Minutes Beach Nourishment Committee Meeting October 17, 2023
Meeting called to order by Sandy Boyer 6:35P.M. at OD Fire House
Attendees: Sandy Boyer, John Lawicki, Peter Mavrelis (remote), Bruce Boyer, C. J. Jackson,
Charles Sheaff, Scott Kingan, Dave Schneider
The minutes of the September 19th meeting were approved.

Permitting:
The approval for the shore preservation of the middle section is on hold at this time. We have
been advised by our engineer that we should not seek approval for the project from the
agencies involved which include the Army Corp of Engineers, National Park Service, and Indiana
Department of Natural resources until the complaint from Save the Dunes is resolved. This is
scheduled for a decision on May 1 2024. If approval is granted we can anticipate shore
preservation to begin next fall.

Mediation:
It appears that we will get a favorable ruling for no mitigation on the work done on the east
end of Ogden dunes for 2020. We also do not anticipate any mitigation for the future work on
the center section.

Sand restoration:
Much discussion occurred regarding plans from the Army Corps of Engineers regarding the
dredging of Burns Ditch and possibly moving sand from the Port of Indiana to the Portage and
Ogden Dunes Beach. These decision appear favorable for Ogden Dunes.

Final letters are going out to settle the issue this month.

Save the Dunes
The next meeting is not until 5/1/24 as Save the Dunes attorneys expect to have many
documents to go through.
The IDNR attorney is not going to ask for summary judgment. She will fight the case as
the IDNR doesn’t believe they did anything wrong.

We think construction can go through the winter if our weather is mild. The IDNR
attorney says we can work above the ODHW mark, but Dan is concerned that working
in some places could block access to the homes that need work below the ODHW
mark. It might also increase costs since we would lose the economies of scale of doing
the entire project at one time.

Ladders to beach – CJ
Litigation & Mitigation – Mediation session October 10. The next meeting with mediator is
November 21.
Reconciliation - A letter has been prepared to go out to homeowners on the east end who have
not paid the balance of what they owe. It is awaiting the approval of the Town attorney.
Community Comments/Questions
Issues on hold: gifts purchased for donors & requestion donations from residents.
The November meeting is cancelled. Our next meeting is scheduled for December 19 at 6:30 p.m. in the
Community Room at the Fire House.
