meet were approved, motion for approval being made by Commissioner

Analysis:
The property involved in this request is located northeast of the Intersection of Legacy Rd and E
Yukon Rd. The site is currently designated Future Development (FD) and is currently vacant
and undeveloped. The applicant is 2015 Cross B, LLC, owner, LCA. Agent, and the purpose of
the original zoning request is to create residential development in the area.
Using the City’s identified priorities contained in the City of Odessa’s Comprehensive Plan to
evaluate zoning amendments the following comments are offered:
Comprehensiveness: This request is not out of line with the City of Odessa’s Comprehensive
Plan. The property is located near to Special Dwelling District (SPD) zoning which allows for
Special Dwelling District (SPD) and the uses.
Livability: The Proposed zoning would not have a negative impact on this site or surrounding
properties. The proposed light residential development is not out of line with development in the
area.
Reasonableness: The proposed zoning district will facilitate a reasonable transition between
land uses of varying intensities and would not create a conflict to the existing land uses in the
area.

The applicant, Maverick Engineering, is requesting a zone change from, (SPD)
Special Dwelling District, to a (PD) Planned Development District for Housing
Development Including Special Housing Types on a 223.04-acre tract of land
situated in Sections 27 and 28, Block 42, City of Odessa, Texas, for development
of multiuse Site including Single Family housing, townhomes, cottages housing,
and greenspace/ detention.
Current Zoning:
(SPD) Special Dwelling District, (SPD-SD) Special Dwelling District-Surface Drainage,
and (SPD-DR) special Dwelling District-Drill Reservation.
Surrounding Land Use:
Properties located to the north and east are zoned Special Dwelling District (SP-D) and
Single-Family Residence District (SF-1), respectively. Properties to the south and west
are zoned Future Development District (FD).
Analysis:
The Applicant, Maverick Engineering, who is representing Betenbough, is requesting approval
of a zone change for the development of a mix of residential, and greenspace uses. This
proposed subdivision will have a total of one thousand one hundred eighty-seven (1,187)
residential lots, and approximately 61.543 acres of greenspace (PID) that is composed of parks,
trails, easements, and common areas.
The proposed residential districts include, Single Family Dwelling Detach, Cottages, and Duplex
lots.
The applicant is proposing the development to be executed in thirteen (13) phases. The lots
width will vary from either 30, 45, 50, 60, 75, or 85 feet and the minimum depth would be 85,
115, or 125 feet. The properties that fall in the minimum lot depth is less than 1%. Below is a
chart with the lot class tabulation, representing them by phases and percentage by lot widths.
The site plan introduces a new housing prototype called Cottages. These homes will have an
underlying zoning of SPD, Special Dwelling District but with the following amendments.
1. The minimum lot Width shall be 50 feet.
2. The minimum lot Depth be 85 feet.
3. The minimum lot Area shall be X, X00 square feet.

The proposed density for each district is as followed:
Core (SF-3): 4.56 units per acre
Cottage (SF-3): 6.6 units per acre
Townhouse (TH-Attached): 8.3 units per acre
Reserve (SF-3): 3.9 units per acre

Including Special Housing Types, subject to conditions A through F.
Conditions:
A. That the Property shall Significantly conform to the site plan attached hereto as
Exhibit “A&B”.
B. That each lot identified as Exhibit "A” as “Cottage” is subject to the following
conditions and regulations:
1. The minimum lot Width shall be 50 Feet.
2. The minimum lot Depth be 77 feet.
3. The minimum lot Area shall be 4,200 Sq ft.

Based upon the preceding analysis, staff recommends approval of the zone change from (SPD)
Special Dwelling District to a (PD) Planned Development District for Housing Development
Including Special Housing Types, subject to conditions A through F.
Mr. Sims ask if they have ever done something like this before? To which Ms. Elizabeth
responds with wanting the applicant to come up and give the information.
I will now at this time allow the two representatives come up and present their plans, and as well
they are establishing one in Midland which already established in Lubbock. They could comment
on the sizes, and details of the parks. Mr. Ronnie Wallace & Chris Berry, Betenbough
Representatives, approached the podium. To which Mr. Peacock, Commissioner,
approved of building parks and improvements, to the area. Mr. Wallace states “as we
expand our homes, to North Park, Sqft size is very similar to what we will be presenting,
as we have already done this in Gardendale before. Ms. Connie Coots, Commissioner,
replies to smaller lots sizes? Mr. Wallace replies yes, 50x85 to which we are introducing
40ft by 85ft. Fits an 1100sq ft home, with a bit narrower, to which will be adjacent to the
big layout over 100th. To address your questions on the parks, we have pocket parks,
potentially we could get 50ft x 115ft lot place a park on that, normally would be
accommodated by the layout with some trees, play structure, and seating for the parents.
Going to install three of those, then we will have two half acre parks on the north and
south of our, 52acres in general and a connector trail between north and south side. Get
a history back from our parks, trying to figure a way to get this donated to the city, to get
a quality of life for the city, and work with the city. The homeowners in the area are the
only one paying for the city, which will help other city owners. Which will help because we
are not over taxing or overburdening the rest of Odessa with maintenance on this park,
what we like about the PID. Elizabeth and some of the staff has done an amazing job
getting the ordinance all created, set up for these parks, helping by crossing T’s and
dotting I’s. Now which Mr. Peacock ask of the remainder of the funds and how will it work
for these parks. Mr. Wallace replies to him as to let him know the appraisal district will tax
the homeowners, from there we will work on more details to get those funds from those
owners. In Lubbock if your home is worth 300 thousand dollars, your 15 cents per hundred-
dollar evaluation, you would end up paying three hundred dollars a year. Then that money
would present itself into a specific fund, that the city maintains, and the city may not use
those funds otherwise to maintain these parks. Ms. Coots ask what the thought process
is for price range for these homes. Mr. Wallace answers to one hundred seventy-five to
two hundred thousand dollars, to which would depend on material and cost increase on
buildings, and how quick we can get them on the ground. “Who can use those parks” Mr.
Peacock ask, as you have others paying for it? Mr. Wallace answers to which can be
used by all of Odessa residence. Mr. Berry mention a detail from Development Directors
request, Elizabeth Shaughnessy, People paying into the PID would only be homeowners
in this community, Advantages of setting up this PID. Connie Coots, Commissioner,
replies with we need to establish more PID’s. Mr. Steve Tercero, Commissioner, ask what
the hill they have out there is going to be? Mr. Wallace replies with the continuing of
building since coming to a haul since needing to work on items request of Engineering
Department requirements. Will eventually be filled for house pads, and as we cut out the
rest of the streets, will slowly dissipate. Mr. Tercero, make a relief comment, as was
worried what else they planning to do. Mr. Wayne Russell asks since we are just doing a
PID, people were paying for all parks. Just wonder how the residence felt about paying
for a public park. Mr. Wallace answers with the existing development and working with
residence who have paid for previous parks in the past, example was the Lubbock development.
Has been over ten years with the first one in Wolford, was set up a little different on assessment,
and trying to get one in Amarillo as well. Most of the PID’s and how they know them is the
developers or community to get bonds for infostructure improvements, as we taken this as a
maintenance. A Different way of doing them, to which has always worked well for us. Allow us to
put a quality of life for residence, like walking spaces and bike trails. The way we communicate
with the homeowners, set it on how its received, there is a small check box on the paperwork’s to
which they check, and we explain it to them they sometime still won’t understand it. What’s the
timing of the installation of these parks? And are the houses going to be done in phases? Will
they get done before the housing? Asked by Mr. Peacock. To which Mr. Berry replies on the
criteria of assessments of arranging these houses. Before building these parks, you must have a
road that leads to that, as we would not want our public to cross a construction road to get to the
park. We add the asphalt and complete or try to before working on the park as when the first
house closes, we will complete the park surrounding it. Which will allow the homeowners to utilize
the parks as they move in. First Park we would establish is a pocket park, then the south park
which is half an acre, then add the connecting trail, to which we will complete other pocket park
and then finally north. East to the playa we will complete the other pocket park and will table
several years before the money is supplied enough to maintain the parks. How about watering for
the grass and trees? Mr. Peacock ask Mr. Berry to which he replies. Will utilize the water from the
city, as tied into the city water, which will fall under parameters with water restrictions. Bigger
parks we are going to try to use irrigation wells so its not a strain on the city. As the bigger parks,
water irrigation will be set up, which could potentially be a big problem for the city with city water.
Mr. Tercero, Commissioner, States about four or three years ago city council approved of
homeowners to be taxed and I have not seen any of these parks yet. Maybe Maria may remember
it better, which the homeowners would be taxed for these upkeep parks. To which maria
remembers it was talks of the parks, but not exactly sure which area it was. Mr. Wallace mention
the work with Michael Moreno, staff had come and visited the parks in Lubbock, to which they got
the ordinance created. Which some parts were missing and needed to get implemented in to
