MINUTES OF THE DECEMBER 18, 2019 REGULAR MEETING OF
THE ARCHITECTURAL REVIEW BOARD (ARB)

Call to Order: 7:02 pm
Present: Chairperson McManus, Members: Robertson, Rothschild, and Holley; Donald
Yacopino, Chief Building Inspector. Absent: Member Watanabe
Application(s) Taken In Order Of Agenda:
(1) Application: 108 Main Street, Application for a parallel sign on Main Street facade.
Building Inspector Review: Proposal complies with zoning requirements.
Board Review Based Upon: The application, Building Inspector Review, Testimony of
representative, Paul, ARB members’ site visit/knowledge of site, consideration of public comment,
if any.
Board Findings:
Public Comment: no public presented.
Motion by Chair McManus to approve the application as presented noting that solid black
awning is to replace existing steaks, chops etc. Member Holley seconded. Approved by vote 4-
0.
(2) Application: 55 Route 59. Application to replace existing Drive-Thru menu boards and
install one new pre-browse menu board and move the existing pre-browse sign to a different
location.
Building Inspector Review: Variances issued for all signage on McDonald’s site on July 30,
2012.
No applicant nor representative came and application was tabled.
(3) Application: 3 Waldron Avenue. Application for signage and exterior alterations in
conjunction with an application to convert single family residence to a delicatessen.
Building Inspector Review: Monument sign and sign on awning valence comply with village
sign ordinance. Size of parallel sign on north building facade complies with village sign ordinance
but area variance is required for a sign not on front facade of building. Interior illumination of
sign permitted in this zoning district. Proposed alterations include the addition of handicap
accessible ramp at front entrance, reconstruction of existing retaining walls, replacement of
windows and siding in kind. Change of use of this building is necessitated.
Board Review Based Upon: The application, Building Inspector Review, Testimony of
applicant/representative, Christiana Scortea, Architect and Daniel Barahona, Property
Owner, ARB members’ site visit/knowledge of site, consideration of public comment, if any.
Board Findings:
Public Comment: no public presented.
Motion by Chair McManus to hold application open and for applicant to return at next
ARB meeting to be held on January 15, 2020 in which applicant is to provide more detail and bring in
materials.
(4) Application: 16 Depew Avenue. Application to demolish garage facing Piermont
Avenue.
Building Inspector Review: Proposal complies with zoning requirements.
Board Review Based Upon: The application, Building Inspector Review, Testimony of
applicant/representative, Kim Feder, co-owner of property with Ira Spiegel, ARB members’ site
visit/knowledge of site, consideration of public comment, if any.
Board Findings:
Public Comment: no public presented.
Motion by Chair McManus to refer application to Planning Board and noting that
property owner indicates that following demolition, backyard is to be restored. Member
Holley seconded and approved by vote 4-0.
(5) Application: 249-259 Diana Place. Application to demolish existing buildings
and construct a 26 Dwelling Unit multifamily building.
Building Inspector Review: Applicant appeared before the ZBA on 6/24/19. Area variances
granted on July 29, 2019. Development will require Subdivision for merger of lots and a Special
Permit for the Subdivision, applications for which have not yet been submitted.
Board Review Based Upon: The application, Building Inspector Review, Testimony of
applicant/representative, Robert Silarski, Architect on behalf of Joseph Maraja. Eddie Mistrata
also spoke on behalf of project following public comment, ARB members’ site visit/knowledge of
site, consideration of public comment, if any.
Board Findings:
Public Comment: 2 members of the public presented on behalf of themselves and
owners of property on Depew Avenue, Peggy Brady-Anoon and Joseph Brady-
Amoon. Both expressed concerns with the Rooftop Garden in relation to creating a
nuisance of light and noise and negative effects on the neighborhood. Mr. Brady-Anoon
suggested that rooftop could be covered to limit noise and/or plantings should be
added. He also expressed concern over the added vehicles and traffic and pollution in
relation to this project. Mr. Mistrata spoke in relation to the resistance the project has
received and his efforts to accommodate the neighbors on Depew Avenue.
Motion by Member Rothschild to close public comment, seconded by Member
Holley. Member Robertson motioned to approve the application as presented with two
requests by the ARB: to submit a rendering of the roll down door in black as well as the
truncated area with dark grey siding with the light grey windows and grills. Member
Holley seconded and vote by 4-0 to approve this motion. Applicant to submit the requested
information to be circulated and voted upon by two ARB members.
