City OF NEWPORT, KY REGULAR MEETING OF THE BOARD OF COMMISSIONERS Monday, March 25, 2019 MINUTES CALL TO ORDER / ROLL CALL The meeting was called to order by Mayor Peluso at 7:00 p.m. in the Multi-Purpose Room of the Newport Municipal Building at 998 Monmouth Street. The meeting was opened with a moment for silent invocation and the mayor led the Pledge of Allegiance. In attendance were: Commissioner Beth Fennell Commissioner Thomas Guidugli, Jr., Commissioner Frank Peluso, and Mayor Jerry Peluso. Absent: Commissioner Ken Rechtin. Also in attendance were: City Manager Thomas Fromme, Assistant City Manager Larisa Sims, City Attorney Daniel Braun, Police Chief Tom Collins, Fire Chief Bill Darin, Community Services Director Doug Roell, Community Liaison Bev Holiday, and City Clerk Amy Able. PERSONNEL ORDERS The city clerk read R-2019-015 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY, PROMOTING RYAN WHALEY AND ROBERT ALCOCK TO THE POSITION OF ENGINEER/MEDIC IN THE FIRE/EMS DEPARTMENT. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Fennell. The mayor called for a roll call vote. Chief Darin stated these promotions follow recent retirements and testing, the families were introduced, and insignia were pinned on by their wives. The city clerk read Tentative R-2019-016 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY, PROMOTING GABE MASCHINOT AND JOHN SHIELDS TO THE POSITION OF LIEUTENANT IN THE FIRE/EMS DEPARTMENT. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Fennell. The mayor called for a roll call vote. Chief Darin stated Shields has been with the department since 2007 and Maschinot since 2008. The families were introduced, and lieutenant bars were pinned on by Maschinot’s wife and Shields’ father. The city clerk read Tentative R-2019-017 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY, APPOINTING DONALD POWELL TO THE POSITION OF PATROL OFFICER, GRADE V, IN THE NEWPORT POLICE DEPARTMENT EFFECTIVE APRIL 15, 2019. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Guidugli. The mayor called for a roll call vote. Chief Collins thanked all the personnel in attendance for their show of support and extended thanks to the families of those in service. Officer Powell has eight years’ experience and previously served in the U.S. Army. The mayor called for a brief recess at 7:10. The meeting resumed at 7:20 with Commissioners Fennell, Guidugli, Peluso, and Mayor Peluso present and responding to roll call. PUBLIC FORUM Father Matt Young of St. Paul’s Episcopal announced 175th anniversary will be celebrated May 19, 2019 with masses at 8:30 and 10:30 followed by a reception. He stated the church considers itself partners in the community and continues efforts in job creation through their program with small businesses operating at the church and various ministries Ms. Tierney of David Court suggested that candidate election platforms be published on the city website. The City Attorney commented that such political use would not be appropriate. Mr. Fromme noted many candidates visit neighborhood groups and Commissioner Peluso advised of the Clifton Neighborhood meeting on the second Tuesday of each month at 7 p.m. at the fire department on Main Street. APPROVAL OF MINUTES Commissioner Peluso made a motion to approve the minutes of the Monday, February 25, 2019 regular meeting, and the Monday, March 11 caucus meeting. Commissioner Guidugli offered a second to the motion. Upon hearing there were no changes, corrections, comments or questions, the mayor called for a roll call vote. OLD BUSINESS The city clerk gave second reading of O-2019-005 AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY, PURSUANT TO CHAPTER 153 OF THE CODE OF ORDINANCES, AMENDING SECTION 9.30 OF THE OFFICIAL ZONING ORDINANCE OF THE CITY OF NEWPORT, KY CONCERNING CELLULAR ANTENNA AND SMALL CELL SYSTEM TOWERS. Commissioner Fennell made a motion to approve; second to the motion was offered by Commissioner Guidugli. Upon hearing there were no comments or questions, the mayor called for a roll call vote. NEW BUSINESS The city clerk read R-2019-018 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY APPROVING AND AUTHORIZING CITY MANAGER THOMAS J. FROMME TO EXECUTE A REAL ESTATE DEVELOPMENT AND PURCHASE AGREEMENT WITH HEALTHPOINT FAMILY CARE, INC. CONCERNING THE SALE OF THE REAL PROPERTY LOCATED AT 214, 216, AND 218 FORREST STREET AND 1029 AND 1039-1045 SARATOGA STREET IN THE CITY OF NEWPORT, KY. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Fennell. Mr. Fromme stated this relates to the sale of the old city stables located in the 200 block of East Eleventh Street. He explained that due to a changed closing date for the sale of related property, the second reading of tentative O-2019-004 has been delayed, but other items can be moved forward at this point. He continued this is the lot the City acquired at Eleventh and Saratoga along with the current city garage at Eleventh and Monmouth, and a vacant lot at Twelfth and Monmouth. This purchase is for $300,000. Commissioner Fennell stated she is not comfortable voting on the sale if it is not clear what is happening with the tabled ordinance. Ms. Sims stated language in the agreement for sale states if that falls through the sale will not go through. Upon hearing there were no further comments or questions, the mayor called for a roll call vote. Mr. Braun stated there was a recent change to the agreement to add 218 Forrest which had not been included in the title of the draft order. He asked for a secondary motion to include this. Commissioner Peluso stated he would amend his motion. Commissioner Guidugli offered a second. The mayor asked for a roll call vote. The city clerk read R-2019-019 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY GRANTING PROPERTY ASSESSMENT MORATORIA TO NEWPORT MILLENNIUM HOUSING CORPORATION III RELATING TO THE RESTORATION OF PROPERTIES AT 934 COLUMBIA ST., 910 COLUMBIA ST., 712 COLUMBIA ST., 224 WEST TENTH ST., 940 PATTERSON ST., AND 210 E. 8TH ST. IN NEWPORT, KY. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Guidugli. Mr. Fromme reviewed the moratorium program. Tom Guidugli, Sr., Executive Director of Newport Millennium Housing, explained the “CHDO” is a Community Housing Development Organization and through the Home Consortium of the River Cities, funds must be set aside for development and each year an application for funding is made. Mayor Peluso commented about the great rehabilitation work that has been done preserving properties in this area. The city clerk read R-2019-020 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY GRANTING PROPERTY ASSESSMENT MORATORIA TO ENTRYWAY INC., CAMPBELL COUNTY CHDO, RELATING TO THE RESTORATION OF PROPERTIES AT 71 PARKVIEW AVENUE AND 715 SARATOGA STREET IN NEWPORT, KY. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Fennell. Upon hearing there were no comments or questions, the mayor called for a roll call vote. The city clerk read R-2019-021 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY AUTHORIZING AND DIRECTING CITY MANAGER THOMAS J. FROMME TO EXECUTE A CONTRACT WITH ROSSMAN ENTERPRISES INC., DBA CLEAN AIR CONCEPTS FOR A VEHICLE EXHAUST SYSTEM. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Guidugli. Chief Darin addressed the Board explaining this is a safety issue and has been in practice for twenty years; some older apparatus had individual equipment but that is outdated technology; the Main Street firehouse already has a (basically homemade) system. Upon hearing there were no comments or questions, the mayor called for a roll call vote. The city clerk read R-2019-022 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KY AUTHORIZING AND DIRECTING CITY MANAGER THOMAS J. FROMME TO EXECUTE A CONTRACT WITH PROFESSIONAL LAWN CARE, INC. FOR GRASS CUTTING AND MAINTENANCE. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Fennell. Mr. Roell addressed the Board explaining this includes various areas such as the ball fields, Pavilion Pkwy., Tenth Street, Grand Avenue, and Route 9. Professional Lawn Care was $26 under the next lowest bidder, they have worked with the City before, have the necessary equipment, and are located in Newport. Upon hearing there were no comments or questions, the mayor called for a roll call vote. COMMENTS FROM CITY MANAGER There are lots of exciting developments underway, details will continue to be announced. COMMENTS FROM THE BOARD Commissioner Fennell: • Thanked Newport employees for consistently going out of their way to assist in problem solving rather than deflecting with reactions or attitudes of “not my job/ not our department.” A recent example involved Doug Roell and Ray Ebert working with the County and others to get an area of highway right-of-way cleaned up following a recent complaint.
