IV. CONSENT E. Council will consider the renewal of the Microsoft Licensing Agreement. This Licensing includes all Microsoft Office 365 accounts, desktop and server operating systems and mobile device management. This budgeted renewal is in the amount of $408,288.30. F. Council will consider the purchase of two automated side load refuse trucks. These trucks will be in addition to the fleet we currently have based on demand. Each truck will cost $381,257 for the total amount of this item being $762,914.00. G. This purchase will be for three side load refuse replacement trucks. The purchase will retire three current fleet vehicles based on their replacement schedule. Each truck will cost $278,673.00 for the total amount of this them being $836,019.00.00 V. OTHER COUNCIL ACTION PUBLIC HEARING 1. This public hearing is to hear the request of Roger Gearhart for a specific use permit to allow a dance hall in Retail zoning district. The property of this request is located at 1541 John Ben Sheppard Parkway, Suite 18. The Planning and Zoning Commission previously heard this request at their November 4th, 2021 meeting and unanimously approved with the following conditions: (1) required parking needs to be striped, (2) any signs need to meet zoning ordinance requirements, (3) adoption of a site plan and (4) review of the permit if any neighborhood complaints are received. RESOLUTION 3. Council will consider a professional services agreement with Newton Engineering for the roadway reconstruction designs of 31st Street, from Andrews Highway to Dixie Boulevard, and Tanglewood Lane, from 52nd Street to Penbrook. The design will include reconstructing the existing pavement, replacing broken curb and installing concrete valley gutters for drainage. The design is anticipated to take six months to complete. Tom Kerr, Director of Public Works/Utilities, recommended to engage Parkson Corporation to rebuild a mechanical bar screen at the Bob Derrington Water Reclamation Plant for $141,817. There was a one year warranty. Mr. Kerr explained the screen’s function which was to catch objects to keep from going into the plant. The repair would take four to six weeks after the parts were received. Motion was made by Council member Thompson and seconded by Council member Willis to approve the rebuild of the mechanical bar screen for $141,817. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Sprawls, Willis, and Swanner Nay: None PUBLIC HEARING Open a public hearing to consider approval of the request by Wyly & Fredna Brown Family Partnership LTD & All Nations Bridge of Hope Inc., owners, LCA, agent, for various original zoning and rezoning requests to Retail (R) and Retail-One (R-1) (31.63 acres total) located in Section 4, Block 41, T-2-S, T&P RR. Co. Survey, City of Odessa, Ector County, Texas (southeast intersection of P Bar Ranch Rd. and N. Faudree Rd.) Randy Brinlee, Director of Development Services, reviewed the location which was vacant. The purpose was to facilitate retail development and other related uses. The area was 31.63 acres. After development, a back road would be incorporated for the area. The Planning and Zoning Commission recommended for approval. No one came forward and the public hearing was closed. Motion was made by Council member Swanner and seconded by Council member Thompson to approve the ordinance on first approval. The motion was approved by the following vote: Aye: Joven, Matta, Thompson, Sprawls, Willis, and Swanner Nay: None RESOLUTION Resolution No. 2021R-78 – Bid award for the Water Treatment Plant rehabilitation and miscellaneous upgrades to Garney Companies, Inc. and authorize an agreement with Carollo Engineers, Inc. for project management during and post construction phase services and appropriating funds for said agreement. Mr. Kerr stated that Garney and Carollo representatives were present. There was a short recess from 6:17 p.m. to 6:19 p.m. Mr. Kerr stated two bids were received and reviewed. It was recommended that Garney be awarded the bid for the Water Treatment Plant rehabilitation and Carollo Engineers be the project management. Garney had a bid of $71,553,712.64 and with a reserve 19% contingency. Carollo Engineers, Inc. Phase 4 Project Management services to cost $9,437,000. The total cost was $95 million using the 2021 Certificates of Obligation which was within budget. He reported that there were local contractors to be used for the project. Council member Thompson stated that the funds stayed in the community and appreciated the use of local contractors. Mr. Kerr did not have the history for change orders but change orders were vetted. Motion was made by Council member Thompson and seconded by Council member Sprawls to approve the resolution. Fire Stations #6 and #9 construction update. John Alvarez, Fire Chief, reported that Fire Station #6 construction was going well with the completion date of July 2022. MW Builders was proactive with the project and there were no major change orders. He stated Station #9 was on-going with electrical, plumbing, and mechanical work. The completion date was extended to April 13. He stated that overall, the projects were within budget. He reviewed the expenditures. Station #6 was larger than Station #9. Council member Willis asked that pictures of the progress be provided on the City’s website. Chief Alvarez stated that the artwork for Station #9 was secured. The artwork for Station #6 would be finalized soon. There was a process for selecting the art through Odessa Arts. He reported on the status of the apparatus. Microsoft licensing agreement. Mike Parrish, Director of Information Technology, stated that the agreement was for the Microsoft licensing that included operating and desktop. The cost was $408,228. Changes to modify Section 12-2-5 – One-way streets and alleys of the City Code. Hal Feldman, Traffic Engineer, stated that there was a sight distance issue for the southbound drivers on the east of Tom Green alley. He recommended to make a one-way alley northbound. PSA with Newton Engineering PC for designs of 31st and Tanglewood roadway reconstructions. Mr. Feldman stated that the Newton agreement was for the design of 31st St. and Tanglewood. The design work would take six months for a cost of $190,000. PSA with Landgraf, Crutcher and Associates for design of Crane Ave. reconstruction. Mr. Feldman stated that the agreement was for the design of Crane Ave. from 2nd St. to Pool Road. The design work would take six months for a cost of $180,660. He stated that any portion of the sidewalks of reconstruction would be repaired but no new installation of sidewalks. Council Work Session Minutes November 16, 2021 Page 2 Purchase three side load refuse trucks for Solid Waste. Mr. Urrutia stated that the three refuse trucks were for the dumpsters for commercial and residential pick up. The total cost was $836,019. There was a 9.3% cost increase due to materials. Purchase two automated side load refuse trucks for Solid Waste. Mr. Urrutia stated that the two side load refuse trucks were for the carts. He explained the truck type for a cost of $762,914. The two trucks would be additions to the fleet. He reviewed the number of pickups per day. One City Council meeting for the month of December 2021. Mr. Marrero stated that tradition has been to have one meeting in December. The Council meeting would be held on December 14. The proposed zoning and rezoning requests will not constitute a conflict to the established land uses in the general area, is not contrary to the land use plan of the City of Odessa's Master Plan and will not have a negative impact on this site or surrounding properties. The proposed retail and related use development is not out of line with the existing mix of various residential use and retail/commercial use development in the area and is an appropriate use of land adjacent to a major thoroughfare (Faudree Rd.). The proposed zoning districts will be encircled by existing single/multi-family residential use development, retail/commercial use development and will facilitate a reasonable transition between land uses of varying intensities. The Planning and Zoning Commission approved this request (4 members present) to Retail (R) and Retail-One (R-1) on October 21, 2021.
