REGULAR MEETING OAKDALE CITY COUNCIL March 22, 2022 CALL TO ORDER A regular meeting of the City Council of the City of Oakdale was held on March 22, 2022, at Oakdale City Hall, 1584 Hadley Avenue, Oakdale, Minnesota. The meeting was called to order by Mayor Paul Reinke at 7:00 PM. APPROVAL OF MINUTES A MOTION WAS MADE BY COUNCIL MEMBER ZABEL, SECONDED BY COUNCIL MEMBER OLSON TO APPROVE THE WORKSHOP MINUTES OF MARCH 8, 2022, AS PRESENTED. 5 AYES. REGULAR MEETING March 22, 2022 Page Two A MOTION WAS MADE BY COUNCIL MEMBER SWEDBERG, SECONDED BY COUNCIL MEMBER OLSON, TO APPROVE THE REGULAR MEETING MINUTES OF MARCH 8, 2022 AS PRESENTED. 5 AYES. OPEN FORUM Washington County Commissioner Stan Karwoski presented retired Public Works Director/City Engineer Brian Bachmeier with the Commissioner Service Award. Traditionally the county will grant this award to people who have dedicated much of their careers to public service. Mr. Bachmeier served the City of Oakdale for over 30 years and worked with Commissioner Karwoski for 21 years while he served on the Oakdale City Council. Commissioner Karwoski spoke of Mr. Bachmeier’s excellent service to the City of Oakdale. CONSENSUS MOTIONS a) Waive reading and adopt Resolution 2022–xxx, approving issuance of a Garden Center License to Hy-Vee to operate a temporary garden center located at 7180 10th Street North, subject to conditions. b) Authorize the City Administrator and Mayor to approve the replacement of the Exhibit A dated February 15, 2022, with the Exhibit A map dated March 3, 2022 which includes the easement list. c) Confirm the appointment of Lori Pulkrabek to the cable commission effective March 23, 2022. d) Waive reading and adopt Resolution 2021-xxx, Approving plans and specifications for city project 2022-01 (street improvements) and authorize the advertisement for and collection of bids. e) Waive reading and approve Resolution 2022-xxx supporting the application for the Washington County CDA Predevelopment finance fund grant application. f) Authorize the Mayor and City Administrator to sign and execute a contract with Davey Resource Group, Inc. in the amount of $3,500. g) Approve the lease agreement and authorize the Mayor and the City Administrator to sign the attached Agreement between T-Mobile Central LLC and the City of Oakdale. h) Authorize the Mayor and City Administrator to sign and execute a contract with WSB & Associates, Inc. i) Approve the Cornerstone Village Encroachment Permit A MOTION WAS MADE BY COUNCIL MEMBER ZABEL TO APPROVE THE CONSENT AGENDA ITEMS, SECONDED BY COUNCIL MEMBER INGEBRIGTSON. 5 AYES ADVISORY BOARDS AND COMMISSIONS Economic Development Commission (no meeting) Environmental Management Commission (no meeting) REGULAR MEETING MARCH 22, 2022 Page Three Planning Commission (no meeting) The Parks and Recreation Commission met on March 15 Council Liaison Ingebrigtson was unable to attend, however he shared that the most important needs were three of the city’s parks and an electrical upgrade at the Walton Park ballfields. The Tree Board met on March 15, Council Liaison Mayor Reinke was unable to attend, however he shared that the Board is still planning the Arbor Day Tree Giveaway. STAFF REPORTS ENGINEERING Interim City Engineer Bachmeier asked for the approval of plans and specifications for city project 2022- 01: 2022 street improvements. A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON REQUESTING THAT THE CITY COUNCIL WAIVE THE READING AND ADOPT RESOLUTION 2022-XXX APPROVING THE PLANS AND SPECIFICATIONS FOR CITY PROJECT 2022-01 “2022 STREET IMPROVEMENTS” AND AUTHORIZE THE ADVERTISEMENT FOR BIDS. SECONDED BY COUNCIL MEMBER SWEDBERG. 5 AYES Interim City Engineer Bachmeier asked that the council establish a speed limit of 35 mph on Hudson Boulevard/Hadley Avenue/4th Street between westerly city limits and Inwood Avenue. The current speed limit on these streets range from 40-45 mph which is higher than other similar roads in the city. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL WAIVE THE READING AND ADOPT RESOLUTION 2022-XXX ESTABLISHING A SPEED LIMIT OF 35 MPH ON HUDSON/HADLEY/4TH STREET NORTH FROM THE WESTERLY CITY LIMITS TO INWOOD AVENUE AND AUTHORIZING THE POSTING OF THIS LIMIT WITH THE GOLD LINE AND CP2022-01 IMPROVEMENTS. SECONDED BY COUNCIL MEMBER INGEBRIGTSON. 5 AYES COMMUNITY DEVELOPMENT Interim City Planner Erin Perdu spoke about the Impact apartment’s preliminary plat, site plan with PUD deviations, and noise variance. Norhart, the developer, is seeking approval to allow the development of a 321 unit apartment building on the R5 parcel within the Helmo Station PUD. They also requested a building height of 7-stories rather than the six that is currently allowed by code. Ms. Perdu also stated the developer is requesting a rear setback of 19.7 feet where 10 feet is required. Norhart is also requesting a variance for highway noise. The Minnesota Pollution Control Agency (MPCA) did a noise study that indicated that the projected daytime outdoor noise levels would exceed the MPCA maximum requirements by up to 2.3 decibels; 3.8% over the threshold. Ms. Perdu highlighted in her presentation that the noise issue will be buffered somewhat by existing trees and future development of a 4-6 story structure. Ms. Perdu stated that the plat includes 145-units per acre vs. the normal maximum of 50-units per acre. Additionally, there will be 67 extra parking spots. REGULAR MEETING MARCH 22, 2022 Page Four A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL WAIVE READING AND ADOPT RESOLUTION 2022-XX APPROVING THE PRELIMINARY PLAT FOR THE IMPACT APARTMENTS, LOCATED IN THE HELMO STATION PUD, WITH CONDITIONS OUTLINED IN THE ATTACHED RESOLUTION. SECONDED BY COUNCIL MEMBER SWEDBERG 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON REQUESTING THAT THE CITY COUNCIL WAIVE READING AND ADOPT RESOLUTION 2022-XX APPROVING THE SITE PLAN FOR THE IMPACT APARTMENTS WITH THE PUD DEVIATIONS AS PROPOSED, WITH CONDITIONS OUTLINED IN THE ATTACHED RESOLUTION. SECONDED BY COUNCIL MEMBER OLSON. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER SWEDBERG REQUESTING THAT THE CITY COUNCIL WAIVE READING AND ADOPT RESOLUTION 2022-XX APPROVING THE NOISE VARIANCE FOR THE IMPACT APARTMENTS. SECONDED BY COUNCIL MEMBER INGEBRIGTSON. 5 AYES TEMPORARY OUTDOOR PATIOS Community Development Director Andrew Gitzlaff discussed the ordinance amendment due to an interest by some Oakdale businesses in continuing to have outdoor patio dining space between April 1, 2022 and November 1, 2022. The need / desire for outdoor patios came about during COVID. Many establishments created an outdoor space for health and safety requirements so they were able to offer their customers a safe location to still enjoy their favorite places to dine. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL WAIVE READING AND ADOPT ORDINANCE 2022-881 APPROVING THE CHAPTER 9 ORDINANCE AMENDMENT AS WRITTEN WITHIN THE ATTACHED EXHIBIT. SECONDED BY COUNCIL MEMBER OLSON. 5 AYES A MOTION WAS MADE BY COUNCIL MEMBER INGEBRIGTSON REQUESTING THAT THE CITY COUNCIL WAIVE READING AND ADOPT RESOLUTION 2022-XXX, APPROVING SUMMARY PUBLICATION OF AN ORDINANCE AMENDING CHAPTER 9, AMENDING THE CODE OF ORDINANCES FOR THE CITY OF OAKDALE, LICENSES AND BUSINESS REGULATIONS. SECONDED BY COUNCIL MEMBER OLSON. 5 AYES CITY ATTORNEY, Assistant Attorney Rachel Tierney – no report ADMINISTRATOR'S REPORT City Administrator Volkers spoke about the City’s efforts at the legislature to ensure a sustainable, safe and reliable water supply. Ms. Volkers added that proposed restrictions, set by a recent court case settlement initiated by White Bear Lake residents, on Oakdale’s water permit presents a dire threat to safe and reliable water access for local schools, hospitals, new housing developments, and other industries. She also added that the DNR’s potential permit amendments threaten the health, welfare, growth, and prosperity of the city, and surrounding communities, and is an untenable solution to shared use of the REGULAR MEETING MARCH 22, 2022 Page Five Prairie du Chien-Jordan Aquifer. Ms. Volkers asked for support of the attached Resolution which speaks to this. If approved, it will be presented to state legislators and the Governor. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL WAIVE READING AND ADOPT RESOLUTION 2022-XXX, SUPPORTING LEGISLATIVE EFFORTS TO ENSURE A SUSTAINABLE, SAFE, AND RELIABLE WATER SUPPLY FOR THE CITY OF OAKDALE RESIDENTS, BUSINESSES, SCHOOLS, HOSPITALS, AND OTHER PUBLIC AND PRIVATE USES. SECONDED BY COUNCIL MEMBER OLSON. 5 AYES COUNCIL PRESENTATIONS (no presentations) AWARD OF BID Every year the city requests bids for street striping. Two bids were received. The lower of the two bids was submitted by Fahner Asphalt. A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL AUTHORIZE THE MAYOR AND THE CITY ADMINISTRATOR TO SIGN AND EXECUTE THE 2022 STREET STRIPING CONTRACT WITH FAHRNER ASPHALT IN THE AMOUNT OF $14,423.50. SECONDED BY COUNCIL MEMBER INGEBRIGTSON. 5 AYES CLAIMS A MOTION WAS MADE BY COUNCIL MEMBER ZABEL REQUESTING THAT THE CITY COUNCIL APPROVE CLAIMS FOR THE PERIOD MARCH 5, 2022 TO MARCH 18, 2022 OF IN THE AMOUNT OF $734,589.78.
