Greendale Village Board, 173Wis. 2d 553, 494 N.W. 2d 408 (1993) and must be noticed as such, although the Common Council will not take any formal action at this meeting. 1  MEMORANDUM DEPARTMENT - WATER UTILITY Date: July 19, 2022 To: Committee of the Whole and City Council From: Scott Osborn P.E. – Water Superintendent Joe Pickart – Utility Manager Re: Consider / Recommend / Act – Use of ARPA Funds to Supplement Public LSL Replacements RELATES TO THE STRATEGIC PLAN Strategic Goal- I – PROVIDE A SAFE AND SECURE COMMUNITY  I.D.5 – Evaluate the removal of lead water laterals (private and public) BACKGROUND The City of Oconomowoc currently has approximately 900 public and over 1,100 private side lead water service lines (LSL) serving customers in our system. Using Utility records and our GIS, we are working continuously at confirming the exact number and locations of the LSL’s and reaching out to those homeowners and asking:  Do you know if you have a lead water service line (LSL)?  Do you know the health effects of consuming lead?  Did you know there is a city program that provides grant funding to help with the replacement? The City is currently in year 2 of the Wisconsin Department of Natural Resources (WDNR) Private Lead Service Line (LSL) Replacement Program which provides financial assistance to residents to replace their private side lead water service line. Currently the City replaces the public side of any water main that is in its’ Annual Street Maintenance Program project and works with the private residents on options to replace theirs at the same time. Starting in 2021, we were able to create a new Private Lead Water Service Line Replacement Program because we were awarded over $200,000 of WDNR grant funding to help homeowners. Our program was able to remove 71 private and 32 public LSLs from our system in 2021. ADDITIONAL ANALYSIS Tonight, Utility staff will provide an update on the status of the 2022 LSL replacement program including the number of potential, committed, and completed private (and public) replacements, along with a discussion of the funding sources in place for this year’s program. To do so, we integrated an LSL solution into the GIS conversion and development the City is currently undertaking with consultants. We will present to you tonight the dashboard that summarizes all of the parameters touched on above, plus more. 1 2 FINANCIAL IMPACT For 2022 on the private side, the city was fortunate enough to again secure grant funding from the Wisconsin Department of Natural Resources (WDNR) and will continue to provide these reimbursements to pre-qualified contractors for the private side replacement of a lead water service line.  We have been awarded $600,000  To provide up to 200 residents with a maximum of $3,000 each for their LSL replacement  City will also continue to provide supplemental funding from Ixonia Bank o 5-Yr loan at 1 ½% interest For 2022 on the public side, if the homeowners’ property also has a LSL on the City’s side, the program mandates that we replace our portion of the LSL at the same time (within 45 days, by rule). The process for these is as follows:  If the project also encounters an LSL on the public side, the same contractor will provide the City a quote and all the LSL replacement will occur at the same time.  City proposes to pay for the public side LSL replacement using the following funding sources: o Utility budget - $350,000 o American Rescue Plan Act (ARPA) funds – up to $700,000 after Utility budget exhausted RECOMMENDATION Staff recommendation - Approve use of a portion of the ARPA funds to supplement the current Utility budget for any public side LSL replacement in conjunction with an approved private side LSL replacement in our program. COW - Consider/recommend that the additional funding for any public side LSL replacements in conjunction with a confirmed private side LSL that is in the Oconomowoc Private Side LSL Replacement Program, be paid for by ARPA funds currently allotted to the City specifically for these types of projects. City Council – Adopt Resolution 22-R3051 SUGGESTED MOTION COW - Consider/recommend that the additional funding for any public side LSL replacements in conjunction with a confirmed private side LSL that is in the Oconomowoc Private Side LSL Replacement Program, be paid for by ARPA funds currently allotted to the City specifically for these types of projects. Consider/recommend passing Resolution 22-R3051 which authorizes the use of up to $700,000 of ARPA funds for public side lead service line (LSL) replacements. City Council – Adopt Resolution 22-R3051 2 3  RESOLUTION NO. 22-R3051 AUTHORIZING EXECUTION OF THE USE OF ARPA FUNDS FOR PUBLIC SIDE LEAD SERVICE LINE REPLACEMENTS WHEREAS, the City of Oconomowoc (the “Municipality“) currently has a Private Lead Service Line (LSL) Replacement Program (the “Program”) which provides financial assistance to homeowners with a confirmed LSL and use of a pre-qualified plumbing contractor; and WHEREAS, the Municipality has also identified LSL remaining on the public side that is required to be replaced within 45 days of the private side replacements; and WHEREAS the City has exhausted its current Utility Budget under Project #602-573- 7000-222006. NOW, THEREFORE, the Mayor and City Clerk are authorized by and on behalf of the Municipality to execute the use of up to $700,000 of ARPA funds to supplement the replacement of the public side LSL in conjunction with the private side LSL replacement through the City’s Private LSL Replacement Program.
