It has not always been an easy route, but it has gotten better by having a full-time supervisor in the City, and they do respond when they are called. She has been working with Rumpke and having biweekly meetings, and she has seen improvements. Also stated the distance of the transfer station made a difference in her vote as well. Councilman Divis – Stated his vote is Yes with comment. He appreciates Rumpke being in our City. They are very responsive to any of the issues that he has brought to their attention. Councilman Euerle – Stated his vote is Yes with comment. DIVIS (By Request – Service Director) A RESOLUTION TO DEDICATE CITY LAND TO USE AS A PUBLIC RIGHT-OF-WAY, AND DECLARING AN EMERGENCY Councilwoman Wilson – Asked what the Let Project is and what problem are we solving by the legislation. Service Director Vannello – Stated this is part of the South Park Connector Trail that West Creek is running. City Engineer Patel – Stated the ODOT Let Project means that we prepare the design and construction plat and submit it to the Ohio Department of Transportation. They will advertise and manage the entire construction. This is a trail along South Park Boulevard from Snow Road to Grantwood Drive. The estimated Construction cost is approximately $700,000.00. The City secured the $650,000.00 funding. So, the City’s share will be approximately $50,000.00. Motion made by Councilwoman Lime seconded by Councilwoman Boyd to adopt Resolution No. 146-25. LIME (By Request – Safety Director) A RESOLUTION REQUESTING THE BUILDING COMMISSIONER TO INSTITUTE SUMMARY NUISANCE ABATEMENT OF PERMANENT PARCEL NUMBER 449-20-112, 6515 WESTMINSTER DRIVE, PARMA, OHIO AND DECLARING AN EMERGENCY Councilwoman Boyd – Stated this is a property that has been problematic. This Resolution will offer relief to the neighbors for the countless number of complaints. She appreciates the time and effort working with the Safety Director and the property inspectors. SHUMAN (By Request – Auditor) AN ORDINANCE TO AMEND THE 2025 PERMANENT APPROPRIATIONS OF THE CITY OF PARMA, OHIO, AND DECLARING AN EMERGENCY Auditor Day – Stated regarding the first group for the principal payments and interest: In 2024 we took out a 1-year note to do some roof work on a number of different buildings and this year we bonded that out, so we are appropriating those funds so we can pay off the note. The second item is for the Velma Avenue Water Line Replacement Project. The Cleveland Water Department paid the entire project upfront, and it was estimated to be $1.8 but came in at $1.3. So, we needed to refund the Cleveland Water Department the difference, which is $522,000.00. The last one is the request from the Senior Center. The Homebound Meal Delivery and Congregate Meals that the Senior Center provides have expanded this year. In speaking with the Senior Citizens Director, they needed to make some moves to assist them. For example, Western Reserve provides those meals. They budgeted $58,000.00 for the year. They are already at $54,000.00. On the opposite side of that, the revenue is coming in as well. They budgeted $170,000.00. They are already at $177,000.00. They decided they can reduce Transportation by $45,000.00, but they need to increase meals by $100,000.00. So, it is a net of $55,000.00. There are a number of items on the Post Cert Legislation for Western Reserve. This will help alleviate the problem because they will get the necessary funding. Mayor DeGeeter – Wanted to thank the Auditor and Deputy Auditor for working with our Senior Director and Service Director. SHUMAN (By Request -Auditor) A RESOLUTION APPROVING THE CITY AUDITOR’S POST CERTIFICATION OF REQUISITIONS AS DETAILED IN EXHIBIT “A” AND DECLARING AN EMERGENCY 10  Councilwoman Lime – Asked the Law Department for an explanation regarding $35,591.03 for the HCC Public Risk for Claim. Law Director Tuma – Stated this is a billing statement that emanates from the representation of the City involving a police chase and our insurance company’s outside Counsel is involved. The reason for the post cert is because the insurance company originally told the Law Department it was going to do the billing and it ended up that the insurance company did it directly. Councilwoman Lime – Asked if our share of the claim is $35,591.03? Law Director Tuma – Stated that is a portion up to a certain amount, but we are paying for outside Counsel. Councilwoman Lime – Asked if is for outside Counsel or for the claim? Chief Assistant Law Director Boyle – Stated pursuant to our insurance policy, we have to utilize the services of outside Counsel. They bill us against the claims. The claim is still pending, it is in Court, it is on the docket. Litigation is time-consuming and costly and those are the bills, so far, they have received. Councilwoman Lime – Asked do we have to, by contract, go to outside legal representation. Chief Assistant Law Director Boyle – Stated we can handle some of the claims, but when it gets to a point where it gets beyond a certain dollar amount, yes we do. Councilwoman Lime – Asked what is the lawsuit and dollar amount that the victim is requesting? Chief Assistant Law Director Boyle - Stated they do not have to pray for a specific dollar amount, it just has to be over $25,000.00. They have asked for significantly more than that. There was a chase that went into a neighboring community and involved an accident. Stated they are confident in their position. Law Director Tuma – Stated when the threshold is met, the insurance company obligates us to have an outside counsel on those types of claims. Councilwoman Lime – Stated she didn’t know there was a lawsuit. Feels they need an Executive Session and have more details. If we are already paying out money for litigation, when we go to renew the insurance, it could impede the insurance premiums. Chief Assistant Law Director Boyle – Stated what Councilwoman Lime is requesting as far as an executive session is accurate. If there was ever a settlement, obviously that would need to go before Council for conversation. He is not sure whether a conversation about the policies would fall within the parameters of Ohio Revised Code provisions. Law Director Tuma – Stated nobody knows, more intimately, how the insurance process works and how the claims impact our insurance, and they did discuss those aspects in executive session at some point. He would be happy to sit down at any time to talk insurance with any Council person. Councilwoman Shuman – Stated she doesn’t think going into executive session to talk about the $35,591.03 would do anything. We owe this dollar amount. We would be holding up everything else on this. Suggested Council pass the post certification tonight and go into executive session if they have the claim put in front of them. Law Director Tuma – Stated the current policy of outside counsel in place is the old policy. They inherited it. Councilwoman Lime – Stated she is concerned about the case and where we are and where we will be at with the insurance. Asked if it is policy or procedure for outside counsel? Mr. Dipierro – Stated, they should move on and discuss this more during committee meetings. Law Director Tuma – Asked Councilwoman Lime to put her questions in writing. KUSSMAUL AN ORDINANCE AUTHORIZING THE ADMINISTRATION TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH THE CITY OF PARMA HEIGHTS FOR THE ESTABLISHMENT OF A DOG PARK, AND DECLARING AN EMERGENCY Motion made by Councilwoman Lime seconded by Councilwoman Boyd to adopt Ordinance No. 164-25. Yes: *Lime, Shuman, Wilson, Zacharias, *Boyd, Divis, Euerle, Kussmaul. No: None; Ordinance No. 164-25 is adopted. Councilwoman Lime – Stated she is very excited to be voting Yes. Councilwoman Boyd – Stated she is also excited to be voting on the legislation. The City of Parma Heights has already passed legislation regarding the same. --------------------------------------------------------------------------------------------------------------- ORDINANCE NO. 173-25 9/2/25 BY: D. LIME, A. BOYD (By Request – Safety Director) AN ORDINANCE TO AMEND SECTION 1707.21 OF THE CODIFIED ORDINANCES OF THE CITY OF PARMA, AND DECLARING AN EMERGENCY Councilman Kussmaul – Asked the Safety Director if they are changing the verbiage to not limiting us to just residential going forward? Safety Coury – Stated when the Building Department reached out for guidance with the application of 1707.21, the Law Department caught some ambiguities in the code and one potential issue that may or may not make the current ordinance unconstitutional. As a result ,they did two basic fixes. One, to clarify that this does apply to premises in residential, not just commercial. Two, it removed the automatic 70% times the number of hours that are spent as a surcharge and instead deleted that language which could be problematic constitutionally and substituted it with making sure that the Building Department can get reimbursed for all of its costs, administrative and direct costs that are applied to abating a nuisance. No: None; Ordinance No. 173-25 is adopted. --------------------------------------------------------------------------------------------------------- PUBLIC SESSION Michael Johns, 7401 Dogwood Lane – Stated they have had major problems, over the past two summers, in their area with motorcycles racing up and down Pleasant Valley, up and down their streets. Stated that the issue was brought to their Council person’s attention last year and and nothing happened until today. Three police officers showed up at his house and they were going down to visit the house and found the motorcycles and talked to the parents and student. The Police told him that 10 other people complained and while they were down there, other members of the area came out of their homes and talked to them about the same problem. Today it finally got solved thanks to the Police Officers doing a great job. Stated he has a problem with how he was answered. He read a statement from Facebook from the Councilperson and felt it was unacceptable. Stated he had to make the videos to send into the Mayor’s Office to prove the issue with the motorcycles was happening. ------------------------------------------------------------------------------------------------------------- 12  Joe from Rumpke – Thanked Council for choosing Rumpke’s contract and allowing them and having the faith in them to keep servicing the residents with trash and recycling service. -------------------------------------------------------------------------------------------------------------- Annabelle Mayville, 6102 Snow Road – Stated a lot of things have been happening in her neighborhood with neighbors aggravating other neighbors. Also, Snow Road has become a drag strip. People fly up and down the street. There are kids on bikes, people walking, children walking to and from school. There is a resident who flies in and out of their driveway. Feels the speed limit should be reduced to 25 MPH. ----------------------------------------------------------------------------------------------------------------- MISCELLANEOUS BUSINESS Mayor DeGeeter – Asked Mrs. Mayville to stay until after the meeting to meet with the Safety Director. Regarding the speeding motorcycles on Pleasant Valley, he does know that the Sgt. went out there, the Council person was asking for action taken as well and it wasn’t just today, there were prior emails that we have tried to address and did different maneuvers with the Police Department. He will defer that to the Safety Director. Also, thanked Council for the passage of Ordinance No. 164-25. Everyone has been invited to the signing of the memorandum of understanding signing for the Dog Park. He looks forward to moving forward on joint Dog Park. ---------------------------------------------------------------------------------------------------------------- Safety Director Coury – Stated he has had a different experience than the good resident with the Council persons attention to Dogwood, Pleasant Valley, neighborhood and surrounding area. Her attention with respect to him goes back to July where she was insistent that we have the Police Department and himself look at the area for speeding, loud cars, etc. So, as a result, going back to July, these complaints were raised by Councilwoman Shuman and as a result, on July 22nd they deployed speed cameras on Valley Villas, on Arcadia and on Pin Oak. In addition, they deployed special attention for a one-week period in that same area which also included the Dogwood/Pleasant Valley neighborhood. When the resident again complained more recently on August 18th, Councilwoman Shuman again complained and asked for special attention in that area. As a result of that and as a result of the additional complaints that were raised they again deployed at 8429 Pleasant Valley and 8440 Pleasant Valley another traffic sign and they deployed special attention. Mr. Johns raised additional issues on Friday, but this time had videos and additional information. They were able to use that information and then Sgt. Desanio personally went out there. Again, at Councilwoman Shuman’s prodding they made direct contact with the resident, and the Sgt. targeted the individuals, counseled them and made clear that they had to get the motorcycle depicted. He wanted the record added to in terms on the work that was put upon him by Councilwoman Shuman’s actions. -------------------------------------------------------------------------------------------------------------------- Auditor Day – No comment. -------------------------------------------------------------------------------------------------------------------- Service Director Vannello – Thanked Council for their support on the garbage contract, the Colorados and let’s go build a dog park. -------------------------------------------------------------------------------------------------------------------- Law Director Tuma – No comment. ------------------------------------------------------------------------------------------------------------------- Treasurer Mastroianni – Stated he is also a member of the Facebook page that the gentleman spoke about. Ninety percent of the time It’s just complaining. Stated that Kammy is his Council person and there have been millions of dollars that were put into Ward 7. Stated Kammy is very responsive. ----------------------------------------------------------------------------------------------------------------- Councilwoman Lime – Commended Sgt. Desanio. Stated he assisted her with an issue in her Ward. Stated there has always been an issue with speeding on Snow Road. Especially now with the street being paved recently. Stated she will be requesting special attention. 13  --------------------------------------------------------------------------------------------------------------- Councilwoman Shuman – Stated Mr. Johns didn’t give the full information that she said. Read the full comment regarding speeding in the area. Further stated that her father was killed in a car accident. Stated she removed herself from that page and will never read another comment that the resident says about her. --------------------------------------------------------------------------------------------------------------- Councilwoman Wilson – Reminded everyone about the Ward 1 and 2 Safety Meeting on September 18th at the Fire Station. Stated she stands by Councilwoman Shuman 100%. -------------------------------------------------------------------------------------------------------------- Councilwoman Zacharias – No comment. -------------------------------------------------------------------------------------------------------------- Councilwoman Boyd – Commended the Service Department for their assistance with road repair, etc. She did receive several calls over the holiday weekend where repair was supposed to have started but there was a delay. Anytime she calls anyone in the Service Department, they are very responsive, which makes it easy to get back with residents when they have those questions. ------------------------------------------------------------------------------------------------------------- Councilman Divis – No comment. ------------------------------------------------------------------------------------------------------------ Councilman Euerle – Stated that being a part of the Auxiliary Police is truly a service to the City. Stated they run every parade, every check point and check every single streetlight every year for the City. Felt the Ukrainian parade was a huge success and a lot of fun. Thanked the Service Director and Mayor for making West Ridgewood paved again. The neighbors are happy. --------------------------------------------------------------------------------------------------------------- Councilman Kussmaul – Stated his residents are also excited about the paving of West Ridgewood. Thanked the Service Department for their assistance with resolving a port o potty issue on one of his streets. Thanked the Recreation Department for working with the Cleveland Building Trades for the Softball Tournament over the weekend. Commended County Councilman Casselberry for his bigtime fulltime effort with helping his team out. -------------------------------------------------------------------------------------------------------------- Clerk of Council Saban – Stated sitting up on the dais as the Clerk of Council she is on emails that come into the Council from all 9 Wards. The 9 Council Members do this job because they care about their neighborhoods and the community.
