CITY OF NORTH MYRTLE BEACH 1018 Second Avenue South BOARD OF ZONING APPEALS February 08, 2018 MINUTES Dan Moore Linda Braswell Robert Terrell-Absent Cynthia Lover William McGonigal Zoning Administrator Paul Blust Assistant Zoning Administrator Ben Caldwell Secretary Merideth Smith City Attorney Chris Noury CALL TO ORDER AND INVOCATION: The Chairman Called the Meeting to order MINUTES – The motion to approve the minutes of the January 11, 2018 meeting was made by Ms. Braswell and seconded by Ms. Lover. Motion passed 4-0. COMMUNICATIONS None The secretary swore in those on the agenda. NEW BUSINESS: B. VARIANCE #V04-18: Ocean Towers HOA has made application for a variance of 15 feet from the required 15 foot side yard setback for a proposed staircase on the side of an existing parking structure for a multifamily project in the R-4 (Resort Residential) district at 4312 South Ocean Boulevard. Mr. Robert Windish representing the HOA presented the request. STAFF REPORT: Mr. Caldwell reported for the staff. MOTION: There were no questions and the Chairman called for a motion. Mr. McGonigal made the motion to approve the variance based of a safety issue created by a non-conforming structure. Ms. Braswell seconded the motion. The motion passed 4-0. C. VARIANCE #V05-18: Mr. Ron Wallace has made application for a variance of 5 feet from the required 10 foot side yard setback for a proposed garage addition in the R-1(Low density Single Family Residential) district at 1205 Hillside Drive South. Mr. Wallace presented his request. STAFF REPORT: Mr. Caldwell reported for the staff. The Board discussed the issue. The Chairman called for a motion. MOTION: The motion to deny the variance because no hardship has been shown was made by Ms. Braswell and seconded by Ms. Lover. The motion to deny passed 4-0. D. VARIANCE #V06-18: Mr. Alan Berryman has made application for a variance of 10 feet of the required 25 foot front yard setback for a proposed covered porch in the NC (Neighborhood Commercial) district at 700 17th Ave South. Mr. Berryman presented his request for a porch addition to the front of the house. STAFF REPORT: Mr. Caldwell presented the report for the staff. The Board discussed the issue. Mr. Moore called for a motion. MOTION: The motion to deny the variance request was made by Ms. Lover stating that no hardship has been proved and that the structure was built to the max setbacks. Seconded by Ms. Braswell. Motion passed 4-0. E. SPECIAL EXCEPTION # SE 2-18: Coastal Sunset Properties has made application for special exception for the expansion of a boat storage dry stack facility in the HC (Highway Commercial) district at 4430 Kingsport Road Mr. Kyle Davis and Mr. Tim Harris were in attendance to present the request. STAFF REPORT: Mr. Caldwell reported for the staff. Public comment: Mr. Carey McLeod stated that the residents of the adjoining condos were not concerned about the upgrade of the facility but were concerned about the storage building on the waterway blocking the view of the waterway and that this would diminish the property values. Mr. Craig Newton also stated his concern with the building and asked for denial.. The Chairman called for a motion. MOTION: The motion to grant the special exception because the request does meet the criteria set forth in sec. 23-26(4) D of code with the condition that a 30 foot setback and that the building be done before the houses in the residential zoned area be constructed was made by Mr. McGonigal and seconded by Ms. Braswell. The motion passed 4-0. 2 F. VARIANCE #07-18: Coastal Sunset Properties has made application for a variance of 19 feet of the required 20-foot rear yard setback (ICW side) for a proposed boat storage rack in the HC (Highway Commercial) district at 4430 Kingsport Road. STAFF REPORT: Mr. Caldwell reported for the staff. MOTION: The motion to deny the variance was made by Ms. Lover stated that no hardship was proved. Motion was seconded by Mr. McGonigal.
