Architectural Review Board Mar 20, 2024 Minutes pg. 1 Meeting location: Nyack Village Hall Meeting called to order = 7:04pm Public hearing session opened. Motion by member Healey, 2nd by member Steinhorst. Present: Greg Healey Chair Laurie Steinhorst Member Scott O’Neill Member Manny Carmona Building Inspector 1. 11 South Broadway. Crystals on the Rocks. Application for signage. Application presented by: Greg Tkacz Board discussion: Sign application with 2 parts. White vinyl on the 2 upper windows on either side of the entryway and perpendicular hanging sign with round hanging sign. Signs conform to regulations. Hanging sign has black ‘wrought iron’ hardware with round printed graphics on white background. Public Comment: None Opened on motion by member Healey, 2nd member Steinhorst. Closed on motion by member Healey, 2nd member O’Neill. Approved by vote 3-0 Conclusion: Application approved as submitted. Motion by member Healey, 2nd by member Steinhorst. Approved by 3-0 vote. 2. 144 Main Street. Panda Garden. Application for new awning. Application presented by: Kenneth Kamil Board discussion: Replacing and modifying pre-existing awning that used to hang over storefront. New awning will be raised so it is 8’ above sidewalk as per regulations. Awning will be all new, with similar color green material and similar graphics, but phone number will be removed. It will have aluminum framing with metal brackets and concrete anchors. Application seeking amendment to previous approval. Application presented by: Giuseppe Pagano Board discussion: Revisiting previously approved build plan with slight modification. Applicant is requesting changing location of window. Originally approved plan had gang of 4 windows on rear (south) on 1st floor on west side, now proposed plan is to remove one of those windows (now gang of 3) and move the extra window to west side of building at same corner of house. Board requested new 3 gang of windows line up on center with 2 windows on second floor. Public Comment: None Opened on motion by member Healey, 2nd member Steinhorst. Approved by 3-0 vote. 4. 34 Hart Place. Linie and Joseph Rand. Application for exterior changes to rear of the house. Application presented by: Margaret Fowler Board discussion: Application is to add small addition in space between 2 existing portions of the house, which will not extend beyond the existing perimeter of the building. Proposal is also to replace multiple windows and doors on North, South and West of building, to be more in kind with existing windows on remainder of house. Doors and windows to have similar lite pattern. Architectural Review Board Mar 20, 2024 Minutes pg. 3 Public Comment: Opened on motion by member Healey, 2nd member Steinhorst. 1 person, who identified themselves as a neighbor, but did not provide their name asked if the modifications would extend the house closer to the property line. It was confirmed that the modifications would not. The member of the public stated that in that case he was OK with the plan and thought it would be an improvement. Closed on motion by member Healey, 2nd member O’Neill. Approved by vote 3-0 Conclusion: Application approved as submitted. Motion by member Healey, 2nd by member Steinhorst. Approved by 3-0 vote. 5. 210 Main Street. John Rooney. Exterior alterations with the creation of an additional dwelling unit on the third floor. Application presented by: Jenny Zuniga & John Rooney Board discussion: Applicant seeking approval to add 3rd floor dormer roofs on both sides at rear (North) side of building. In addition, seeking to add new exterior staircase to provide access to 3rd floor. The new dormer roofs are only minimally visible from Main Street due to the existing roof lines. Siding and roof material to match existing. The staircase does project out from the existing footprint of the building, but does remain over the 1st floor roof and turns to minimize the projection. The applicant asked the board to consider the choice of color for the staircase, either white or green. Although it is outside the purview of the ARB, the members agreed green matching the trim on the house is preferred. Public Comment: None Opened on motion by member Healey, 2nd member Steinhorst. Architectural Review Board Mar 20, 2024 Minutes pg. 4 6. 80 South Broadway. Dominick Pilla. Continuation of application for demolition of gas station and construction of 18 unit, multi-family building with retail on first floor and parking garage below. Application presented by: Dominick Pilla&associate Board discussion: Applicant was requested to reappear before board ‘with revised plan for parking / greenspace layout.’ At last meeting, the board requested the parking in the front be drastically reduced. Applicant provided new site plan with 1 less parking spot in front of building. The new plan also added a walkway approach to the south, and widened the sidewalk at S Broadway. Applicant provided additional renderings of site from multiple angles. Applicant also provided material samples. Per Nyack Village code: “the Architectural Review Board shall take into consideration the general design framework which respects the scale and architectural character of existing neighborhoods and which will allow development and alterations to be in harmony with and compatible with the existing design and architecture of the Village and not detrimental thereto. In reviewing applications, the ARB shall take into account natural features of the site and its surroundings, the exterior design and appearance of existing and planned structures in the immediate area and the character of the area and the Village.” As per above, the majority of the board feels the building as proposed does not fit the ‘character of the area and the Village.’ However, due to the complexity of this project and the numerous decision making bodies yet to consider and rule on this project, in addition to conformances to state and local codes this project has yet to be scrutinized for compliance to, the board agrees to let this project be considered by the next appropriate Land Use Board as decided by the Building Dept. Public Comment: Opened on motion by member Healey, 2nd member Steinhorst. Keith Taylor, Owner of 88 S Broadway, Nyack NY Mr Taylor mentioned the risk of fire hazard and possibly code violation having the building in such close proximity to his building. He also mentioned a shared wall which is partially owned by him. ** Another member of the audience (presumably the owner of 80 S Broadway) came up to Mr Taylor and aggressively confronted him while he was speaking. Mr Healey (ARB chair) immediately told this individual to return to his seat. Mr Taylor finished his remarks with the comment that this proposed building ‘doesn’t fit into the character of Nyack.’ Note: Mr Taylor also submitted a letter addressed to the ARB titled: ‘80 South Broadway observations of plans for ARB’ which has been submitted to the application’s records. This letter should be reviewed and considered in its entirety by the building dept. and other boards. Closed on motion by member Healey, 2nd member Steinhorst. Approved by vote 3-0 Architectural Review Board Mar 20, 2024 Minutes pg. 5 Conclusion: The board agrees to allow the building and site plan as proposed WITH the following notices and stipulations: Attention should be paid to the number of parking spaces the applicant is mandated to provide or request a variance for. By our calculations, due to the number of units & bedrooms the number of required spaces is 22. The site plan provides 17. However, no additional parking spaces may be added in front of the building. The Architectural massing, width, height, proportion and scale of the building as a whole should also be considered. The building coverage is roughly 78% of the lot size which is high. And, they are asking for 2 density bonuses. 20% for a green roof and 10% for affordable and workforce units which allows them 4.2 extra units. The board does not think they should be granted both bonuses. Also, the majority of the ARB members feel the building set back with parking in front of the building does not fit the character of the village. In an effort to be in harmony with, and compatible with the existing design and architecture of the Village, the board members have recommended that the building to be in line with the buildings to the north on Broadway and the parking moved to the back. In addition, if the building plan and/or site plan changes, the applicant is required to re-appear before the ARB. This may be a joint session with another Nyack land use board. Motion by member Healey, 2nd by member Steinhorst. Approved by 3-0 vote. Meeting adjourned = 7:50pm Public hearing closed. Motion by member Healey, 2nd by member Steinhorst.
