BACKGROUND: The O3 Office/Research and Development district applies to
the Jefferson Center for Research and Technology and the
surrounding area proposed for the Tech Center at Oyster Point
office park.
The amendment establishes parking requirements for
development in the O3 Office/Research and Development
district through an approved master plan that governs physical
development in the district.
On December 6, 2017, the City Planning Commission voted
unanimously 8:0 to recommend adoption of the zoning text
amendment.

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Newport News,
Virginia:
That Chapter 45, Zoning Ordinance, of the Code of the City of Newport News, Virginia,
Article XIX., O3 Office/Research and Development District Regulations, Section 45-1904, Off-
street parking and loading regulations; Section 45-1908, Master development plan required; and
Article XXX, Off-Street Parking and Loading Regulations, Section 45-3004, Parking requirements
for specific uses, be, and the same hereby is, amended and reordained as follows:
CHAPTER 45
ZONING ORDINANCE
ARTICLE XIX. O3 OFFICE/RESEARCH
AND DEVELOPMENT DISTRICT REGULATIONS
Sec. 45-1904. Off-street parking and loading regulations.
Parking spaces shall be as required by Article XXXthe approved Master Plan.
Sec. 45-1908. Master development plan required.
A master development plan shall be required for the creation of an office/research and
development park. Upon recommendations by the city planning commission, and approval by the
city council, the master development plan shall govern the physical development of the office park,
including: land use; the location of streets; building setbacks and lot coverage; parking; amenities
such as landscaping, plantings, water features, pedestrian ways and trails; improvements such as
water, sewerage and drainage; provisions such as signage and lighting; and, the orientation of main
structures, building materials, and architecture.
ARTICLE XXX. OFF-STREET PARKING AND LOADING REGULATIONS
Sec. 45-3004. Parking requirements for specific uses.
(a) Parking requirements for specific uses shall be computed in accordance with the
provisions of this section. Unless otherwise specifically set forth, the requirements shall be
minimum requirements and may be exceeded at the discretion of the premises owner or developer.
(b) Dwelling and related living facilities uses.
(1) Single-family dwelling: One parking space for each dwelling unit.
(2) Two-family or multiple-family attached dwellings: One and one-half (11/2) parking
spaces for each dwelling unit.
(3) Manufactured homes: One and one-half (11/2) off-street parking spaces shall be
provided on or adjacent to each manufactured home site.
(4) Bed and breakfast or halfway house: One parking space for each sleeping room.
(5) Dormitory or fraternity/sorority house: One parking space for every three (3)
sleeping rooms or for every six (6) members, whichever is greater.
(6) Hotel or motel: One parking space for each guest room or suite.
(7) Tourist home: One parking space for each guest room or suite.
(8) Homeless shelter: One parking space for each room.
(9) Multiple-family housing for handicapped persons or the elderly: One parking space
for each dwelling unit that is permanently allocated for occupancy by handicapped
persons or by elderly persons at least sixty (60) years of age. Parking space for
dwelling units allocated for individuals with physical handicaps shall be thirteen
(13) feet wide with an unobstructed, near level, paved surface that is suitable for
wheeling and walking.
(10) Congregate housing for children: One parking space per employee attending a
shift.
(c) Community facilities and places of assembly.

(1) Hospitals, sanitariums, asylums, nursing homes, convalescent houses, homes for
the aged, and similar institutions: One parking space for each four (4) beds.
(2) Church or place of worship: One parking space for each four (4) seats in the main
sanctuary or auditorium, in addition to three (3) spaces for each classroom used for
Sunday school or educational purposes.
(3) Elementary school: One parking space for each four (4) seats in the auditorium or
main assembly room.
(4) High school, secondary school: One parking space for each four (4) seats in the
auditorium plus two (2) spaces for each classroom or laboratory room.
(5) College: One parking space for every three (3) accommodations for students in
classrooms, laboratories, etc.
(6) Library or museum: One parking space for every three hundred (300) square feet
of floor area, but not less than ten (10) spaces.
(7) Country club, golf club, yacht club, or swimming pool club: One parking space for
each five (5) adult members or one parking space for each four (4) seats in a place
of assembly, whichever is greater.
(8) Stadium, sports arena, community center, or other similar places of assembly: One
parking space for every four (4) seats, or if fixed seats are not included, then one
space for each fifty (50) square feet of floor space.
(9) Theatre or auditorium: One parking space for each four (4) seats or seating spaces.
(10) Bingo hall: One parking space for every forty (40) square feet of floor area.
(11) Fraternal lodges or veteran organizations or service clubs: One parking space for
each four (4) seats or one parking space for every fifty (50) square feet of floor area.
(12) For mobile home park administrative buildings: Not less than one parking space
for every fifteen (15) manufactured home sites within the park shall be provided at
the administrative building.
(13) For mobile home park swimming pools, community buildings or recreational
areas: Not less then one space for every fifteen (15) manufactured home sites
within the park shall be located at any swimming pool, community building or
recreational area serving the development.

(14) Multiple-family mobile home park accessory or maintenance buildings: For
accessory or maintenance buildings, one space for each vehicle used in connection
with the maintenance of the mobile home park or multiple-family development
shall be provided.
(15) Marinas: Not less than one parking space for every two (2) boat slips.
(16) Miniature golf course: One and one-half (11/2) parking spaces for each hole.
(d) Commercial and related uses.
(1) Medical or dental clinic: Two (2) parking spaces for each room, chair or other
facility in which patients are examined or treated by a physician.
(2) Business or professional office, bank or studio: One parking space for every three
hundred (300) square feet of floor area, but not less than three (3) parking spaces
for each use.
(3) Retail store or personal service establishment: Unless otherwise listed below, a
minimum of one parking space for every two hundred fifty (250) square feet of
floor area and a maximum of one parking space for every two hundred (200) square
feet of floor area.
(4) Restaurant, cafeteria, or other eating or drinking establishment: One parking space
for every one hundred (100) square feet of total floor area, including kitchen area.
(5) Furniture or appliance store, wholesale establishment or service shop: No more
than one parking space for every five hundred (500) square feet of floor area.
(6) Commercial recreation center: One parking space for every fifty (50) square feet
of floor space; provided however, that fifty (50) percent of all space used for
bowling alleys, indoor racquetball courts, indoor tennis courts, skating rinks, indoor
tracks or similar indoor recreation facilities may be deducted in computing this
parking requirement.
(7) Funeral home or mortuary: One parking space for each fifty (50) square feet of
floor area used for chapels, reposing rooms or other public or semi-public uses
incidental to funeral services, plus one space for each vehicle maintained on the
premises and one space for any dwelling use on the same premises.
(8) Enclosed mall building: No more than one parking space for every two hundred
fifty (250) square feet of gross leasable area.

(9) Child care center: One parking space per employee in addition to on-site
circulation space for delivering children.
(10) Coin-operated commercial laundry: One space per three pieces of washing/drying
equipment for rent.
(11) Medical and dental laboratory: One space per employee.
(12) Office and two-family residential within one building: One and one-half spaces per
residential unit plus one space per 100 square feet of utilized office.
(13) Banquet/function hall. One parking space per 100 square feet of total floor area.
(e) Industrial, wholesale and similar uses. One parking space for each five (5) persons
employed on a maximum shift, plus one space for every vehicle maintained on the premises, but
not less than one parking space for every five hundred (500) square feet of occupied floor area.
(1) Mini-storage warehouse: Three spaces per one thousand (1,000) square feet of
office space plus one space per employee.
(2) Propane storage and distribution: One space per two thousand (2,000) square feet
of service area.
(3) Shooting range: One space per firing position.
(4) Animal shelter: One parking space for each one thousand (1,000) square feet of
floor area.
(f) Neighborhood Conservation District. Off-street parking is not required for
commercially zoned property within the Neighborhood Conservation District
(g) Parking spaces for the disabled shall not be shared or provided off-site.
(h) Proposed changes in use for a premises subject to an approved on-premises shared
parking plan or off-site parking plan shall require proof that adequate parking continues to be
available.
(i) O3 Office/Research Development District. Off-street parking shall be established
by the approved Master Plan as required in Section 45-1908.

ACTION: A REQUEST TO APPROVE A RESOLUTION
AUTHORIZING THE CITY MANAGER TO EXECUTE A
MEMBER AGREEMENT FOR VIRGINIA ASSOCIATION OF
COUNTIES GROUP SELF INSURANCE RISK POOL
(VACoRP), BY AND BETWEEN THE CITY OF NEWPORT
NEWS,VIRGINIA, AND ALL THE PARTIES WHO ARE
NOW, OR MAY HEREAFTER BECOME MEMBERS, OF
VACoRP.
BACKGROUND: VACoRP is an association of political subdivisions that have
agreed to provide for joint and cooperative action to self-
insure and pool their separate risks and liabilities as
authorized by the Code of Virginia.
The City recently went to market for its General Liability
policy and found VACoRPs proposal to be the most
advantageous to the City.
In order for the City to participate in VACoRP, a membership
agreement is required.
The City Manager recommends approval.

BACKGROUND: Harbour-Newport News Limited Partnership desires to
acquire and renovate an existing apartment complex consisting
of 200 units known as Newport Harbor Apartments located at
2301 Madison Avenue.
In order to assist with the financing of the project, Harbour-
Newport News Limited Partnership sought the NNRHA's
issuance of Multi-Family Housing Revenue Bonds in an
amount not to exceed $18 million.
NNRHA approved a resolution at its December 19, 2017
Board meeting for issuance of the bonds for the benefit of
Harbour-Newport News Limited Partnership and the Newport
Harbour Apartments Project and held the required public
hearing.
NNRHA recommends that City Council approve the issuance
of the NNRHA bonds as required by the statute and the
Internal Revenue Code.
The City Manager recommends approval.

A RESOLUTION APPROVING THE ISSUANCE BY THE NEWPORT NEWS
REDEVELOPMENT AND HOUSING AUTHORITY OF ITS MULTIFAMILY HOUSING
REVENUE BONDS FOR THE ACQUISITION, CONSTRUCTION, RENOVATION,
REHABILITATION AND EQUIPPING OF THE NEWPORT HARBOUR APARTMENTS
MULTIFAMILY HOUSING FACILITY LOCATED IN THE CITY OF NEWPORT NEWS,
VIRGINIA.
WHEREAS, the Newport News Redevelopment and Housing Authority (the
“Authority”) is authorized to advertise and hold public hearings relative to the issuance of
private activity bonds; and
WHEREAS, the Authority has considered the application of Harbour-Newport News
Limited Partnership, a Virginia limited partnership (the “Borrower”), requesting that the
Authority issue up to $18,000,000 of its revenue bonds (the “Bonds”) to assist the Borrower in
financing or refinancing (1) a portion of the cost of acquiring, constructing, renovating,
rehabilitating and equipping a multifamily residential rental housing project consisting of 31
two-story buildings containing approximately 200 units, a one-story common laundry building
and a one-story community and leasing office building, to be known as Newport Harbour
Apartments, located at 2300-2382 Madison Avenue in the City of Newport News, Virginia (the
“Project”) and (2) the costs of issuance incurred in connection with the issuance of the Bonds
(collectively (1) and (2), the “Plan of Finance”) and has held a public hearing in connection
therewith on December 19, 2017 (the “Public Hearing”); and
WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the
“Code”), provides that the applicable elected representatives of the governmental unit having
jurisdiction over the issuer of private activity bonds and over the area in which any facility
financed with the proceeds of private activity bonds is located must approve the issuance of
such bonds; and
WHEREAS, the Authority issues its bonds on behalf of the City of Newport News,
Virginia (the “City”) and the Project is located in the City; and
WHEREAS, the Authority, as the issuing governmental unit with respect to the Bonds,
has no applicable elected representative, the City constitutes the next highest governmental unit
with such a representative, and the members of the City Council of the City (the “Council”)
constitute the applicable elected representatives of the City; and
WHEREAS, the Authority has recommended that the Council approve the issuance of
the Bonds; and
WHEREAS, a copy of the Authority’s resolution authorizing the issuance of the Bonds,
a certificate of the Public Hearing, a summary of the statements expressed at the Public
Hearing and the fiscal impact statement concerning the Plan of Finance have been filed with
the Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF NEWPORT NEWS, VIRGINIA:
1. The Council approves the issuance of the Bonds by the Authority for the
benefit of the Borrower, as required by Section 147(f) of the Code, Section l5.2-4906, as
applicable to housing authorities, of the Code of Virginia of 1950, as amended (the “Virginia
Code”) and Section 36-19(9) of the Virginia Code to permit the Authority to assist in the
financing or refinancing of the Plan of Finance.
2. The approval of the issuance of the Bonds does not constitute an endorsement
to a prospective purchaser of the Bonds of the creditworthiness of the Project, the Plan of
Finance, or the Borrower.
3. The Bonds shall provide that neither the City nor the Authority shall be
obligated to pay the Bonds or the interest thereon or other costs incident thereto except from
the revenues and monies pledged thereto and that neither the faith and credit nor the taxing
power of the City or the Authority is pledged to the payment of the principal of the Bonds or
the interest thereon or other costs incident thereto.
4. In adopting this resolution, the City, including its elected representatives,
officers, employees and agents, shall not be liable for, and hereby disclaim all liability for, any
damages to any person, direct or consequential, resulting from the Authority’s failure to issue
the Bonds for any reason.
5. This resolution shall be in effect on and after the date of its adoption, January
9, 2018.

BACKGROUND: The Office of the Commonwealth’s Attorney current
appropriation request is for the Lexis Advance software
subscription to VA Enhanced w/Full Federal and Practice
Library for 29 users (Attorneys).
Asset forfeiture funds are transferred to the Office of the
Commonwealth’s Attorney as a result of officers participating
in state and federal criminal cases where the defendant’s
assets are seized.
The current unappropriated asset forfeiture balance is
approximately $25,930.
FISCAL IMPACT: Will allow the use of $12,600 from asset forfeiture by the
Office of the Commonwealth’s Attorney.

SUBJECT: Appropriation from Asset Forfeiture Fund – Commonwealth’s Attorney
The Office of the Commonwealth’s Attorney is requesting the
appropriation of $12,600 from the Asset Forfeiture fund. The funds will be
used for the Lexis Advance software subscription that will support 29
Attorney users. The funds will cover a three year subscription.
Asset Forfeiture funds are transferred from the Virginia Department of
Criminal Justice to the Commonwealth’s Attorney as a result of police
officers participating in state and federal criminal cases where the
defendant’s assets are seized. The current Asset Forfeiture fund balance is
approximately $47,998.49.
No other local funds are required for this action. Approval of this resolution
is recommended.
