Call to Order Chair Mark Lawlis called the meeting to order at 2:00 p.m. 2. Roll Call Planning Commissioners present: Mark Lawlis, Dan Bricker, Tom Bies, Randy Johnston, Steve Kern, Dennis Petersen Planning Commissioners absent: Thorn Ward Motion by Commissioner Kern to excuse Commissioner Ward. Motion Seconded by Commissioner Johnston. The motion was passed unanimously. City Staff present: Nicole Birch, City Clerk and Marshall Read, Lead Planner 3. Approval of Meeting Agenda • Commissioner Johnson moved to approve the meeting agenda. • Commissioner Petersen seconded the motion. The motion passed unanimously. 4. Approval of Minutes • Approval of our minutes from our meeting of April 8, 2025. Commissioner Bricker moved to approve the minutes, seconded by Commissioner Bies. The motion passed unanimously. 5. Public Comments A guest expressed concern about our Trapping in Ocean Shores proposal. Another guest stated that Metal Siding should be in OSMC 15 6. Old Business: • Roofing and Metal Fasteners: OSMC 17.50.210 Presented by Chair Lawlis and Marshall Read, Lead Planner A discussion was held concerning a proposal that came out of a meeting of Mark Lawlis and Marshall Read. This item was tabled until our next meeting. • Additions to Definitions in OSMC 17.50 (Awnings/Canopies/Intermodal Shipping Containers – CONEX) Presented by Chair Lawlis and Marshall Read, Lead Planner Commissioner Bricker moved to approve this change. Commissioner Bies seconded the motion. The motion passed unanimously. • Trapping in Ocean Shores Presented by Planning Commission Vice-Chair Bricker A comprehensive discussion was had by all present. This item was tabled until our next meeting. 7. New Business: • Wiring Methods and Materials: OSMC 15.24.020 Add Section (F) to read: New or replaced Meter Sockets must be stainless steel. Public Comments: • A guest stated that Hazardous Waste Facilities need to be looked at and addressed. 13. Roofing materials shall be wood shingle or shake, composition, asphalt laminate, clay, or architectural metal. 1. Membrane roofs comprised of torch down, polyvinyl chloride or hot tar as a primary roofing material in residential buildings are permitted provided the exposed facade is screened from street-level view. 2. Exposed fastener corrugated metal or corrugated fiberglass roofing is not permitted. 3. Exposed fastener ribbed or architectural metal roofing is not permitted for any structure larger than 200 square feet. (Approved 2-25-2025). 4. Exposed fastener ribbed or architectural metal roofing is allowed for both non-accessory structures and accessory structures, as well as permitted gazebos, canopies, and awnings. Fasteners must be designed for metal roofing, match its color, and be installed with uniform spacing per the manufacturer's recommendation. (Approved 2-11-2025) Roofing and fasteners must have a manufacturer’s guarantee of at least twenty years, in compliance with OSMC 17.26.060 D. I. Architectural elevations must meet the following: 1. The same architectural elevation shall be separated by a minimum of two other homes. Reversing/mirroring home does not change the architectural elevation. 2. An articulation is an architectural element such as a one-story porch or bay window. One such element shall be used on sides of the building that face toward a public street, shared access easement, or common green. The articulation shall be offset a minimum of twelve inches. A garage setback does not count as an articulation. 3. Both attached and detached garages All permitted structures on the property must be in keeping with the home’s architectural design and finishes. J. Exterior finishes must meet the following: 1. Wood, or wood-style, insulated lap, or other nonmetallic-appearing architectural metal siding is required on primary structures and permitted accessory structures. Page 5 of 9 outbuildings, unpermitted structures less than 200 square feet, permitted tubular canopies, carports/boat covers over 200 square feet and permitted accessory structures. a. The exterior of the home primary structures, outbuildings and permitted accessory structures must be finished with a minimum of two types of materials or variation in reveals. Window and door trim count as a second reveal. ; architectural metal siding is allowed as an accent only on up to 50 percent of any wall and not the primary siding material on the primary structure and/or detached garages over 200 square feet. b. Where exposed fastener architectural or ribbed metal siding is prohibited on residential buildings permitted. Fasteners must be specifically designed for metal siding, be the same color as the siding, and must be installed with uniform spacing as recommended by the manufacturer. Metal siding, roofing and fasteners approved for use, must carry a manufacturer’s guarantee of at least twenty years, consistent with OSMC 17.26.060 D. c. Exposed ends of stone and masonry facades must be finished with trim or end caps. d. All garage sides that are visible from streets or shared access easements shall provide architectural details and trim consistent with the design of the home. e. Attached garages or attached carports which provide a third bay or more of covered or enclosed space must be offset a minimum of two feet from the first two covered or enclosed spaces. f. On gazebos, canopies, and awnings, no more than four feet of the upper section of the wall may be architectural or ribbed metal siding. 3. Page 6 of 9 17.50.115 Nonaccessory Structures – Standards and Applications Owners of undeveloped real property as defined in Section 17.04.371 may erect one shed- type structure, one gazebo, and a fence on a vacant lot. Said nonaccessory structure may be erected pursuant to the following conditions: A. The property owner shall complete a city of Ocean Shores nonaccessory structure application, which application shall include: 1. A completed nonaccessory building permit application with applicable fee as set by resolution; and 2. A proposed site plan; and 3. Drawings and/or photographs of the proposed shed-type structure and fence, including dimensions; and B. Nonaccessory sheds may not exceed one hundred twenty square feet in area, and twelve feet in height; and C. Nonaccessory gazebos may not exceed two hundred square feet in area, and fifteen feet in height; and D. Nonaccessory sheds may have a permanent foundation which must be securely anchored in a tie-down fashion; and E. The exterior wall surface of nonaccessory sheds shall be constructed of non-metallic wood like appearance, wood, vinyl, and/or resin. 4. Allowed The city council recognizes that the practice of trapping for animals is very hazardous in an area where families reside and businesses are carried on, and declares that it is the policy of the city to prohibit allow trapping of any nature whatsoever within the city limits for wildlife threatening human life safety or causing property damage. (Ord. 199 § 1, 1976) 8.20.110 Unlawful Trapping wildlife threating human safety or causing property damage – procedure, limitations, and conditions. Any person who hunts for fur-bearing animals with any trapping device of any nature whatsoever within the city limits shall be guilty of a Class B offense as defined in Title 7 of this code. (Ord. 281 § 3 (part), 1979: Ord. 199 § 2, 1976) (1) Subject to limitations and conditions established by the City, the owner, the owner's immediate family member, the owner's documented employee, or a tenant of real property may contact City Animal Control Officer to establish the threat of human safety or property damage caused. (2) Once the City agrees that there is wildlife threating of human safety or causing property damage the owner or representative will contact WDFW to establish contact with a Licensed Wildlife Control Operator. (3) The Wildlife Control Operator will be required to get the necessary permits from WDFW before trapping can begin along with notifying City Safety Officer before the placing of the traps within the city. (4) Trapping will be consistent with RCW 77.15.194, or kill wildlife that is threatening human safety or causing property damage, licenses required under RCW 77.65.460 or authorization from the WDFW Director under RCW 77.12.240. (5) All cost incurred for the trapping of the wildlife shall be the responsibility of the property owner. 8.20.120 Exemptions Unlawful. The Washington State Game Department shall be allowed to trap for animals, with the approval of the public safety director of the city, when such activity is necessary under the circumstances. (Ord. 199 § 3, 1976) Any person who hunts fur-bearing animals, except as outlined in 80.20.110, with any trapping device of any nature whatsoever within the City shall be guilty of a Class B offense as defined in Title 7 of this code. 5.
