REGULAR MEETING OAKDALE CITY COUNCIL December 14, 2021 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on December 14, 2021, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Paul Reinke at 6:00 PM. TRUTH IN TAXATION Mayer Reinke opened the Truth in Taxation meeting. Finance Director Zimmerman presented the 2022 Tax Levy and Budget. Mayer Reinke called for public comment. There was no one that commented. The mayor closed the Truth in Taxation meeting and opened the regular meeting. 2022 BUDGET, LEVY AND CIP ADOPTION Zimmerman presented the 2022 property tax levy and 2022 General Fund, Special Revenue Fund and Enterprise Fund Budget. REGULAR MEETING December 14, 2021 Page Two A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER SWEDBERG, TO WAIVE READING AND ADOPT RESOLUTION 2021-108 ADOPTING THE 2022 PROPERTY TAX LEVY AND 2022 GENERAL FUND, SPECIAL REVENUE FUND, AND ENTERPRISE FUND BUDGETS. 5 AYES. Zimmerman presented the city plans for capital maintenance and improvements by preparing a five-year Capital Improvement Plan (CIP). The CIP represents a framework for planning the preservation and expansion of capital including equipment, facilities, and infrastructure. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER SWEDBERG, TO WAIVE READING AND ADOPT RESOLUTION 2021-109 APPROVING THE FISCAL POLICY REFLECTED IN THE 2022-2026 CAPITAL IMPROVEMENT PROGRAM, ADOPTING THE 2022- 2026 CAPITAL IMPROVEMENT PROGRAM, AND INITIATING THE 2022 PROJECTS), 5 AYES. APPROVAL OF MINUTES: Workshop, October 12, 2021 Regular Meeting, November 23, 2021 Special Workshop, November 30, 2021 A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON, SECONDED BY COUNCIL MEMBER ZABEL, TO APPROVE THE WORKSHOP MINUTES OF OCTOBER 12, 2021, AS PRESENTED. 5 AYES. CONSENSUS MOTIONS REGULAR MEETING December 14, 2021 Page Three A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG, TO APPROVE THE FOLLOWING CONSENSUS MOTIONS: a) Approve the 2022 Fire Protection and Ambulance Services contract, in the amount of $558,040, between the City of Oakdale and the Oakdale Fire Department. b) Waive reading and adopt Resolution 2021-110, Accepting Supplemental Distribution of Fiscal Recovery Funds from the U.S. Department of the Treasury under the American Rescue Plan Act of 2021. c) Amending Resolution 2021- 111 and Resolution 2021-96, Authorizing the Allocation of all State and Local Fiscal Recovery Funds, as well as any additional American Rescue Plan Act Proceeds Resulting from the Redistribution of Unrequested Funds, to be Used to Replace Lost Revenue and Finance Government Services as Outlined by the Department of Treasury’s Interim Final Rule. d) Waive reading and adopt Resolution 2021--112, Approving the hiring of Ice Rink Attendants, as noted. e) Approving the issuance of a Natural Tree Sales License to Fleet Farm of Green Bay LLC, dba Fleet Farm, 5635 Hadley Avenue; license to expire January 9, 2022. f) Waive reading and adopt Resolution 2021-113, Approving the 2022 Fee Schedule. g) Approve Policy Number PE-032: Telecommuting Policy and Procedure, Effective Immediately h) Waive reading and adopt Resolution 2021-114, Approving the 2022 Approving, Executing and Implementing the 2022-2024 Labor Agreement and Memorandum of Understanding between the City of Oakdale and the International Union of Operating Engineers, Local 49, for the period of January 1, 2002 to December 31, 2024. i) Waive reading and adopt Resolution 2021-115, Approving the Memorandum of Agreement (MOA) Between the State of Minnesota and Local Governments and Authorizing Participation in National Opioid Settlements. j) Waive reading and adopt Resolution 2021-116, Authorizing the Interfund transfers and fund consolidation as presented. k) Waive reading and adopt Resolution 2021-117, Approving the Appointment of Trent Christensen, Josh Elverum and Mark Tiffany as Fire Captains, effective January 1, 2022 at a rate of pay Consistent with the Approved Job Classification and Compensation Study. REGULAR MEETING December 14, 2021 Page Four l) Authorize the Mayor and City Administrator to sign the attached Grant Agreement between the State of Minnesota, EAB project through the Department of Natural Resources and the City of Oakdale. m) Authorize the Mayor and City Administrator to sign and execute a one year service agreement with Consolidated Communications starting December 15, 2021. n) Approve the issuance of 2022 Solid Waste Hauler Licenses, as noted, contingent upon receipt of all required materials as listed in the ordinance. o) Accept and Enter into a Three Month Contract Extension with Expert T Billing Company Effective January 1, 2022. p) Authorize the Mayor and City Administrator to sign the agreement with TPC, Inc. q) Approve the issuance of 2022 Sale of Firework Sales licenses, as noted. r) Approve the issuance of 2022 Sale of Tobacco Sales licenses, as noted. s) Waive reading and adopt Resolution 2021-118, Approving the Issuance of a Used Car Dealer License to Oakdale Auto Sales, Inc., 7500 Hudson Boulevard, Suite 410, Subject to Conditions; Waive Reading and Adopt Resolution 2021-119, Approving the Issuance of a Used Car Dealer License to Elite Motorsports, LLC 7500 Hudson Boulevard, Suite 155, subject to Conditions; Waive Reading and Adopt Resolution 2021-120 Approving the Issuance of a Used Car Dealer License to Reflective Auto Sales, 4747 Geneva Avenue, subject to conditions; Waive Reading and Adopt Resolution 2021-121, Approving the Issuance of a Used Car Dealer License to Stillwater Auto Sales, 6014 Stillwater Boulevard, Subject to Conditions. t) Waive reading and adopt Resolution 2021-122 Authorizing the Budget Adjustments as Outlined 5 AYES. STAFF REPORTS REGULAR MEETING December 14, 2021 Page Five Public Works Director/City Engineer Brian Bachmeier, presented a feasibility report for city streets in need of improvement. The streets proposed have poor pavement conditions and he said repaving the streets are a necessity and can no longer be patched. The streets include the Anna’s Grove neighborhood, 4th Street; will include curb and gutter, 3rd Street; mill and overlay, Imperial Avenue, and Oak Marsh Drive. The cost of the project will be $4,570,000. Some of the cost will be offset by the gas tax and Assessments A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER INGEBRIGTSON, TO WAIVE READING AND ADOPT RESOLUTION 2021-123 ACCEPTING THE FEASIBILITY REPORT FOR CITY PROJECT 2022-01 (2022 STREET IMPROVEMENT PROGRAM), AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS, DECLARING THE COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT ROLL, AND ESTABLISHING A PUBLIC IMPROVEMENT AND ASSESSMENT HEARING FOR JANUARY 25, 2022, AT 7:00 P.M. CITY ATTORNEY Nothing to report. ADMINISTRATOR REPORT City Administrator Volkers reported that Jean Thurmer wished to make a donation of six cemetery plots at Union Cemetery in Maplewood. The estimated gift per plot is $1,200. The city would then sell the plots and the funds would go to the parks department. A MOTION WAS MADE BY COUNCIL MEMBER OLSON, SECONDED BY COUNCIL MEMBER INGEBRIGTSON, ACCEPTING A DONATION FROM JEAN THRUMER OF CEMETERY LOTS LOCATED AT UNION CEMETERY AND DIRECTS STAFF TO PROCEED WITH THE PROCESS TO SELL THE PROPERTY. 3 AYES – REINKE, OLSON, INGEBRIGTSON 2 NAYS – SWEDBERG, ZABEL THE MOTION REQUIRES A 2/3’S VOTE TO PASS. THE MOTION FAILED. PUBLIC HEARING: LOR ENTERPRISES INC., DOUBLESHOTZ LIQUOR – OFF SALE INTOXICATING LIQUOR LICENSE Mayor Reinke opened the hearing and invited public comment, no comments were brought forth; Mayor Reinke closed the hearing A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER SWEDBERG, APPROVING THE ISSUANCE OF AN OFF SALE INTOXICATING LIQUOR LICENSE TO LOR REGULAR MEETING December 14, 2021 Page Six ENTERPRISES INC., DBA, DOUBLESHOTZ LIQUOR, 1021 HELMO AVENUE; LICENSE TO EXPIRE MARCH 31, 2022. 5 AYES COUNCIL PRESENTATIONS Mayor Reinke acknowledge long-time City Clerk as the recipient of the 2021 Volunteer of the Year Award. He expressed how much Ms. Barry has meant to the city and many of the tasks she’s performed in her role. Sue has been with the city of Oakdale for over 40 years and we wish her all the best in retirement. Mayor Reinke also wished everyone Happy Holidays. Council Member Ingebrigtson said that City Clerk Sue Barry goes above and beyond and will be missed. Council Member Zabel paid a compliment to the Public Works Department on how well they did with snow removal after the big snowfall the city experienced recently. Council Member Swedberg wished everyone Happy Holidays.
