MINUTES OCTOBER 21, 2024 COUNCIL MEETING PARMA COUNCIL CHAMBERS 7:52 P.M. The Regular Council Meeting was called to order by President of Council Vito Dipierro presiding: COUNCIL MEMBERS PRESENT: AMANDA BOYD MARK CASSELBERRY ALLAN DIVIS ROB EUERLE KEVIN C. KUSSMAUL DEBORAH LIME KAMMY SHUMAN MONICA WILSON KELLY ZACHARIAS Mrs. Saban – Mr. Chairman, the Roll of Council has been called, and I find a quorum of Council members present. The following officials and department heads were also present: Mayor Timothy DeGeeter, Law Director Scott M. Tuma, Treasurer Tom Mastroianni, Service Director Tony Vannello, Safety Director Bob Coury, Building Commissioner Dan Kulchytsky, City Engineer Hasmukh Patel, Communications and Community Relations Director Carolyn Kovach, Recreation Commissioner Mickey Vittardi, and Clerk of Council Kristin L. EUERLE, K.C. KUSSMAUL, A. BOYD, M. CASSELBERRY, A. DIVIS, D. LIME K. SHUMAN, M. WILSON, K. ZACHARIAS A RESOLUTION HONORING ST. VLADIMIR UKRAINIAN ORTHODOX CHURCH ON THEIR 100TH ANNIVERSARY. Mrs. Saban – Stated that the Resolution will formally be presented to St. Vladimir Church at the November 6th Council Meeting. Motion made by Councilman Kussmaul seconded by Councilwoman Lime to adopt Resolution No. 179-24. Motion carried. 1 RESOLUTION NO. 184-24 10-21-24 BY: K. ZACHARIAS, A. BOYD, M. CASSELBERRY, A. DIVIS, R. EUERLE, K.C. KUSSMAUL, D. LIME, K. SHUMAN, M. WILSON A RESOLUTION HONORING RYEN WINNETT 2024 COACH OF THE YEAR YOUTH SOCCER Motion made by Councilman Casselberry seconded by Councilwoman Shuman to adopt Resolution No. 184-24. Motion carried. The Resolution was presented by Councilwoman Zacharias, and Proclamations were presented by the Mayor, and Law Director. ------------------------------------------------------------------------------------------------------------ LEGISLATIVE COMMENT No one wished to speak. ------------------------------------------------------------------------------------------------------------ DISPOSAL OF JOURNAL Mr. Dipierro – Stated, you have before you the minutes from the October 7, 2024, Regular Council Meeting. Asked if there were any additions or corrections to the minutes? Stated, hearing none, the minutes will stand as printed. ----------------------------------------------------------------------------------------------------------- COMMUNICATIONS, PETITIONS AND CLAIMS Request from the Ohio Division of Liquor Control for a C1, C2 for DBA Holy Smokes Cigar & Wine, 7824 Broadview Rd. Parma, Ohio 44134. Responses must be postmarked no later than October 28, 2024. Mr. Dipierro – Copy of said permit was referred to Council and the Safety Director. ------------------------------------------------------------------------------------------------------------ AMENDMENT TO THE CALENDAR Motion made by Councilwoman Lime seconded by Councilman Casselberry to amend the Calendar by accepting revised Exhibit for Ordinance No. 181-24. ZACHARIAS (By Request – Community Services & Economic Development Director) AN ORDINANCE AUTHORIZING THE MAYOR OR HIS DESIGNEE TO ENTER INTO A LEASE AGREEMENT WITH WELLNET PROPERTIES, LLC, FOR THE LEASING OF OFFICE SPACE LOCATED AT 5517 STATE ROAD, IN THE CITY OF PARMA, FOR THE PERIOD OF FEBRUARY 1, 2025, THROUGH JANUARY 31,2026, TO BE UTILIZED BY THE CITY OF PARMA ECONOMIC DEVELOPMENT AND COMMUNITY SERVICES DEPARTMENT, AND DECLARING AN EMERGENCY Mr. Dipierro – Said Ordinance will be referred to the Finance Committee. 2 ORDINANCE NO. 178-24 10/21/24 BY: D. LIME AN ORDINANCE TO AMEND THE SCHEDULE OF PERMITTED BUILDINGS AND USES SET FORTH IN SECTION 1170.03 OF THE PARMA CODIFIED ORDINANCES TO PERMIT BODY ART ESTABLISHMENTS IN RETAIL BUSINESS ZONING DISTRICTS AND SHOPPING CENTER ZONING DISTRICTS, AND DECLARING AN EMERGENCY Mr. Dipierro – Said Ordinance will be referred to the Planning Commission and Planning Committee. ------------------------------------------------------------------------------------------------------------ ORDINANCE NO. 183-24 10/21/24 BY: K. DIVIS (By Request – City Engineer) AN ORDINANCE AUTHORIZING THE MAYOR AND/OR DIRECTOR OF PUBLIC SERVICE TO ENTER INTO A CONTRACT WITH THE LOWEST AND BEST BIDDER FOR THE VALLEY VILLAS DRIVE SEPTIC ABATEMENT PROJECT, INCLUDING PORTIONS OF YORK AND STATE ROADS, AND DECLARING AN EMERGENCY Mr. Dipierro – Said Ordinance will be referred to the Finance Committee. ------------------------------------------------------------------------------------------------------------ SECOND READING: ORDINANCE NO. 106-24 10/7/24 BY: D. LIME (By Request – Safety Director) AN ORDINANCE TO AMEND SECTION 606.31 OF THE PARMA CODIFIED ORDINANCES TO INCLUDE NON-RESIDENTIAL PROPERTIES AND TO FURTHER UPDATE THE CITY’S NUISANCE PROPERTY ORDINANCE, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilman Casselberry to refer Ordinance No. 106-24 back to the Public Safety Committee. LIME (By Request – Safety Director) AN ORDINANCE AUTHORIZING THE MAYOR AND/OR THE DIRECTOR OF PUBLIC SAFETY TO ENTER INTO A CONTRACT TO PURCHASE AND INSTALL EQUIPMENT TO OUTFIT SIX (6) CHEVY SIVERADO’S AND THREE (3) CHEVY TAHOE’S FOR THE PARMA POLICE DEPARTMENT, AND DECLARING AN EMERGENCY Motion made by Councilman Casselberry seconded by Councilwoman Shuman to refer Ordinance No. 171-24 back to the Finance Committee. Motion carried. 3 ORDINANCE NO. 172-24 10/7/24 BY: M. CASSELBERRY, M. WILSON (By Request – City Engineer) AN ORDNANCE AUTHORIZING THE MAYOR OR DIRECTOR OF PUBLIC SERVICE TO AUTHORIZE PAYMENT TO THE CUYAHOGA COUNTY DEPARTMENT OF PUBLIC WORKS FOR THE REPAIR AND RESURFACING OF RIDGE ROAD FROM PEARL ROAD TO FLOWERDALE AVENUE IN THE CITIES OF PARMA, BROOKLYN AND CLEVELAND, AND DECLARING AN EMERGENCY Motion made by Councilman Casselberry seconded by Councilwoman Lime to amend Ordinance No. 172-24 by accepting the Exhibit and refer Amended Ordinance No. 172-24 back to the Finance Committee. WILSON A RESOLUION RECOGNIZING OCTOBER AS “NATIONAL DOMESTIC VIOLENCE AWARENESS MONTH”, AND DECLARING AN EMERGENCY Motion made by Councilwoman Shuman seconded by Councilman Casselberry to adopt Resolution No. 180-24. Yes: Boyd, Casselberry, Divis, Euerle, Kussmaul, Lime, Shuman, Wilson, Zacharias. CASSELBERRY (By Request – Auditor) AN ORDINANCE AUTHORIZING THE TRANSFER OF APPROPRIATIONS WITHIN THE 2024 PERMANENT APPROPRIATIONS OF THE CITY OF PARMA, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilman Casselberry to adopt Ordinance No. 181-24. 4 Yes: Boyd, Casselberry, Divis, Euerle, Kussmaul, Lime, Shuman, Wilson, Zacharias. CASSELBERRY (By Request – Auditor) A RESOLUTION APPROVING THE CITY AUDITOR’S POST CERTIFICATION OF REQUISITIONS AS DETAILED IN EXHIBIT “A” AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilman Casselberry to adopt Resolution No. 182-24. Yes: Boyd, Casselberry, Divis, Euerle, Kussmaul, Lime, Shuman, Wilson, Zacharias. No: None; Resolution No. 182-24 is adopted. ------------------------------------------------------------------------------------------------------------ ORDINANCE NO. 185-24 10/21/24 BY: M. CASSELBERRY, A. DIVIS, R. EUERLE (By Request – Service Director) AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO ENTER INTO AN AGREEMENT WITH AM HIGLEY FOR GUARANTEED MAXIMUM PRICE (GMP), AMENDMENT NO. 3, FOR SUBSTANTIALLY COMPLETE CONSTRUCTION WORK FOR THE RIDGEWOOD EVENT CENTER AND GOLF COURSE CLUBHOUSE PROJECT, IN AN AMOUNT NOT TO EXCEED $7,081,369.00, CONSISTANT WITH SECTION 2 OR ORDINANCE NO. 194-22, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilman Casselberry to adopt Ordinance No. 185-24. Yes: Boyd, Casselberry, Divis, Euerle, Kussmaul, Lime, Shuman, Wilson, Zacharias. No: None; Ordinance No. 185-24 is adopted. ----------------------------------------------------------------------------------------------------------- PUBLIC SESSION No one wished to speak. ------------------------------------------------------------------------------------------------------------ MISCELLANEOUS BUSINESS Mayor DeGeeter – No comment. Safety Director Coury – No comment. Service Director Vannello – No comment. Law Director Tuma – Thanked Chief Blair, Assistant Chief Riley, and Safety Director Coury for allowing his staff to assist them in the continued education and yearly training of the Police Officers, who update their training annually. He thanked his staff as well. Safety Director Coury – Added that without the Law Department Staff, yearly training and education of the Police officers would have to be sourced out, and the Officers would have to be sent out for training. The Law Department has allowed this training to be done in- house with the same expertise. Treasurer Mastroianni – No comment. Councilwoman Boyd – No comment. Councilman Casselberry – No comment. Councilman Divis – No comment. Councilman Euerle – No comment. 5 Councilman Kussmaul – Wished everyone a Happy Halloween. Councilwoman Lime – Wished everyone a Happy Halloween and reminded all that the 14 Annual Treat-N-Greet will be held Saturday from 11-2. She encouraged everyone to come th and enjoy the event and check out the festive decorations in Polish Village. Councilwoman Shuman – No comment. Councilwoman Wilson – No comment Councilwoman Zacharias – No comment.
