MINUTE RECORD PAPILLION CITY COUNCIL MINUTES - AMENDED TUESDAY, NOVEMBER 1, 2022 e 7: 00 P. M. The City Council of the City of Papillion met in open and public session in the City Council Chambers at Papillion City Hall, 122 E Third St, on November 1, 2022, at 7: 00 PM. City Clerk Nicole Brown called the roll. Present were Councilmembers Steve Sunde, Tom Mumgaard, Jason Gaines, Jim Glover, Gene Jaworski, Lu Ann Kluch, Bob Stubbe, Steve Engberg, and Mayor David P. Black. Also present were City Administrator Amber Powers, Deputy City Administrator Phil Green, Deputy Administrator of Community Development Mark Stursma, Assistant City Attorney Carla Heathershaw Risko, Police Chief Chris Whitted, Fire Chief Bill Bowes, Deputy Public Works Director of Engineering/ City Engineer Alex Evans, Sports Turf Superintendent Casey Ballou, Recreation Director Tracy Stratman, Finance Director Nancy Hypse, Planning Director Travis Gibbons, Library Director Matt Kovar, and Human Resources Director Carrie Svendsen. Presentation: Ashley Gast and Christine Holder of the Mayor' s Youth Leadership Council presented their Council' s Quarterly Report. R22- 0186— A resolution to approve Kenneth C Eastwood as the Corporate Manager for FOE Aerie 4029 d/ b/ a Fraternal Order of Eagles 4029 for their Class " C" Liquor License Nicole Brown — 597- 2021. ORD. 1979— An ordinance to amend Papillion Municipal Code 44117- 4 and 117- 11 to revise the number of fireworks sales licenses, to amend fireworks regulations, and to provide for an effective date— Phil Green— 827- 1778. Councilmember Mumgaard made a motion to reopen the public hearing today and to table the vote for ORD. 1979 to the November 15 City Council Meeting. Councilmember Mumgaard explained that it came to his attention that more discussion needs to take place between the City and the fireworks distributors. Councilmember Gaines stated that he would like to make a substitute motion to table ORD. 1979 to the November 15 City Council Meeting, republish the public hearing notice, and hold the public hearing and vote at the November 15 City Council Meeting. Mayor Black called for a second on the substitute motion, second by Councilmember Engberg. Councilmember Mumgaard asked for clarification of what Councilmember Gaines' substitute motion would do. Mayor Black explained the difference between the two motions. Councilmember Mumgaard stated that he would like to withdraw his motion to table and asked what the proper procedures are for holding a public hearing. Ms. Heathershaw Risko explained the procedures for holding a public hearing and that the motion by Councilmember Gaines would allow for the public hearing to republished according to City Code. Mayor Black called for a vote on the substitute motion to republish the public hearing to be held at the November 15 City Council Meeting, and for the vote to be held at the same meeting. Upon roll call vote, Sunde, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe, and Engberg all voted yes. Voting no: none. Motion passed. 4 November 1, 2022 RES. R22- 0193 — A resolution to approve a Purchase Agreement between the City of Papillion and Tri- City Food Pantry for a portion of Tax Lot 31 Section 26, T14N, R12E of the 6th P. M., Sarpy County, Nebraska, consisting of approximately 2. 67 acres — Amber Powers 827- 1111. Motion to approve RES. R22- 0193 by Councilmember Sunde, second by Councilmember Gaines. Mayor Black called for proponents and opponents. Proponent: Chris Henkenius, 8533 S 102nd St, La Vista, explained the role of the Tri- City Food Pantry and their plans for the new building proposed to be built on the land purchased from the City. Opponents: None. Councilmember Mumgaard stated that he thinks it is important to have and to keep the Tri- City Food Pantry in Papillion and that he plans to support this resolution. Upon roll call vote, Sunde, Mumgaard, Gaines, Glover, Jaworski, Kluch, Stubbe, and Engberg all voted yes. Voting no: none. Motion passed. ADMINISTRATIVE REPORTS: Committee Reports: Public Safety Committee: Councilmember Kluch explained that the Committee discussed the Property Maintenance Code, which should be going to Council for consideration within the next couple of months. The Public Safety Committee is scheduled to meet again on November 15. Comments from the Floor: Beth Norris, 2425 Corn Dr, explained that she would like to see a traffic light installed at S 84th St and Corn Dr for the entrance to the new Shadow Creek neighborhood. Ms. Norris stated that she would also like to see the related traffic study released for public viewing before the November 15 City Council Meeting. Ms. Norris lastly stated that she is concerned with the number of heavy vehicles and construction equipment that will potentially be using the entrance at S 84th St and Corn Dr. John Lowndes, 11909 S 48th St, Bellevue, stated that he was representing the St. Columbkille Shepherds and wanted to thank Council for reopening the public hearing for ORD 1979 and tabling the vote to the November 15 City Council Meeting. 5 November 1, 2022 Comments from Mayor and Council: Mayor Black provided an update on his events: ( 1) Mayor Black met with the Papillion Art' s Foundation; ( 2) Mayor Black attended the Sarpy County and Cities Wastewater Agency Board Meeting; ( 3) Mayor black attended the 2022 Mayor' s Forum; ( 4) Mayor Black attended the Sarpy County Chamber Annual Awards Celebration. Mayor Black reminded those present of upcoming events: ( 1) Ribbon Cutting for Lux American on November 10; ( 2) Veterans Grille Day Ceremony on November 11; ( 3) Ribbon Cutting for Inspired Dental on November 11. Mayor Black stated that if anyone has legislative requests to send them to himself or Ms. Powers. Councilmember Kluch explained that a citizen had emailed her regarding a sun glare issue in the mornings at Papillion Landing. Councilmember Kluch thanked Recreation for their prompt response to the request. Councilmember Engberg thanked Mr. Kleffner and the Public Works Department for a successful Fall Clean- Up Days. Councilmember Sunde asked if there has been any discussion on moving Fall Clean- Up Days later into the season so residents have time to take care of the leaves that have fallen in their yards. Mayor Black stated that he would work with Staff on this request. ADJOURNMENT: Motion to adjourn by Councilmember Glover, second by Councilmember Gaines.
