Public Comment – Discussion of Action Items Only – 3 Minute Time Limit. 5. Action Items 5.1 Resolution No. 2023-18 Resolution of the Nyack Village Board accepting audited voucher summary. WHEREAS, the Audited Voucher Summary was presented to the Nyack Village Board of trustees at its regularly scheduled meeting of January 12, 2023. THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE NYACK VILLAGE BOARD AS FOLLOWS: RESOLVED, that General Fund Claims set forth on pages 1 through 13 in the amounts of General fund $45,444.24 Parking fund $4,270.74 Water Fund $731.83 as set forth on Audited Voucher Summaries and as submitted by the Village Clerk/Treasurer, are hereby approved. 5.2 Resolution No. 2023-19 Resolution of the Nyack Village Board to approve Third Annual Black LGBTQ+ Pride Block Party w/Nyack NAACP, Wednesday, June 14th (rain date Thursday, June 15), 6-9 pm. at Hezekiah Easter Memorial Veterans Park gazebo and adjacent parking lot RESOLVED, the Trustees of the Village of Nyack approve the Pride Center application for use of the Hezekiah Easter Memorial Veterans Park gazebo and adjacent parking lot Wednesday, June 14th (rain date Thursday, June 15), 6-9 pm, for the Third Annual Black LGBTQ+ Pride Block Party w/Nyack NAACP. 5.4 Resolution No. 2023-20 Resolution of the Nyack Village Board to approve joining NYCLASS bank to earn a higher interest rate on Village funds WHEREAS, New York General Municipal Law, Article 5-G, Section 119-o (Section 119-o) empowers municipal corporations [defined in Article 5-G, Section 119-n to include school districts, boards of cooperative educational services, counties, cities, towns and villages, and districts] to enter into, amend, cancel, and terminate agreements for the performance among themselves (or one for the other) of their respective functions, powers, and duties on a cooperative or contract basis; WHEREAS, the Village of Nyack wishes to invest portions of its available investment funds in cooperation with other corporations pursuant to the NYCLASS Municipal Cooperation Agreement Amended and Restated as of March 28, 2019; WHEREAS, the Village of Nyack wishes to satisfy the safety and liquidity needs of their funds; RESOLVED, the Jennifer Hetling, Clerk Treasurer, is authorized to participate in the NYCLASS program under the terms of the NYCLASS Municipal Cooperation Agreement Amended and Restated as of March 28, 2019. 5.5 Resolution No. 2023-21 Resolution of the Nyack Village Board to approve Walter Santos’ application for a food truck permit for 2023. RESOLVED, the Trustees of the Village of Nyack approve the food truck permit submitted by Walter Santos, contingent on the full satisfaction of all permit requirements as well as a Fire Safety Inspection, and direct the Village Administrator to work with the permittee to coordinate specific parking location within the Memorial Park and Marina area. 5.6 Resolution No. 2023-22 Resolution of the Nyack Village Board to declare garbage truck surplus WHEREAS, the DPW Superintendent and Village Administrator have identified the 2007 International garbage truck as no longer worth fixing in the face of escalating repair costs and the circumstances of having two other garbage trucks, the minimum needed for weekly garbage pickup. RESOLVED, the Village Administrator is authorized to sell at auction the above-described vehicle. 5.7 Resolution No. 2023-23: Resolution of the Village Board of Trustees to issue a Notice of its Intention to Declare itself Lead Agency pursuant to the State Environmental Quality Review Act (“SEQRA”) regarding the construction of additional water treatment facilities dedicated to PFAS pollution removal, and to distribute such Notice of Intention to all other SEQRA Involved Agencies (if any). RESOLVED, the Trustees of the Village of Nyack approve the issue of a notice of its intention to declare itself lead agency pursuant to the NYS Environmental Quality Review Act (“SEQRA”) regarding the construction of additional water treatment facilities dedicated to PFAS pollution removal, and to distribute such Notice of Intention to all other SEQRA Involved Agencies (if any). 6.
