Architectural Review Board Feb 21, 2024 Minutes pg. 1 Meeting location: Nyack Village Hall Meeting called to order = 7:04pm Public hearing session opened. Motion by member Healey, 2nd by member Adler. *Note: The audio of this meeting was recorded. An audio only file is available at the building department. A FOIL request may be required. Present: Greg Healey Chair Laurie Steinhorst Member Mary Adler Member Maren Robertson Alternate Member Manny Carmona Building Inspector Dennis Michaels Village Attorney 1. 80 South Broadway. Dominick Pilla. Application for demolition of gas station and construction of 18 unit, multi-family building with retail on first floor and parking garage below. Application presented by: Dominick Pilla & an associate Board discussion: Application is for demolition of existing gas station / deli followed by erection of 4 story multi family building in DMU-1 zone. New building as proposed has 4 commercial suites on the ground (1st) floor, 18 apartments (a combination of studio, 1-BR & 2-BR)on the 2nd, 3rd& 4th floors and a total of 18 parking spots including 12 in the basement and 6 in front. Discussions with the board included clarifying the required parking spaces as 16. This project as proposed includes 18. The Applicant stated there would not be assigned parking for tenants, it would be first come first serve. The board made several statements over concerns about having the building set back so far and that it might interrupt the flow of the street. The board also suggested that the building be moved forward in line with the rest of the street, therefore creating space in the back of the building for parking. The board asked questions regarding the use of the parking spaces in the front of the building. The applicant(s) stated the spaces may be used by patrons of the stores in that building or tenants only. They further stated the building would have building management to make sure others did not park there. The board asked questions to clarify the rules about the provided public benefit features required to have a 4th floor. The applicant stated their contributions include: burying the utility lines, providing 2 additional on street parking spots by reducing curb cuts and more. Brian Davis, 9 Ross Ave, Nyack NY The commenter suggested there should be some kind of a compromise that could be made regarding the parking in front.. In addition, he made the following comments: you could cut the spots in half and still use the remaining spots for deliveries. Its Ok for the building to be set back, it gives more light. There are a million way to make the building look nice. He questioned if the building would be charging residents for the parking? Corey, Division Ave, Nyack, NY Stated the building is a big improvement over what is there now, but he is very concerned over the parking in the front of the building. Stated he doesn’t think it fits in with the character of the town. He said; Perhaps the space in front could be greenspace of seating for restaurants that might be in the stores. Christine Driscol, work and shops in Nyack. Stated, esthetically, the building is different, but she likes it more than some of the other buildings in Nyack. She also said It’s better than the building that is already there and the parking is better than what is there now. Closed on motion by member Healey, 2nd member Robertson. Approved by vote 4-0 After further discussion between the Applicant and the board members, the board requested the parking in the front be drastically reduced, when asked to clarify, it was further clarified to half of what it is as proposed. The applicant said that amount of reduction would not be possible otherwise it would require a variance. At a different time the board questioned whether all of the paved area in the front of the stores could be removed, but the applicant stated the access in the front of the building was required for emergency vehicles. Conclusion: No Ruling. Applicant is required to reappear before board with revised plan for parking / greenspace layout. As matter of record this was unanimously agreed on 4-0 by entire board. Public Hearing Remains Open *Note: For the above application 80 S Broadway, The applicant should provide at the next appearance before the board: samples of exterior materials to be used, as required and they also should provide photographs of additional buildings surrounding the property. 2. 47 Fifth Avenue. Gail Monaco. Application for the construction of a three-season room over existing rear deck. Architectural Review Board Feb 21, 2024 Minutes pg. 3 Application presented by: Jackie Urra Board discussion: Application includes building 3 season enclosed porch where deck currently is. New structure will be erected on existing deck structure after removing deck boards. New structure will extend further away from house slightly, with addition of new pylons and added understructure. New siding to match existing. West exterior wall of proposed porch in line with existing building. Roof line pitch varies from existing in order to maintain height at south end. Public Comment: None Opened on motion by member Healey, 2nd member Robertson. Closed on motion by member Healey, 2nd member Robertson. Approved by vote 4-0 Conclusion: Application approved as submitted. Motion by member Healey, 2nd by member Robertson. Approved by 4-0 vote. 3. 188 North Broadway. Kelly Colquitt. Application for exterior changes. Application presented by: Bill Pfaff Board discussion: Application includes new wood deck along west side of building, with wood pergola on deck and wooden stairs along west end of deck. Application also includes replacement of 4 windows with 2 french doors entering on deck, as well as addition of single window on 2nd floor and metal chimney. There are also new stone stairs on the south side and northwest corner. Board commented on discrepancies between drawing plans and photos of actual building. Additional comments were made regarding matching lite pattern of new window on 2nd floor with window next to it. Public Comment: None No members of general public besides other applicants were present. Conclusion: Application approved as submitted with agreement to align top and bottom of new window with existing as much as possible, and to add window divider(s) to match existing. Motion by member Healey, 2nd by member Steinhorst. Approved by 4-0 vote.
