VOUCH DET IBWTP031826 E. BOARD OF TRUSTEES- AUTHORIZING THE HIRING OF JOEL R. DICHTER OF DICHTER LAW LLC AS SPECIAL COUNSEL TO REPRESENT PARTICIPATING WESTCHESTER MUNICIPALITIES IN MONITORING THE CON EDISON RATE SETTLEMENT WHEREAS, the Westchester Municipal Consortium (WMC) including the Village of Ossining hired Joel R. Dichter of Dichter Law LLC to represent participating Westchester County municipalities in Con Edison’s electric and gas rate case before the New York Public Service Commission; and WHEREAS, the New York State Public Service Commission recently approved a three- year rate settlement with Con Edison starting January 1, 2026; and WHEREAS, it is in the best interest of the Village of Ossining and the Westchester Municipal Consortium that the settlement be monitored for compliance with the terms agreed upon with the New York State Public Service Commission; and WHEREAS, Joel R. Dichter of Dichter Law LLC has the necessary experience and expertise to represent the interests of the participating municipalities in this matter and has submitted a three-year monitoring proposal dated February 1, 2026; and WHEREAS, the proposal includesmonitoring submissions, respond thereto when Legislative Meeting March 18, 2026 Page 2 of 8 necessary, participate in the WMC specific meetings, and provide periodic updates to the Westchester Municipal Consortium at a cost of $1,250 per participating municipality per year; now therefore be it RESOLVED that following review by the Corporation Counsel: 1. that the Village of Ossining Board of Trustees hereby authorizes the hiring of Joel R. Dichter of Dichter Law LLC as special counsel to represent participating Westchester municipalities of the Westchester Municipal Consortium to monitor the approved New York State Public Service Commission settlement in accordance with the three-year proposal from Joel R. Dichter of Dichter Law LLC dated February 11, 2026; and 2. The participating municipalities shall share the cost of legal and related fees incurred by Joel R. Dichter of Dichter Law LLC, with the total annual amount of such representation not to exceed $1,250 per year per participating municipality; and 3. The Village Manager is hereby authorized sign the aforementioned proposal. F. DPW - Award of Bid – Painting of Lakeville Water Tank RESOLVED, that, subject to review by Corporation Counsel, the Board of Trustees of the Village of Ossining hereby awards the bid for Contract No. DPW-25-06, Painting of Lakeville Water Tank, to Bridgeway Associates Corp., 519 Yale Avenue, Hillside, NJ 07205 for the total bid amount of $1,393,850.00 as the lowest bid received from a responsive and responsible bidder; and be it further RESOLVED, that following review by the Corporation Counsel the Village Manager is authorized to sign the documents for Contract No. DPW-25-06. G. Board of Trustees- Old Croton Aqueduct Phase 1 Meter Vault Improvements- Type II Designation WHEREAS, on February 19, 2025 the Board of Trustees authorized the Village Clerk to advertise for bids for Contract DPW 25-05, Aqueduct Meter vault Improvements; and WHEREAS, the proposed improvements add a new raw water connection internal to the existing vault structure to provide a new flowmeter for assessing raw water usage and a new control valve to better control the pressure and flow to the downstream aqueduct to reduce resulting water losses; and WHEREAS, pursuant to 6 NYCRR section 617.6(a)(i) and Village of Ossining code chapter 118 a determination must be made whether the proposed improvements are subject to the State Environmental Quality Review (SEQR) and if the improvements are determined to be a Type II action the village has no further responsibilities pursuant to SEQR; and WHEREAS, Type II actions “have been determined not to have a significant impact on the environment or are otherwise precluded from environmental review under Environmental Conservation Law, article 8”; and WHEREAS, 6 NYCRR section 617.5(c) identifies Type II actions including “maintenance or repair involving no substantial changes in an existing structure and facility”; and WHEREAS, the New York State Department of Parks, Recreation and Historic Preservation which department oversees the Old Croton Aqueduct determined that the proposed improvements should be considered a Type II action under SEQR; now therefore be it RESOLVED, that the Board of Trustees determines that the Old Croton Aqueduct Phase 1 Meter Vault Improvements will have no significant impact on the environment and is designated as a Type II action. H. Board of Trustees- Proposed Assessment (Snow Removal)- 42 Calam Avenue WHEREAS, 42 Calam LLC is the owner of property at 42 Calam Avenue (90.13-1-6) (“Property”); and Legislative Meeting March 18, 2026 Page 3 of 8 WHEREAS, pursuant to section 229-6 of the Village of Ossining Code (Code):  Every owner…or other person having charge of any building…in the Village abutting upon any street, avenue or public place shall within six hours after the cessation of every fall of snow or the formation of any ice on the sidewalk or public way abutting such building…cause the snow or ice to be removed or cleared entirely from the sidewalk or public way abutting such building…  In case the snow or ice on the sidewalk or public way abutting any building…shall not be cleared of snow or ice…the Village Manager shall direct the Superintendent of Public Works or the Building Inspector to promptly clean or cover the sidewalk…The cost or expense of doing such work…shall be ascertained by the Superintendent of Public Works or Building Inspector.  Within ten days of the snow/ice removal from the sidewalk, the Superintendent of Public Works or Building Inspector will send to the owner…a notice of proposed assessment of costs by certified mail.That notice will provide the amount and purpose of the proposed assessment for the work performed; the date, time and location where the Board of Trustees will meet to hear and determine all objections to the proposed assessment; and that the Board of Trustees will determine an assessment that is just and reasonable not exceeding, in the event of default the amount in the notice.The proposed assessment will include a 20% administrative charge.The notice will include a statement that if the amount so assessed is not paid to the Village Treasurer within thirty days of the Board of Trustees’ determination, an action to recover the amount may be maintained by the Village against the property owner…; a special warrant may be issued as directed by the Board of Trustees; or the amount of the assessment may be included in the next annual tax levy to be collected and enforced in the same manner as property taxes; and WHEREAS, the owner failed to timely remove snow and ice on the sidewalk along the Calam Avenue in front of the Property; and WHEREAS, pursuant to section 229-6 of the Code, the Village arranged to have the snow removed; and WHEREAS, the snow was removed by Villa & Sons Construction Corp., the village’s contractor on February 28, 2026 at the village’s request; and WHEREAS, the owners were sent a Notice of Proposed Assessment of Costs and Notice of Hearing noting the total amount due to be $172.80 consisting of the invoice for the work performed ($144) plus a 20% administrative fee ($28.80); WHEREAS, at the hearing on March 18, 2026 the Board of Trustees discussed the assessment; now therefore be it RESOLVED, that the itemized costs noted below are just and reasonable; and be it further RESOLVED, that if the amount so assessed is not paid within thirty (30) days after the assessment by this board the Village Treasurer is directed to include the assessment in the next annual tax levy to be collected and enforced in the same manner as property taxes. Property- 42 Calam Avenue (90.13-1-6) Snow/Ice Removal $144.00 Administrative Fee $28.80 Total Due: $172.80 I. WHEREAS, on March 29, 2023, the village and Town of Ossining entered into an agreement with Fundamental Business Service (FBS), Inc., 14 Front Street, Hempstead, New York to provide parking enforcement management services to the Village and Town of Ossining for the collection and processing of parking tickets; and WHEREAS, the agreement has a three-year term expiring on March 29, 2026; and Legislative Meeting March 18, 2026 Page 5 of 8 WHEREAS, the agreement includes a provision that the agreement could be extended for an additional three years “by mutual agreement of the parties by the parties giving written notice to the other parties”; and WHEREAS, FBS and the Town of Ossining have agreed to extend the agreement for three years; now therefore be it RESOLVED, the following review by the Corporation Counsel, the Village Manager is authorized to sign the contract extension with FBS. FBS Contract Extension 2026-2029 K. Board of Trustees- Call for Public Hearing-Proposed Honorary Street Naming for Sharmaine Powell RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing to take place on April 8, 2026 at 7:30 p.m. at the Birdsall Fagan Police- Court facility, 86-88 Main Street, Ossining, New York to consider the proposed honorary street naming of the corner of South Highland Avenue and Croton Avenue in memory of Sharmaine Powell pursuant to the village’s Honorary Street Naming Policy; and be it further RESOLVED, that members of the public are invited to attend the public hearing in- person at the above-referenced location; and be it further RESOLVED, that those members of the public requiring a reasonable accommodation to participate in the public hearing due to that person’s disability, shall notify the Corporation Counsel no later than seven (7) days before the public hearing (kahan@villageofossiningny.gov) to afford the village sufficient time to provide the reasonable accommodation; and be it further RESOLVED, that those members of the public who want to attend/participate in the public hearing remotely, access will be available via the Zoom platform; and be it further RESOLVED, that comments regarding the proposed honorary street naming will be accepted by the Board of Trustees at BOT@villageofossiningny.gov Please click this URL to join: https://us06web.zoom.us/j/83741123373 Via phone: +19292056099 Webinar ID: 837 4112 3373 L. Board of Trustees- Public Hearing-Request for hardship exception to adult-use cannabis dispensary moratorium. WHEREAS, on September 30, 2025 the Board of Trustees adopted Local Law 5-2025 amending chapter 270 (Zoning) by adding a new article XX (Moratorium for submission and processing of land use approvals for cannabis dispensaries, vape shops, smoke shops, vape lounges and vape consumption businesses); and WHEREAS, the purpose of the local law was to temporarily suspend issuance of land use approvals for cannabis dispensaries, vape shops, smoke shops, vape lounges and vape consumption businesses in the Village of Ossining; and WHEREAS, the moratorium is scheduled to expire on June 2, 2026; and WHEREAS, section 270-103 of the Village Code details the process for an applicant to request an extraordinary hardship exception to the moratorium; and WHEREAS, Grand Peconic Ventures LLC dba Green Panacea submitted a letter dated March 2, 2026 with exhibits requesting a hardship exception; and WHEREAS, section 270-103C requires a public hearing on any application for an exception to the moratorium to be held no later than 45 days after receipt of a complete application; and Legislative Meeting March 18, 2026 Page 6 of 8 WHEREAS, the application from Grand Peconic Ventures LLC dba Green Panacea is considered to be complete; now therefore be it RESOLVED, that the Board of Trustees of the Village of Ossining hereby calls for a Public Hearing to take place at 7:30 pm on April 8, 2026 at the Birdsall Fagan Police- Court Facility, 86-88 Spring Street, Ossining, New York and via Zoom, to consider the application of Grand Peconic Ventures LLC dba Green Panacea, 159 Main Street, Ossining, New York for a hardship exception to the cannabis dispensary moratorium; and be it further RESOLVED, that members of the public are invited to attend the public hearing in- person at the above-referenced location; and be it further RESOLVED, that those members of the public requiring a reasonable accommodation to participate in the public hearing due to that person’s disability, shall notify the Corporation Counsel no later than seven (7) days before the public hearing (kahan@villageofossiningny.gov) to afford the village sufficient time to provide the reasonable accommodation; and be it further RESOLVED, that for those members of the public who want to attend/participate in the public hearing remotely, access will be available via the Zoom platform; and be it further RESOLVED, that comments regarding the application will be accepted by the Board of Trustees at BOT@villageofossiningny.gov Please click this URL to join: https://us06web.zoom.us/j/83741123373 Via phone: +19292056099 Webinar ID: 837 4112 3373 M. Board of Trustees- Adoption of plan document (Length of Service Award Program) RESOLVED, that following review by the Corporation Counsel, the Board of Trustees adopts the Village of Ossining Service Award Program Plan Document for the village’s Length of Service Award Program (LOSAP) offered to active volunteer firefighters of the Ossining Volunteer Fire Department; and be it further RESOLVED, that the voting members of the Board of Trustees shall sign the plan document. Village of Ossining Plan Document B. Board of Trustees- Adopt Village of Ossining Service Award Program Trust Document RESOLVED, that following review by the Corporation Counsel the Board of Trustees adopts the Village of Ossining Service Award Program Trust document dated January 2026; and be it further RESOLVED, that the voting members of the Board of Trustees shall sign the trust document. Village of Ossining Trust Document C. Recreation and Parks Department- Accept donation RESOLVED that the Superintendent of the Recreation and Parks Department is authorized to accept from Matt Gullotta on behalf of Gullotta House, 72 North State Road, #175, Briarcliff Manor, New York a donation of $750 for a 2026 camp scholarship; and it is further RESOLVED that the Village of Ossining Board of Trustees gratefully acknowledge the donation to the Recreation and Parks Department.
