A. Approval of Minutes - June 5, 2024
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the
Minutes of the June 5, 2024 Regular Meeting as presented.

B. Approval of Voucher Detail - June 18, 2024
RESOLVED, that the Board of Trustees of the Village of Ossining hereby approves the
Voucher Detail Report dated June 18, 2024 in the amount of $1,095,987.56.

C. Workers Compensation Third-Party Administrative and Risk Services
RESOLVED, that upon review by the Corporation Counsel, the Village Manager is
authorized to sign an agreement with PMA Management Corp., 5789 Widewaters
Parkway, DeWitt, New York 13214 to provide workers compensation third-party
administrative and risk services to the village for a term commencing on October 1, 2024
through December 31, 2027.
D. Easement agreement with Deerfield Homeowners Association
RESOLVED, that following review by the Corporation Counsel, the Mayor is authorized
to sign an easement agreement with Deerfield Homeowners Association c/o Heritage
Management Services, LLC, P.O. Box 265, 346 Route 202, Somers, New York 10589; and
be it further
RESOLVED, that the easement agreement will allow for the installation, repair,
maintenance and reconstruction of a twelve inch transmission watermain which will
improve fire flows and the resiliency of the water distribution system for the benefit and
safety of the residents of the unincorporated area of the Town of Ossining and primarily
for the transmission of water for use within the Village of Ossining.
E. Proposal from Manganaro Engineers
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign the June 10, 2024 proposal from Manganaro Engineers, 303 South
Broadway, Suite 223, Tarrytown, New York for bidding services, office services during
construction and field services during construction for the installation of approximately
960 linear feet of new 8 and 12-inch diameter Class 54, ductile iron water mains on
Whitetail Circle, Hawkes Avenue and a portion of Route 9A entrance and exit ramp.
The work also includes the installation of in-line gate valves and new fire hydrant
assemblies.
F. Memorandum of Understanding related to the Community Choice Aggregation Plan
WHEREAS, the Village of Ossining is a member of Sustainable Westchester and a
participant in the Community Choice Aggregation Program (“CCA” or the “Program”);
and
WHEREAS, the current Electric Service Agreement (“ESA”) for the Sustainable
Westchester CCA Program terminates on October 31, 2024; and
WHEREAS, the Village desires to continue to engage the services of Sustainable
Westchester, Inc. as the Program Manager for CCA and for administration of the
Program; and
WHEREAS, in connection with the CCA, Sustainable Westchester has provided the
Village with information regarding the plan to secure a new ESA (the “2024 ESA”); and
WHEREAS, a new Memorandum of Understanding (the “2024 MOU”) with Sustainable
Westchester will allow for the bid for electricity supply to be awarded to the lowest-
priced responsible bidder; and

WHEREAS, the purpose of the 2024 MOU is to: a) establish the Village’s participation in
the CCA to be managed by Sustainable Westchester, Inc. under the 2024 ESA; b) to
affirm that the Village and Sustainable Westchester, Inc. agree to adhere to the terms
and conditions of the 2024 ESA in the event the 2024 ESA is executed; and c) to affirm
that the Village and Sustainable Westchester, Inc. agree to execute the 2024 ESA, subject
to the conditions of review and approval outlined in the MOU; and
WHEREAS, demand for voluntary renewable energy certificates (“RECs”), which have
historically been the medium for the purchase of renewable energy in support of the
Program, has exceeded available supply, such that at this time, suppliers can only offer a
50% renewable supply option as the default product for the 2024 ESA, along with an
opt-out option that allows participating customers to elect to select a 100% renewable
supply option; and
WHEREAS, developments in the REC market may make it possible for suppliers to
provide a 100% renewable supply option as the default product for the 2024 ESA before
commencement of service, which change in the default product would be effectuated
through an amendment to the 2024 ESA; now therefore be it
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to execute the 2024 MOU with Sustainable Westchester, Inc. and the
associated 2024 ESA, subject to receiving a Compliant Offer, as defined in the MOU, as
required to continue participating in the CCA program; and be it further
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign an amendment to the 2024 ESA to change the default product to a
100% renewable supply option, should such an option become available before
commencement of service under the 2024 ESA.
G. Call for Public Hearing-Proposed Local Law -2024 titled “A Local Law amending
chapter 91, sections 91-23 and 91-24 (Building Construction, Payment of review costs
and failure to pay review costs) of the Village of Ossining Code.”
RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a
Public Hearing to take place at 7:30 pm on July 17, 2024, at the Birdsall Fagan Police-
Court-Facility, 86-88 Spring Street, Ossining, New York to consider proposed Local Law
-2024, titled, “A Local Law amending chapter 91, sections 91-23 and 91-24 (Building
Construction, Payment of review costs and failure to pay review costs) of the Village of
Ossining Code”; and be it further
RESOLVED, that the proposed local law reduces the time for an applicant to dispute
charges for review costs associated with land use matters from 15 days to 5 days; and be
it further
RESOLVED, that members of the public are invited to attend the public hearing in-
person at the above-referenced location; and be it further
RESOLVED, that those members of the public requiring a reasonable accommodation to
participate in the public hearing due to that person’s disability, shall notify the
Corporation Counsel no later than seven (7) days before the public hearing
(kahan@villageofossining.org) to afford the village sufficient time to provide the
reasonable accommodation; and be it further
RESOLVED, that for those members of the public who want to attend/participate in the
public hearing remotely, access will be available via the Zoom platform; and be it further
RESOLVED, that comments regarding the proposed local law will be accepted by the
Board of Trustees at BOT@villageofossining.org.

Proposed Local Law (2024- Chapter 91)
H. Adoption of Changes to Fee Schedule for 2024 – Other than Water and Sewer Fees

WHEREAS, the Village’s adopted Financial Goals and Policies requires, in part, the
establishment and periodic evaluation of user charges and fees to help reduce reliance on
real property taxes, and
WHEREAS, the Village recently adopted Local Law 2-2024, amending chapter 226
(Special events, parades and public gatherings) which local law went into effect on April
11, 2024; and
WHEREAS, the Village recently adopted Local Law 4-2024, amending chapter 162
(Housing/Property Maintenance and Building Code Administration) which local law
went into effect on May 10, 2024; and
WHEREAS, the Village recently adopted Local Law 5-2024, repealing chapter 162,
article VIII (Housing/Property Maintenance and Building Code Administration, Vacant
Building Registry) and adopting a new chapter 249 (Vacant building and storefront
registry) which local law went into effect on May 20, 2024; and
WHEREAS, at the June 12, 2024 work session, the Board of Trustees discussed with
village staff proposed fees for these recently enacted local laws; now therefore be it
RESOLVED, that the Village’s Fee Schedule is hereby amended, effective June 19, 2024,
for the following user charges and fees:
I. Intermunicipal agreement with Westchester County (Mobile radios for mutual aid
purposes)
RESOLVED, that following review by the Corporation Counsel, the Village Manager is
authorized to sign an intermunicipal agreement with Westchester County acting through
the Commissioner of the Department of Public Safety to furnish the village with mobile
radios including hardware, supplies, cabling, antennas, microphones and accessories for

the village to install at its sole cost and expense in village-owned police vehicles.
J. Reappointment of Village Clerk- Susanne Donnelly
RESOLVED, that the Village of Ossining Board of Trustees hereby reappoints Susanne
Donnelly as Village Clerk for a term of office through December 31, 2027. This
appointment is retroactive to January 1, 2024.
K. Fire Department – Appointment – Ossining Hose CO. #1
RESOLVED, that upon recommendation of the Fire Chief, Sebastian Quizhpi, Ossining,
New York was elected as active members of Ossining Hose CO. #1 for interior
firefighting.

X. NEW BUSINESS OF THE BOARD
A. Site/license agreement with Drop Mobility
WHEREAS, on May 1, 2024, Village Engineer Paul Fraioli signed a Letter of Intent
which states in part, “This letter verifies the intent of the Village of Ossining to execute a
Site Agreement that permits Shared Mobility Inc. (SMI) and its operational partners to
deploy bikeshare stations at various Village-owned or controlled sites”; and
WHEREAS, bikeshare stations refer to a non-permanent (metal base plate) e-bike
docking station that is not connected to the utility grid and does not have charging
capabilities; and
WHEREAS, by the letter of intent the Village agreed to work with SMI to develop
mutually agreeable site agreements to guide the deployment of bikeshare stations on
Village property and in the public right of way; and
WEHEREAS, the site/license agreement will define rights and responsibilities related to
the installation, operation and maintenance, access, ownership and disposition,
insurance, and indemnification of NYSERDA, privacy data and publicity; and
WHEREAS, the Village and SMI have developed a list of eleven (11) locations on village-
owned property or within the village’s right-of-way where the bikeshare stations can be
located, a list of the locations is below; and
WHEREAS, SMI has contracted with Drop Mobility, the project services vendor which
entity will provide the e-bikes, stations/racks and the ground operations of the bikeshare
program; now therefore be it
RESOLVED, that following review by the Corporation Council, the Village Manager is
authorized to sign a site/license agreement with Drop Mobility.

B. Finance – Establishment of Sparta Park Playground Equipment Capital Project from

Playground Equipment designated to be financed by a NYS Community Resiliency,
Economic Stability, and Technology Program (CREST) Grant, now therefore be it
