December 12, 2019
A regular meeting of the Board of Water Commissioners was held on the
above date at 9 North Broadway, Nyack, NY. The meeting was called to order by
Chairman Dailey at 4:30 PM.
The following were present:
Ross Dailey Chairman
Michelle Bullock Commissioner
Eileen Colarell Commissioner
William McDowell Commissioner
John Phillips Commissioner

Barbara Kunar Secretary
Upon motion by Commissioner Phillips, second by Commissioner Colarell,
and carried, the Board accepted the minutes of November 14, 2019.
The Cash Flow Statement for November 2019 was presented to the Board
for review.
The Statement of Revenue and Expenditures for November 2019 was
incomplete. Problems with our software did not account for increases in revenue
it only adjusted the expenses.
The Village of Nyack Policy Against Discrimination and Harassment was
distributed to all Board members and an acknowledgement of receipt was signed
by all Commissioners.
H2M architects + engineers - Dennis Lindsay, P.E.
1. H2M architects + engineers have submitted their contract with
engineering fees for 2020. Their proposal for this year includes a
modest overall increase of their rates.
Upon motion by Commissioner Phillips, second by Commissioner
Bullock, and carried, the Board authorized H2M to continue as the Water
Department engineers and authorized Chairman Dailey to sign the
agreement.
2. H2M is ready to submit the plans for System Improvements to the
Health Department for Review. Form DOH 348 requires the Chairman’s
signature.
Upon motion by Commissioner Phillips, second by Commissioner
Colarell, and carried, the Board authorized Chairman Dailey to sign form
DOH 348.
3. Mr. Lindsay is in the process of composing a letter to Tilcon. Secretary
Kunar and Superintendent Smith are in the process of collating data.
4. New valves were installed on water mains as part the construction on
the Shared Us Path in South Nyack. The contractor failed to submit
plans and form 348 to the Health Department. The Health Department
will accept ‘as built’ plans for this project since the contractor has
followed required procedure.
Executive Session:
At 5:12 PM, upon motion by Commissioner Phillips, second by Commissioner
Bullock, and carried, the Board moved into executive session to discuss personnel
issues. At 5:40 PM upon motion by Commissioner McDowell, second by
Commissioner Philips, and carried the Board moved out of executive session.
Superintendent’s Report:
1. Sewer Leak - Interconnection:
A November 18, 2019 sewer leak on Old Mill Road spilled into the
Hackensack River made it necessary to go on the interconnection for
about 24 hours.
2. 35 North Greenbush Road:
The October 22, 2019 main break on North Greenbush Road caused
damage to the property at #35. The property owner, Bill Schlette,
submitted photographs of depicting 1” – 5” of mud on his river rock
wall and a landscaper’s estimate for repair. He is willing to postpone
repairs until spring. Since the property is presently snow covered,
further review of his request was tabled until our next meeting.
3. 273 Main Street Hydrant Use:
A temporary meter was hooked up to a fire hydrant to supply water
for the construction at 273 Main Street. It was agreed that our techs
would turn the hydrant on and off daily. On December 10, 2019 we
noticed there was a hose running from an adjacent property and the
hydrant was leaking. We will compile the cost of repairs and submit
an invoice to the contractor.
Our next meeting will be Thursday, January 9, 2020.
There being no further business, upon motion by Commissioner Colarell,
second by Commissioner Bullock, and carried, the meeting was adjourned at 5:44
PM.
