MINUTES Ocean Shores Planning Commission Regular Meeting Tuesday, 4/8/2025– 2:00 p.m. Ocean Shores Public Library Meeting Room 573 Point Brown Ave NW, Ocean Shores, WA Minutes taken by Commissioner Johnston 1. Call to Order Chair Mark Lawlis called the meeting to order at 2:00 p.m. 2. Roll Call Planning Commissioners present: Mark Lawlis, Thorn Ward, Steve Kern, Dennis Petersen, Randy Johnston, and Dan Bricker Planning Commissioners absent: Tom Bies Motion to approve absence of Tom Bies Commissioner Petersen moved to approve the absence of Commissioner Bies. Commissioner Bricker seconded the motion. The motion passed unanimously. City Staff present: Nicole Birch, Deputy City Clerk and Marshall Read, City Planner 3. Approval of Meeting Agenda ● Commissioner Peterson moved to approve the meeting agenda. Commissioner Bricker seconded the motion. The motion passed unanimously. 4. Approval of Minutes ● Commissioner Johnston moved to approve the meeting minutes from 3/25/2025. ● Commissioner Bricker seconded the motion. The motion passed unanimously. 5. Public Comments None 6. Old Business: Discussion Metal Fasteners Chairman Lawlis stated that he and City Planner Marshall Reed, and Roy Simmons, Building Department, met to discuss the metal fastener verbiage changes to the building code. Marshall will write up the changes discussed and present at the next Planning Commission meeting for final discussion and approval. Action: No action was taken. Update to OSMC 17.50.115. Chairman Lawlis and City Planner Reed presented proposed changes to the code. Action: No action was taken. 8. New Business: Discussion Bills in the Washington Legislature - Chairman Lawlis discussed several bills from the Washington State Legislature, including HB 183 and SB 184, and SB 5576 and HB 1763. Trapping in Ocean Shores. Chairman Lawlis introduced Scott Harris, representative from Washington State Fish and Wildlife. He agreed with the commission that the OSMC should be changed to more closely match the WAC codes regarding the trapping of animals. Page 5 of 11  H. Roofing materials shall be wood shingle or shake, composition, asphalt laminate, clay, or architectural metal. 1. Membrane roofs comprised of torch down, polyvinyl chloride or hot tar as a primary roofing material in residential buildings are permitted provided the exposed facade is screened from street-level view. 2. Exposed fastener corrugated metal or corrugated fiberglass roofing is not permitted. 3. Exposed fastener ribbed or architectural metal roofing is not permitted for any structure larger than 200 square feet. (Approved 2-25-2025). Exposed fastener ribbed or architectural metal roofing is permitted for structures of less than 200 square feet. 4. Exposed fastener ribbed or architectural metal roofing is permitted for non- accessory structures, unpermitted accessory structures. Fasteners must be specifically designed for metal roofing, be the same color as the roofing, and must be installed with uniform spacing as recommended by the manufacturer. (Approved 2-11-2025) I. Architectural elevations must meet the following: 1. The same architectural elevation shall be separated by a minimum of two other homes. Reversing/mirroring home does not change the architectural elevation. 2. An articulation is an architectural element such as a one-story porch or bay window. One such element shall be used on sides of the building that face toward a public street, shared access easement, or common green. The articulation shall be offset a minimum of twelve inches. A garage setback does not count as an articulation. 3. Both attached and detached garages All permitted structures on the property must be in keeping with the home’s architectural design and finishes. J. Exterior finishes must meet the following: 1. Wood, or wood-style, insulated lap, or other nonmetallic-appearing architectural metal siding is required on primary structures. Architectural or ribbed metal siding is permitted for outbuildings, unpermitted structures less than 200 square feet, tubular canopies, carports/boat covers over 200square feet and permitted accessory structures. a. Fasteners must be specifically designed for metal siding, be the same color as the siding, and must be installed with uniform spacing as recommended by the manufacturer. Metal siding, roofing and fasteners approved for use, must carry a manufacturer’s guarantee of at least twenty years, consistent with OSMC 17.26.060 D. c. Exposed ends of stone and masonry facades must be finished with trim or end caps. d. All garage sides that are visible from streets or shared access easements shall provide architectural details and trim consistent with the design of the home. e. Attached garages or attached carports which provide a third bay or more of covered or enclosed space must be offset a minimum of two feet from the first two covered or enclosed spaces. 3. Page 7 of 11  17.50.115 Nonaccessory Structures – Standards and Applications Owners of undeveloped real property as defined in Section 17.04.371 may erect one shed- type structure, one gazebo, and a fence on a vacant lot. Said nonaccessory structure may be erected pursuant to the following conditions: A. The property owner shall complete a city of Ocean Shores nonaccessory structure application, which application shall include: 1. A completed nonaccessory building permit application with applicable fee as set by resolution; and 2. A proposed site plan; and 3. Drawings and/or photographs of the proposed shed-type structure and fence, including dimensions; and B. Nonaccessory sheds may not exceed one hundred twenty square feet in area, and twelve feet in height; and C. Nonaccessory gazebos may not exceed two hundred square feet in area, and fifteen feet in height; and D. Nonaccessory sheds may have a permanent foundation which must be securely anchored in a tie-down fashion; and E. The exterior wall surface of nonaccessory sheds shall be constructed of non-metallic wood like appearance, wood, vinyl, and/or resin; and 4. Page 8 of 11  Additions to Definitions in Ocean Shores Municipal Code 17.50 Awnings: An architectural projection that provides weather protection, identity or decoration and is partially or wholly supported building to which it is attached. An awning is composed of a lightweight structure over which a covering is attached. Canopy: A permanent structure or architectural projection of rigid construction over which a covering is attached that provides weather protection, identity or decoration. A canopy is permitted to be structurally independent or supported by attachment to a building on one or more sides. Intermodal Shipping Containers/CONEX: A six-sided steel unit originally constructed as a general cargo container used for the transit of goods and materials. 5. Page 9 of 11  8.20.100 Prohibited Trapping The city council recognizes that the prac�ce of trapping for animals is very hazardous in an area where families reside and businesses are carried on,.and declares that it is the policy of the city to prohibit allow trapping of any nature whatsoever within the city limits for wildlife threatening of human safety or causing property damage 8.20.110 Unlawful. Trapping wildlife threatening human safety of causing property damage – procedure, limita�ons, and condi�ons Any person who hunts for fur-bearing animals with any trapping device of any nature whatsoever within the city limits shall be guilty of a Class B offense as defined in Title 7 of this code. (Ord. 281 § 3 (part), 1979: Ord. 199 § 2, 1976) (1) Subject to limita�ons and condi�ons established by the city, the owner, the owner's immediate family member, the owner's documented employee, or a tenant of real property may contact City Animal Control Officer to establish there is wildlife threa�ng of human safety or causing property damage. (2) Once the city agrees that there is wildlife threa�ng of human safety or causing property damage the owner or representa�ve will contact WDFW to establish a contact of a Wildlife Control Operator. (3) The Wildlife Control Operator will be required to get the necessary permits from WDFW before trapping can begin along no�fying City Safety Officer of the placing traps within the city. (4) Trapping will be consistent with RCW 77.15.194, or kill wildlife that is threatening human safety or causing property damage on that property, without the licenses required under RCW 77.32.010 or authoriza�on from the director under RCW 77.12.240. 8.20.120 Exemp�ons Unlawful The Washington State Game Department shall be allowed to trap for animals, with the approval of the public safety director of the city, when such ac�vity is necessary under the circumstances. (Ord. 199 § 3, 1976) Any person who hunts for fur-bearing animals with any trapping device of any nature whatsoever within the city limits shall be guilty of a Class B offense as defined in Title 7 of this code. 6. The following provisions shall regulate the use and installation of electrical materials, devices, appliances and equipment in the city: A. Field installed aluminum conductors of electricity are authorized only in the commercial zone dedicated for the Tesla Charging Station located at the Ocean Shores Convention Center. B. Field installed aluminum conductors of electricity are prohibited. Only copper conductors are authorized. Exceptions shall be permitted only if the Grays Harbor PUD supplies, installs and maintains any nonconforming conductor. C. Concrete-encased electrode shall be used as the primary grounding system if available. An electrode diameter of at least two inches (fifty millimeters) of concrete, located within and near the bottom of a concrete foundation or footing that is in direct contact with the earth, consisting of at least twenty feet (six meters) of one or more bare or zinc galvanized or other steel reinforcing bars or rods of not less than one-half-inch (thirteen millimeter) diameter, or consisting of at least twenty feet (six meters) of bare copper conductor not smaller than No. 4 AWG. Reinforcing bars shall be permitted to be bonded together by steel tie wires or other effective means. D. A secondary grounding system shall consist of two grounding rods five-eighths-inch by eight feet minimum installed six feet minimum apart supplemented by minimum No. 2 bare copper conductor twenty feet in length buried a minimum two feet in the earth.
