CITY OF NEWPORT, KY SPECIAL MEETING OF THE BOARD OF COMMISSIONERS Monday, March 11, 2019 MINUTES CALL TO ORDER / ROLL CALL FOR SPECIAL MEETING The special meeting was called to order by Mayor Peluso at 7:00 p.m. in the Multi-Purpose Room of the Newport Municipal Building at 998 Monmouth Street. In attendance were: Commissioner Beth Fennell, Commissioner Thomas Guidugli, Commissioner Ken Rechtin, Commissioner Frank Peluso, and Mayor Jerry Peluso. Also in attendance were: City Manager Thomas Fromme, City Attorney Daniel Braun, Police Chief Tom Collins, Fire Chief Bill Darin, Assistant to the City Manager Larisa Sims, Community Liaison Bev Holiday, and City Clerk Amy Able. NEW BUSINESS The city clerk gave first reading of an Ordinance, tentative O-2019-004. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY, PURSUANT TO THE PROVISIONS OF CHAPTER 153 OF THE CODE OF ORDINANCES, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF NEWPORT, KENTUCKY TO INCORPORATE A MAP AMENDMENT FOR CERTAIN PARCELS OF REAL ESTATE DESIGNATION AS BEING WITHIN THE I-1 ZONE TO THE R-3 ZONE Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Fennell. Mrs. Sims reviewed the recommendation of the Planning and Zoning Commission to allow the map amendment and responded to questions from the Board. Upon hearing all questions and comments, the mayor called for a roll call vote. Commissioner Peluso: Yes Commissioner Guidugli: Yes Mayor Peluso: Yes Commissioner Fennell: Yes Commissioner Rechtin: Yes Motion carried 5-0. The city clerk gave first reading of an Ordinance, tentative O-2019-005. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY, PURSUANT TO CHAPTER 153 OF THE CODE OF ORDINANCES, AMENDING SECTION 9.30 OF THE OFFICIAL ZONING ORDINANCE OF THE CITY OF NEWPORT, KENTUCKY CONCERNING CELLULAR ANTENNA AND SMALL CELL SYSTEM TOWERS. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Fennell. Mrs. Sims reviewed the recommendation of the Planning and Zoning Commission to approve the text amendments. Upon hearing all questions and comments, the mayor called for a roll call vote. Commissioner Guidugli: Yes Commissioner Rechtin: Yes Mayor Peluso: Yes Commissioner Fennell: Yes Commissioner Peluso: Yes Motion carried 5-0. The city clerk gave first reading of an Ordinance, tentative O-2019-006. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AMENDING SECTION 37.150 OF THE CODE OF ORDINANCES CONCERNING THE SCHEDULE OF FEES, CHARGES AND EXPENSES. Commissioner Fennell made a motion to approve; second to the motion was offered by Commissioner Guidugli. Mr. Braun stated with changes to the zoning code pending the fee schedule was reviewed and the updates include fees for cell towers. Upon hearing all questions and comments, the mayor called for a roll call vote. Commissioner Fennell: Yes Commissioner Rechtin: Yes Mayor Peluso: Yes Commissioner Guidugli: Yes Commissioner Peluso: Yes Motion carried 5-0. The city clerk gave first reading of an Ordinance, tentative O-2019-007. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AMENDING SECTION 7, 9.10, 18.2, 18.5, AND 18.8 OF THE OFFICIAL ZONING ORDINANCE OF THE CITY OF NEWPORT, KENTUCKY. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Guidugli. Mrs. Sims reviewed the proposed changes. There was discussion about the proposed change for elimination of the fee for appeals of a decision by the zoning administrator and administrative costs that may be incurred in such cases. Staff will research the history of appeals and provide the Board with additional information. ADJOURNMENT OF SPECIAL MEETING There being no further business, Commissioner Guidugli made a motion to adjourn the special meeting. Commissioner Fennell offered a second to the motion. PUBLIC FORUM AND COMMENTS Anyone wishing to discuss any City service issue not on the agenda was invited to do so. ADJOURNMENT OF CAUCUS MEETING There being no further business, Commissioner Peluso made a motion to adjourn the caucus meeting. Commissioner Fennell offered a second to the motion.
