified properties. Mike Montello seconded the motion. Carried unanimously. AUTHORIZATION TO SOLICIT BIDS - PUBLIC WORKS SHOP LIGHTING PROJECT Noah Wiedenfeld explained that the City was awarded a Rural Energy Start-Up Program grant in fall 2025 through the Public Service Commission of Wisconsin Office of Energy Innovation. The grant will fund conversion of Public Works Shop lighting to LED and replacement of the lighting control system. No local match is required; however, any costs exceeding the $25,000 grant will be the responsibility of the City. Staff have reviewed the scope of the project and upgrade options and are preparing to proceed with the RFP process, which will be brought forward at a future meeting. Mike Montello made a motion to authorize City Staff to proceed with soliciting competitive proposals for the Public Works Shop lighting project. Thomas Weinmeyer seconded the motion. Carried unanimously. AUTHORIZATION TO SOLICIT BIDS: DOWNTOWN LIGHTING PROJECT Noah Wiedenfeld shared an overview on the design plans and cost estimates for the downtown lighting project, as staff were directed to create on October 29, 2025 by the City Council. A timeline was outlined including the general intention to bid the project out this winter to obtain better pricing before contractors' schedules fill up for the 2026 construction season. Funding sources were looked at briefly, but more funding information will come to the January Work Session. Mike Montello made a motion to authorize staff to go out for bid for the Downtown Lighting Project. Greg Gartner seconded the motion. Carried unanimously. AGENDA TOPICS FOR FUTURE MEETINGS Mayor Zajkowski requested that a project tracker be included at future meetings to outline the status of previously approved projects. It was also discussed that including a start date for future projects would help Council members respond to resident questions. Regular Council Meeting February 9, 2026 Page 3 of 5 Page 5 of 26 City Clerk Regular Council Meeting February 9, 2026 Page 4 of 5 Page 6 of 26 RESOLUTION #022601 FEDERAL RECREATIONAL TRAILS PROGRAM GRANT AUTHORIZING RESOLUTION WHEREAS, the City of New Richmond is interested in seeking federal funding for the maintenance of the City's existing trails system; and WHEREAS, rehabilitation and maintenance of existing trails and trailhead facilities, including but not limited to resurfacing trails, replacing culverts and bridges, mowing, grooming, grading trails, and new trail amenities are eligible Recreational Trails Program projects; and WHEREAS, the reconstruction of E 5th Street and W 2 nd Street are identified in the City of New Richmond's five-year capital improvement plan and are eligible for LRIP funding. THEREFORE, the New Richmond City Council resolves that the City of New Richmond has budgeted a sum sufficient to meet the local match requirement for purposes of the grant, and hereby authorizes the City Administrator or their designee to submit an application to the State of Wisconsin Department of Natural Resources for the Recreational Trails Program and any other financial aid that may be available, submit reimbursement claims along with necessary supporting documentation in accordance with the grant program requirements, submit signed documents, and take necessary action to undertake, direct, and complete the approved project. BE IT FURTHER RESOLVED that the City of New Richmond agrees to comply with the applicable laws, requirements, and regulations for the Recreational Trails Program; maintain the completed project in an attractive, inviting, and safe manner; keep facilities open to the general public during reasonable hours consistent with the type of facility; and obtain from the State of Wisconsin Department of Natural Resources or the National Park Service approval in writing before any changes are made in the use of the project site. Passed and approved: ·z_ { q ( �0 7.-� Page 5 of 5 Page 7 of 26 MEMO Prepared for: Mayor Zajkowski & City Council Staff Contact: Beth Thompson Meeting: Council Work Session - 23 Feb 2026 Subject: Contracts for Commercial Plumbing Services and Commercial Plumbing Inspections BACKGROUND INFORMATION: The City currently contracts with Brant Johnson for Plumbing Plan Review Services and Josh Melstrom for Plumbing Inspection Services. Both agreements were approved for a one-year term and are set to expire on March 1, 2026. Over the past year, both contractors have provided reliable, timely, and professional services. Staff has found their work to be thorough, responsive, and consistent with the City’s expectations and regulatory standards. The services have supported efficient permit processing and ensured compliance with applicable plumbing codes. Both contractors and City staff are interested in renewing these agreements for an additional one- year term, from March 1, 2026, through March 1, 2027, under the same terms and conditions. RECOMMENDATION: Staff recommends that the City Council approve renewal of the contracts with Brant Johnson and Josh Melstrom for the one-year period noted above. Continuation of these agreements will help maintain consistency in service delivery and ensure ongoing support for the City’s inspection and review functions. ATTACHMENTS: Brant Johnson Plumbing Contract 2026-2027 Josh Melstrom Inspections Plumbing Contract 2026-2027 Page 8 of 26 PLUMBING SUPERVISOR SERVICES AGREEMENT , THIS PLUMBING SUPERVISOR SERVICES AGREEMENT (“Agreement”) is entered into effective as of March 1, 2026 (“Effective Date”), by and between the CITY OF NEW RICHMOND (“City”) and BRANT JOHNSON (“Contractor”). RECITALS WHEREAS, the City is a Wisconsin third-class city; and WHEREAS, in accordancewith Wis. Stat. § 145.05(1), the City is required to retain the services of a licensed plumber to serve as its plumbing supervisor; and WHEREAS, Contractor is willing and quali?ed to provide the required services to and on behalf of the City, in accord with this Agreement. NOW, THEREFORE, THIS AGREEMENT WITNESSETH: AGREEMENT 1. Term of Agreement. This Agreement shall be for a term of one (1) year, from and after the Effective Date hereof, unless earlier terminated by the Contractor, upon thirty (30) days’ a d V a n c e d w r i t t e n notice to the City, upon the mutual agreement of the parties hereto, or upon the establishment of just cause by the City for its termination. 2. Responsibilities of Contractor. The Contractor shall be responsible for enforcing the Wisconsin Plumbing Code, as adopted pursuant to §15.08 of the City Code, for commercial plumbing projects, including new construction, additions, and alterations. The Contractor shall make himself available to perform any of the following services, as required, from time to time, by and on behalf of the City: a. Examination of plumbing plans and isometrics for commercial plumbing projects not subject to state plan review; b. Conducting ?eld inspections as required for commercial plumbing installations, including rough-in, follow- up, re—inspections,and ?nal inspections to determine conformity with the Wisconsin Plumbing Code; 0. Performance of ?eld inspections as needed for commercial sewer and water lateral installations in preparation of as—builtdrawings for building permit ?le and for submission to the New Richmond Municipal Utility; Page 2 of 13 Page 9 of 26 d. Maintenance of commercial plumbing inspection records in the building permit ?le, to be housed in the Community Development of?ce at City Hall, 156 E First Street, New Richmond, Wisconsin; e. Provision of assistance to the building inspectors and Fire Department in the enforcement of any plumbing code violations noted while performing rental housing inspections, ?re inspections and inspections upon complaint with respect to commercial property; f. Attending commercial subdivision and site plan meetings, on an as-needed basis; g. Such other or further duties as may be assigned from time to time by the Common Council. 3. Contractor Quali?cations.At all times during the term of this Agreement, the Contractor shall possess and retain a Master Plumber License under the laws and regulations of the State of Wisconsin. Should the Contractor voluntarily relinquish his Master Plumber License, or should his Master Plumber License be revoked or suspended, Contractor shall provide immediate notice of such fact to the City. In addition, Contractor represents that his employees and contractors have the ability to read, analyze and interpret general business periodicals, professional journals, teclmical procedures, ?nancial data, and engineering or governmental regulations pertaining to the subject matter of his responsibilities hereunder. In addition, the Contractor represents that his employees and contractors have the ability to write reports, business correspondence and procedure manuals, and has the further ability to present information effectively and to respond to questions from department heads, the Common Council, customers of the New Richmond Municipal Water Utility, and the general public. The Contractor further represents that its employees and contractors have the physical ability to occasionally lift and/or move up to 50 pounds at any one time. 4. Independent Contractor Status. For purposes of this Agreement, the Contractor shall be treated as an independent contractor and not as an employee of the City. Contractor shall not be entitled to any of the wages, salaries, fringe bene?ts or evaluations of employment with the City a n d t h e City shall, not deduct from payments made to the Contractor sums representing state and federal income tax withholding, FICA and Medicare deductions in accord with state and federal laws. Contractor shall be personally and individually responsible for the payment of all taxes associated with his compensation under this Agreement. Page 3 of 13 Page 10 of 26 5. Compensation for Services Rendered. a. Master Plumber License Maintenance Charge. As and for maintenance of his Master Plumber License in good standing with the State of Wisconsin at all times subject to this Agreement, Contractor shall be compensated in the amount of $2,000 annually, to be paid to the Contractor on or before the effective date of this Agreement with respect to the ?rst year hereof, and on the anniversary of such effective date for each year hereafter during the term hereof. b. Consultation Services. As and for consultations for purposes of ful?lling the responsibilities of the Contractor, the City shall pay to the Contractor the sum of $125 per hour. To make a claim for such payment, the Contractor shall submit, monthly, an invoice representing the number of hours served during the preceding month. Subject to review of each invoice as to appropriateness, the City agrees to make payment within 30 days of the receipt of each invoice. If the City disputes any portion of an invoice, it shall, on a timely basis, pay that portion of the invoice which it does not dispute and separately seek to resolve the disputed portion of the invoice. c. Contractor acknowledges that the compensation at a. and b. above constitutes full and complete compensation to him for all services rendered under this Agreement, and that he shall be solely responsible to defray any expenses including, but not limited to, mileage, long distance telephone charges, facsimile charges, and other expenses attendant upon and aiding and allowing him to provide the services required of him under this Agreement. 6. Miscellaneous Terms and Conditions. a. Governing Law. This Agreement shall be interpreted under the laws of the State of Wisconsin. b. Venue. Should any dispute arise under or concerning the terms and conditions of this Agreement, for dispute resolution purposes, venue shall be in the Circuit Court for St. Croix County, Wisconsin. c. Notices. For purposes of this Agreemen, “just cause” for termination shall take the form of one of the following: (1) Loss or voluntary surrender of Master Plumber’s License; (2) Failure of the Contractor to make himself available upon reasonable notice for consultations,on an as-needed basis, for the City; (3) Failure to perform any of the performance—relatedobligations of this Agreement in a workmanlike and professional manner, in accord with the standards reasonably accepted by and impressed upon Master Plumbers who are licensed by the State of Wisconsin. (4) Violation by the Contractor of 7.e., below. e. Agreement Personal to Contractor.It is the understanding of the City that the Contractor is employed by or otherwise associated with a corporation, namely Johnson Bros. Plumbing. This Agreement, nonetheless, is personal by and between the City and the Contractor; as such, the performance obligations imposed upon the Contractor shall be performed solely by the Contractor and not by any other employee or agent of Johnson Bros. Plumbing or its successors or assigns. The Contractor may not assign this Agreement to a third party. f. Insurance. The Contractor shall provide a current certi?cate of insurance naming the City as a party to receive prior notice if such policy is subject to cancellation for any reason, and showing minimum coverage in the type and amount as follows: Page 5 of 13 Page 12 of 26 (1) General Liability $1,000,000 — (2) Errors & Omissions $500,000 ~ (3) Automotive $500,000 — (4) Workers’ Compensation to the extent required under Wisconsin law. — g. Waiver. In the event any provision contained in this Agreement should be breached by either party and thereafter waived by either party, such waiver shall be limited to the particularbreach so waived and shall not be deemed to waive any other concuirent, previous or subsequent breach hereunder. h. Severabilig. In the event any provision of this Agreement is found to be unenforceable or void by a court of competent jurisdiction, the remaining provisions shall survive and continue in effect between the parties. i. Entire Agreement; Modi?cation. This Agreement constitutes the entire agreement between the parties concerning the subject matter covered in it. RECITALS WHEREAS, the City is a Wisconsin third-class city; and WHEREAS, in accordance with Wis. Stat. §145.05(1), the City is required to retain the services of a licensed plumber to serve as its Plumbing Supervisor; and WHEREAS, in accordance with SPS 305.625(1)b, the City may retain an individual who, under a Supervisor conducts plumbing inspections and shall be licensed as a commercial plumbing inspector; and WHEREAS, Contractor is willing and qualified to provide the required plumbing inspection services to and on behalf of the City, in accord with this Agreement. NOW, THEREFORE, THIS AGREEMENT WITNESSETH: AGREEMENT 1. Term of Agreement. This Agreement shall be for a term of one (1) year, from and after the Effective Date hereof. 2. Termination of the Agreement. Upon thirty (30) days’ written notice from either the City or the Contractor, the parties hereto agree this agreement may be terminated without cause, or upon the establishment of just cause by either party for its termination. 3. Responsibilities of Contractor. Commercial Plumbing Inspection Rates. Rates for the performance of commercial plumbing inspections shall be a per inspection charge. For the purposes of invoicing, in the case of a multi-family complex, schools, medical buildings, multi-unit tenant spaces, or similar issued under one permit, the rate shall be per apartment, room, section, or similar within the structure, referenced as a Unit. The charges include mileage, inspection time, drafting of reports, and any associated correspondence in regard to the inspection such as phone calls, emails, or similar. Rates shall be as follows: Commercial Plumbing Inspection Charge, $125 Multiple inspections under one permit or address: • $125.00 for the first Unit, Page 9 of 13 Page 16 of 26 • PLUS, an additional $40.00 per Unit for Units 2-15, • PLUS, an additional $20.00 per Unit for the balance of Units. b. Consultation Services. As and for consultations for purposes of fulfilling the responsibilities of the Contractor, the City shall pay to the Contractor the sum of $125 per hour. To make a claim for such payment, the Contractor shall submit, monthly, an invoice representing the number of hours served during the preceding month. Subject to review of each invoice as to appropriateness, the City agrees to make payment within 30 days of the receipt of each invoice. If the City disputes any portion of an invoice, it shall, on a timely basis, pay that portion of the invoice which it does not dispute and separately seek to resolve the disputed portion of the invoice. c. Notices required or deemed advisable under the terms of this Agreement shall be delivered by first class U.S. mail or in person, to the following representatives of the parties hereto: To the City: City of New Richmond Attn: City Administrator 156 E. First Street New Richmond, WI 54017 To the Contractor: Joshua Melstrom Melstrom Inspections, LLC P.O. Box 351 Glenwood City, WI 54013 e. Just Cause Defined. For purposes of this Agreement, “just cause” for termination shall take the form of one of the following: (1) Loss or voluntary surrender of Commercial Plumbing License; (2) Failure of the Contractor to make himself available upon reasonable notice for consultations, on an as-needed basis, for the City; (3) Failure to perform any of the performance-related obligations of this Agreement in a workmanlike and professional manner, in accord with the standards reasonably accepted by and impressed upon Commercial Plumbing Inspectors who are licensed by the State of Wisconsin. (4) Violation by the Contractor of 7.f., below. (5) Violation by the City of 7.g., below. f. Agreement Personal to Contractor. It is the understanding of the City that the Contractor is employed by or otherwise associated with a corporation, namely Melstrom Inspections, LLC. This Agreement, nonetheless, is personal by and between the City and the Contractor; as such, the performance obligations imposed upon the Contractor shall be performed solely by the Contractor. Plumbing or its successors or assigns. The Contractor may not assign this Agreement to a third party. g. Agreement of Retention of a Plumbing Supervisor. It is the understanding of the Contractor that the City shall retain a Plumbing Supervisor per Wis. Stat. § 145.05(1) to whom the Contractor shall have supervision per SPS 305.625(1)b. If circumstances arise where the City does not retain a Plumbing Supervisor, the City Page 11 of 13 Page 18 of 26 shall provide immediate notice to the Contractor of such fact. h. Indemnification. To the extent permitted by applicable law, the Contractor agrees to indemnify and hold harmless the City from and against any claims, suits, causes of action or expense, arising out of any act or omission of the Contractor, and causing injury to any person or persons or property, whomsoever and whatsoever, and all liability or loss arising in any way out of his performance of this Agreement. i. Insurance. The Contractor shall provide a current certificate of insurance naming the City as a Certificate Holder and additional insured to the insured party. The Certificate shall show the minimum coverage in the type and amount as follows: (1) General Liability - $1,000,000 (2) Errors & Omissions - $500,000 (3) Automotive - $500,000 (4) Workers’ Compensation – to the extent required under Wisconsin law. j. Waiver. In the event any provision contained in this Agreement should be breached by either party and thereafter waived by either party, such waiver shall be limited to the particular breach so waived and shall not be deemed to waive any other concurrent, previous or subsequent breach hereunder. k. Severability. In the event any provision of this Agreement is found to be unenforceable or void by a court of competent jurisdiction, the remaining provisions shall survive and continue in effect between the parties. l. Entire Agreement; Modification. This Agreement constitutes the entire agreement between the parties concerning the subject matter covered in it. On Monday, staff will lead a discussion regarding potential funding sources for this project. As previously noted, the estimated cost for the lighting project, including a ten percent contingency factor, is $834,726. Potential funding sources for the project include:  Unused borrowing from 2016 WPPI Note: $ 70,559  Carryforward capital project funds from 2020: $ 200,000  Insurance recoveries from 2017 hailstorm: $ 130,000  New debt through WPPI revolving loan: $476,617 Under the WPPI Energy revolving loan program, each member is eligible for up to $500,000 cummulatively in 0% interest loans. Projects involving property owned by the utility or municipality are eligible, provided the project results in energy efficiency improvements or renewable energy production. To determine eligibility, the utility or municipality must submit an application with WPPI; a 1% origination fee applies. RECOMMENDATION: Staff is seeking direction from Council regarding potential funding sources should the downtown street lighting project be approved. Page 21 of 26 MEMO Prepared for: Mayor Zajkowski & City Council Staff Contact: Noah Wiedenfeld Meeting: Council Work Session - 23 Feb 2026 Subject: Artisan Industry and Small-Scale Manufacturing BACKGROUND INFORMATION: In November of 2025, the City Council expressed support for the conceptual idea of updating the City's zoning ordinances to provide greater flexibility for small-scale/light manufacturing in the downtown as well as property located near the intersection of 140th Street and CTH K which is currently owned by Jerry Klasen. The aforementioned ordinance amendments require a public hearing before the Plan Commission, followed by approval from the City Council. At the February work session, staff will whighlight some of the proposed ordinance amendments which would allow for light manufacturing in the Z6 Central Business District, and create a new zoning district (Z8) which would allow for low-density residential development and light manufacturing. The work session is a good opportunity for the City Council to ask questions and provide feedback which staff can incorporate into the draft ordinances. The Board for the Freedom Park Center has expressed an interest in displaying signage on the structure. Outside of our sign ordinance and sign permit application, there is no policy in place at this time regarding signage in this location on City-owned property, so staff would like direction from the City Council as to how to proceed. A few key points or questions which the City Council might want to discuss at the work session include:  Who will install and remove the proposed sign?  Does the City Council want to know what the proposed sign would look like or say?  When would the sign be installed, and when would it be removed?  Is the City Council open to other organizations (e.g. soccer, football, etc.) displaying signage in this location?  What is the long-term plan for this structure? For example, does the City Council envision permanent signage for Freedom Park being displayed here?
