Michael Tomsik, Tomsik - Tomsik Architects, Inc. 921 Literary Road Cleveland, Ohio 44113, for 10601 Pleasant Valley Road PPN: 457-34-001. The applicant is requesting a variance to Section 1111.05(b)(3) - ESTABLISHMENT OF RIPARIAN SETBACKS. (b) Riparian setbacks are established as follows: (3) A minimum of seventy-five feet on both sides of all other watercourses draining an area greater than one-half square mile and up to twenty square miles. Along with Section 1111.07(a) USES PROHIBITED IN RIPARIAN SETBACKS. Any use not authorized under these regulations shall be prohibited in riparian setbacks. The following uses are specifically prohibited, (a) Construction. There shall be no structures of any kind. The proposal is to construct building additions within the 75’ riparian setback. A variance would result in allowing construct an addition 26”-8” and one 23’-10” into the 75’ riparian setback. After discussion Michelle Green made the following recommendation: 3 I make a motion to grant the variance with the following stipulations: 1. The site’s impervious surface shall be reduced. 2. A grass covered street buffer strip shall be installed in accordance with PCO 1199.07(b) between the street and the public sidewalk. 3. A 6-foot-wide grass covered buffer strip shall also be constructed between the public sidewalk and the edge of the parking lot as required by 1199.07(c). Plantings shall be required. The applicant shall submit a site plan to the Building Department for review and approval by the Planning Commission. George Mastrobuono second the motion. George Ziefle, Allesan Armstrong, Michelle Green and George Mastrobuono are all in favor. A second variance was requested to Section 1170.08 SCHEDULE OF YARD AND HEIGHT REGULATIONS: Minimum Required Yards for One and Two Story Buildings - Setbacks Adjacent to Other Districts – The required side yard setback for Auto Service is 10 feet. The proposal is to construct a building addition at a 5-foot side yard setback. A variance would result in a building addition being constructed 5 feet into the required side yard setback. After discussion George Mastrobuono made the following recommendation: I make a motion to approve the variance subject to the owner and builder following all the instructions and requirements of the Building Department and the reason being the variance would not be substantial, and justice done by granting this variance. He has a small group of local golf pros where they discuss various things in their profession. Golf Simulators Trackman is the industry’s leader. Ninety out of the 100 top PGA players use Trackman. It is something that they vetted through several different companies. They had the Law Department review the quotes. The golf simulators are something that will generate revenue and anything in the project stands to generate revenue. Reminded everyone about the 9/11 Memorial next week. ------------------------------------------------------------------------------------------------------ Councilwoman Lime – Thanked the Safety Fair Committee and the officers who go above and beyond getting donations, making sure everything is done. Thanked the Service Department for their quick response to some trees that came down into sidewalks and roadways during the tornado and also picking up debris. Stated she will be asking First Energy for the ages of the transformers in back yards. There was a transformer in her ward that was put up in 1955. It exploded and hazardous material was on the garage, shed, back of house, deck, driveway and new truck. Someone could have been hurt.
