Dev. Specialist Mikayla Schmidt, Randy Ernst, two others from Aurora Pharmaceutical, Marie Gebler, and another citizen. Present: 4 - Joe Gasior, Tracy Heisler, Kate Stuart and Betsey Buckheit Absent: 3- William Schroeer, Jay Jasnoch and Aaron Swoboda I. Call to Order and Approval of Agenda Chair Gasior called the meeting to order at 7:04pm. A motion was made by Buckheit, seconded by Heisler, to approve the agenda as amended to remove item II. Approval of Minutes and item V. Reports and Discussion. The motion carried by the following vote: Yes: 4- Chair Gasior, Heisler, Stuart and Buckheit III. Unfinished Business IV. New Business Items 1. ZBA Res. Variance Resolution - 620 South Nevada Street 2018-003 Attachments: ZBA Resolution 2018-003 - 620 Nevada Aerial contours Nevada view 7th street view Chair Gasior read the proceedings of the meeting and then opened the public hearing at 7:09pm. Tempel spoke on the variance requests for 620 Nevada St. S. Chair Gasior invited the applicant to speak and the ZBA members to ask questions. Heisler asked when the fence and shed were constructed. Marie Gebler - 620 Nevada St. S. - stated the fence and shed were built last summer, she described the topography of the lot and where the fence would have been if the yard didn't slope off so abrubtly from the street. City of Northfield Page 1 Printed on 8/24/2018 Zoning Board of Appeals Meeting Minutes - Final July 19, 2018 Buckheit stated she realizes the cost and agony of this, but with the height and location of the fence and shed in the public right of way (ROW), she struggled to find a way to approve the variance. Heisler stated she can't find to see how it meets the criteria. She noted the ROW and height issues as well. Stuart asked for clarification that the variance goes with the fence and not the property. Tempel stated it would follow the fence. Due to this, Stuart felt comfortable with the variance request. Chair Gasior stated with the ROW issue he also has difficulty approving the variance. A motion was made by Heisler, seconded by Buckheit, to close the public hearing at 7:23pm. The motion carried by the following vote: Yes: 4- Chair Gasior, Heisler, Stuart and Buckheit A motion was made by Buckheit, seconded by Heisler, to deny ZBA Resolution 2018-003 allowing the fence and shed to encroach the right-of-way and all the fence to be six feet tall in the corner sideyard. The motion carried by the following vote: Yes: 3- Chair Gasior, Heisler and Buckheit No: 1- Stuart VI. Adjournment A motion was made by Buckheit, seconded by Stuart, to adjourn the meeting at 7:30pm.
