Recommended Planning and Zoning Commission Action: Case File 2023-12-Z ____ Approved ___x__ Deny Detail of the Request: The applicant, Maverick Engineering, is requesting a zone change from PD-LI, Planned Development-Light Industrial District, to a Light Industrial District, on Lot 1, Block 12, Leeco Industrial 12th Filing and Lot 1, Block 6, Leeco Industrial Filing, to advance the development as proposed to allow the addition of the proposed buildings. Current Zoning: LI, Light Industrial District Surrounding Land Use: Properties located to the north are zoned Planned Development – Light Industrial District – Drill Reservation (PD-LI-DR). Properties to the east are zoned a mix of Planned Development – Light Industrial District (PD-LI), and Planned Development- Light industrial District0Drill Reservation (PD-LI-DR). Properties to the south are zoned a mix of Planned Development – Light Industrial District-Surface Drainage (PD-LI-SD). Finally, properties to the west are located in the Extraterritorial Jurisdiction (ETJ). Analysis: The property involved in this request is located west of Tucker Rd, approximately 1,320-feet north of E Interstate 20-Council District 2. The Site is currently designated Planned Development – Light Industrial District (PD-LI), and is currently developed. The applicant is LOD Odessa Re Investments, LLC, Owner, Maverick Engineering, agent, and the purpose of the zone change request is to create Light Industrial Development in the area. Using the City’s identified priorities contained in the City of Odessa’s Comprehensive Pla to evaluate zoning amendments the following comments are offered: Comprehensiveness: This request is not out of line with the City of Odessa’s Comprehensive Plan. The property is located near to Planned Development – Light Industrial District (PD-LI) zoning which allows for Light Industrial and the associated less intense use. Livability: The Proposed zoning would not have a negative impact on this site or surrounding properties. The proposed light industrial development is not out of line with development in the area. Reasonableness: The proposed zoning district will facilitate a reasonable transition between land uses of varying intensities and would not create a conflict to the existing land uses in the area. Planning: No Comments. Based upon the preceding analysis, Staff recommends approval of the request. Vice-Chairman Russell opened a public hearing and asked for any concern or questions, Hearing none, Closed public hearing then turned to commission and asked for discussion or a motion, Member Jimmy Peacock asked questions to staff over the comments made on reasonableness. Its not about of situations out there, will not create conflict to existing land uses and not out of the ordinary, line. I was on the Board when we had zoned that, and that was PD for a reason. As Ms. Prieto stated according to Mr. Larry Lee, who zoned location, it was to restrict the list of uses, keep residential out of that area. Ms. Prieto comments with as part of Light Industrial, that is an allowed use of Light Industrial. As Ms. Coots comments this is why when it was rezoned, we kept from Workforce Housing from being a part of that area. If we could keep the same restrictions of housing or Workforce housing out of the area. Joe Tucker, PW Director, approaches the podium and states that the reason this was all zoned PD-LI instead of LI was it has two items with its development. Sexual Orientation business would not be allowed use as they are allowed in LI, Light Industrial district. As for Curb and Gutter are not in this street, as the whole area not one has a curb and Gutter, was the reason. As LI would require them to provide Curb & Gutter, as a City Standard. Member J. Peacock ask if we went Light Industrial South Interstate, it’s been too long since we did this to remember. Mr. Tucker replies with yes, as I re-reviewed this case, but I am going through memory, reasons for PD-LI were stated with this request. As we remove PD-LI to just LI it removes these restrictions. Ms. Prieto comments the portion Joe Tucker, something I did not remember however, but he is correct. It would remove all restriction from the PD we had presented on this case first. As member Jimmy Peacock ask, “What are the proposals to place here”? Ms. Prieto replies with the Intent of owners is to place a Truck Wash Bay in the area as well as Truck parking and Warehouse in Industrial use. Member Jimmy Peacock ask Ms. Prieto if they plan to use the whole tract. To which Ms. Prieto answers yes, the top part for the property, north, as well as the south, they own both. Vice chairman, W. Russell, states with as of now, they aren’t going to place these here. With what the problem is could we review with what we are going to do here now. Member J. Peacock asked Ms. Prieto if we members could approve what they would like to place now. Ms. Prieto comments what can be indicated as a board, as what was indicated on the site plan could be approved. With comments from j. Peacock to keep it PD-LI? To which Ms. Prieto replies, yes to keep PD- LI. I do not have a problem with them coming back to us and asking for permission, this is the very reason it was placed as PD-LI. Mr. Peacock states. Ms. Prieto states this case could be as Mr. Peacock interrupts with no one has come forward to object into this carwash. Ms. Prieto answers as to no one has come forward to protest of the proposed truck wash, wash bay that they are planning to place there. However, the Zoning request is denied. As Mr. Peacock as of confusion, Ms. Coots answers by not changing the zoning request, would keep those requirements safe. Ms. Prieto comments by not Changing the Zoning request from PD-LI, the proposed project Truck wash and building, could be approved. Could approve the PD-LI Wash and Deny the zone to change from PD-LI to just LI. Ms. Coots comments on not wanting to change it. At this time Mr. Russell ask for any additional questions or comments. Ms. Connie mentions the need to deny request but approve Truck wash. Vice-Chairman, Wayne Russell turns to his commission for Motion. Commissioner Jimmy Peacock moves to Deny the request of Zone change, with Commissioner Connie Coots seconded the motion, with the vote being a unanimous vote “aye”. Mr. Wayne Russell, Vice Chairman, opens another motion to approve the Truck wash, building and Warehouse, (Ms. Prieto mentions, the site plan they would be bringing in) Commissioner Connie Coots moves to approve Site Plan of the City, Commissioner Gary Sims seconded the motion, with the vote being a unanimous "aye". Recommended Planning and Zoning Commission Action: Case File 2023-61-P (ETJ) __X__ Approved _____ Deny Detail of the Request: The applicant, Larry & Shelia Pendleton, owner, S.W.
