MAYOR’S UPDATE Mayor Hector C. Lora updated the council and residents on the following: • COVID statistics from March 2020 to date: • 9,231 tested positive for Covid-19; of those there were 309 deaths; no deaths since June 2021. • Free Covid testing, vaccines, and booster shots are available every Wednesday from 10am-2pm at 333 Passaic Street. Passaic City Council November 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK • Over 85% of adults over 18 and over have been vaccinated. • 75% of residents under the age of 18 have been vaccinated. • Children over the age of five are now eligible for vaccinations. • Food distribution at City Hall continues on Wednesdays from 2:30pm until supplies run out. • Veterans day ceremony on November 11 at 9am in armory park 474 main avenue. Street cleaning will be suspended. Veterans Affairs leader Millie Hilliard- Cousins will be the host of the ceremony. • Ice skating rink will reopen on Friday Nov 12, from 4pm-7pm, and from sat-sun 10am-6pm. Free ice skates will be provided. • On November 17, turkey distribution to be held in partnership with Community Food Bank. Over 2100 turkeys and roosters will be distributed. • Nov 23, PBA will receive over 500 turkeys for distribution to seniors. • Over next few weeks, flu vaccines will be available through health department. • Special resolution honoring Carlos Zuniga, naming the corner of Bergen as Carlos Zuniga Way. LORA HONORIFICALLY DESIGNATING THE CORNER OF THIRD STREET AND BERGEN STREET AS “JUAN C. ZUNIGA TORRES WAY” WHEREAS, Juan Carlos Zuniga Torres (“Torres”) was born in a small town in Puebla, Mexico and immigrated to the City of Passaic (“City”) at a young age, where he was able to grow as an entrepreneur, community leader and raise a family; and WHEREAS, Torres’ first milestone in the City was when he trained to earn his State Golden Gloves title in boxing; and WHEREAS, Torres, making it a priority to be involved in the community, started his first business in the City in 2001, All Garden State Pest Control, which fostered a multitude of job opportunities; and WHEREAS, Torres, in 2008, opened Fiestas Nightclub with his brothers to offer the Mexican and Latino community a place to gather, celebrate traditional events such as Three Kings Day and other events native to Mexico, and to serve as a place for non-profit organizations to host events; and WHEREAS, Torres’ final business venture in the City of Passaic was opening his family restaurant, El Alebrije Mexican Restaurant on Main Avenue in the heart of the City, as a continuation his father’s legacy, with the restaurant being a gift to his loving wife Maria and an opportunity Page 3 of 50 Passaic City Council November 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK to work with his family, especially during the COVID-19 pandemic where many businesses feared closing; and WHEREAS, El Alebrije Mexican Restaurant additionally was a space where many public servants, including Governor Phil Murphy, U.S. Senator Bob Menendez, Assemblyman Gary Schaer and Mayor Hector C. Lora, among other community members, gathered to discuss helpful information on small business grants and the Passaic Urban Enterprise Zoning Program, which were essential to maintaining small businesses during the pandemic and allowing for those small businesses to prosper; and WHEREAS, as a member of the Mexican Chamber of Commerce, Torres became a resource for fellow business owners and future entrepreneurs in the City of Passaic; and WHEREAS, Torres performed these and many other acts without the desire for recognition, but from the kindness of his heart; and WHEREAS, as such, Mayor Hector C. Lora wishes to highlight the invaluable contributions made by Juan C. Zuniga Torres within the City of Passaic community. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Cecilia Kingsley, 285 Aycrigg • She congratulates Council resident Schaer on his reelection of 36th district. • Energized by mayor leadership on city improvements, including skating rink, parks. • Thanks for LED flash stop sign on Mead, however the problem is at Aycrigg and Mead. • City ordinances 209-15 and 209-16 address the appearance of a property should not constitute a blighting factor for surrounding property. 208 Passaic Avenue falls in this category. Rick Bergman, 256 Summer Street • Garbage pickup has been occurring as early as 4:30 am when pickup is supposed to be 6am or later. • Only half of Summer Street has been paved. Aryeh Mack, 187 Howard Ave • What are the plans to fix the sidewalk on Howard Avenue near the stream? • He wished the city luck on resolving the 208 Aycrigg Avenue issue. CITY OF PASSAIC RESOLUTION NO. 21-11-284 RESOLUTION AUTHORIZING INTERNAL ACCOUNTING CONTROLS WHEREAS, N.J.S.A. 40A:5- 16 requires that the governing body of any local unit shall not pay out any of its monies unless the person claiming or receiving payment first presents a detailed bill of items or demand, specifying particularly how the bill or demand is made up (“Invoice”), with the certification of the party claiming payment that the bill or demand is correct (“Claimant Certification”) and the payment carries a written or electronic certification of some officer or duly designated employee of the local unit having knowledge of the facts that the goods have been received by, or the services rendered to, the local unit (“Certification”); and WHEREAS, N.J.A.C. 5: 30-9A.6 gives local units discretion to not require claimant certification by enacting a standard policy by resolution for vendors or claimants who do not provide such certification as part of its normal course of business; and WHEREAS, generally, vendors do not provide such certification as part of the normal course of business which has created unnecessary confusion and delay in processing claims for payment; and WHEREAS, the Claimant certification cannot be waived for reimbursement of employee expenses, or for services provided exclusively and entirely by an individual; and WHEREAS, the Chief Financial Officer (CFO) has communicated internal accounting controls as follows, and Page 25 of 50 Passaic City Council November 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK has determined the same to be sufficient to avoid errors and fraud in the processing of claims for payment: 1) No goods or services will be procured without a valid Purchase Order issued by the City containing the signature of the City's Purchasing Agent. 2) Except for contract items approved by resolution of the City Council, or are issued directly by the Purchasing Agent, all procurement transactions must originate by way of a requisite ion in the City' s Finance System. As necessary, certain issues are escalated to review by the City' s Purchasing Agent and/or City Attorney. 5) The procurement of goods and services that are anticipated to exceed the Pay-to-Play threshold or the bid threshold are forwarded to the City' s Purchasing Agent for review and/ or processing. 6) All transactions in excess of $17,500 require approval by resolution of the City Council as a " Fair and Open Process", a " Non Fair and Open Process", an " Open Competitive Bid", or as one of several exceptions to the bid process. 7) Contracts are monitored for performance as payments are processed: a. The user Department shall certify performance. b. Purchasing and/ or Accounts Payable shall review requests for payment against the terms of the contract. Clerical assistance is available for most departments. Regular reviews are performed to assure that activity posted to the department' s budget, such as Purchase Orders and Cash Payments, is valid, proper, and authorized by the Department Head. 11) Claims for payment are submitted to Accounts Payable in the Finance Department by each department. Invoices are reviewed to verify that work was performed as authorized and that prices are consistent with original proposals. 12) Invoices, along with any supporting documentation(i.e. packing slip, quotes) are attached to the Purchase Order and submitted to Accounts Payable for payment. A responsible person with direct knowledge that the work was performed or goods received and/ or the department head shall sign the Purchase Order to authorize payment. 13) In processing Purchase Orders ( and invoices) for payment, Accounts Payable personnel shall review for: a. Certification by responsible person attesting that services were performed or goods delivered. b. Verify that payment is applied to proper contract, if applicable. c. MAYOR’S REPORT • Passaic received engineering award for Dundee island Park. • He congratulated former Fire Lieutenants William Diaz and Ernesto Rodriguez III who were promoted to Captain. • He congratulated Firefighters Bernie Lawson and Frank Perez who were promoted to Fire Lieutenant. • Passaic high school marching band took first place in the National Band Championship at MetLife Stadium. • Passaic high school soccer team made it to the semifinals. • November is Men’s Health Awareness month. American Legion Post #359 will host a wreath laying ceremony at the 15th Passaic soldiers monument at 12pm in Third Ward Park.
