Council Minutes December 5, 2013 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, December 5, 2013. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Councilor McCain Absent: Councilor Cochran Minutes: Councilor Roberts made a motion to waive the reading of the November 7, 2013, minutes. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed say "no", all in favor say "aye." Councilor Roberts made a motion to accept the minutes as written of the November 7, 2013, meeting. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that both motions passed unanimously." Councilor Roberts made a motion to waive the reading of the November 21, 2013, minutes. Councilor McCain duly seconded the motion. Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $71,398.87; a copy of the bills schedule is attached. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned the two largest bills were Jefferson County Sheriff’s Office in the amount of $28,000 and Goodwyn/Mills/Cawood in the amount of $14,000. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that the motion passed unanimously.” Mayor Sanders mentioned the Audit presentation will be at the December 19, 2013 meeting. Mayor Sanders added, the architect from Goodwyn/Mills/Cawood will be here as well regarding the park. Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners John and Cresence Nail and William Goggans, located at 5247 Willow Ridge Lane and 6101 Summer Side Drive. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2013-37. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Perry Jeffery and Deborah Bachelor, located at 6920 Treeline Lane. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. Mayor Sanders, ordinance passes unanimously as Ordinance 2013-38. Education: Mayor Sanders announced a vacancy on the Jefferson County Board of Education. Mayor Sanders added that interested parties will have to go through the Board of Education, but he will help anyone interested through the application process. Enhancements: Mayor Sanders announced the Christmas tree lighting has been cancelled due to the rain. Mayor Sanders added the tree will be lit at the conclusion of the Christmas Parade. Mayor Sanders stated the Christmas Parade is still on schedule for Saturday, December 7, 2013, at 10:00. Mayor’s Report: Councilor Roberts offered a motion to approve the expense for removing debris from the Rock School. Councilor McCain duly seconded the motion. Mayor Sanders stated the debris is carpet and paneling. Mayor Sanders called for any discussion. Councilor Churchwell stated that he, Councilor Tanner and Mayor Sanders went through the building and Mayor Sanders pointed out things that need to be done to the building. Councilor Churchwell stated that he and Councilor Tanner agreed with the Mayor that those items would need to be done. Mayor Sanders called for any further discussion. Mayor Sanders mentioned that the pickup schedule for the recycle dumpster was off due to Thanksgiving. Councilor Tanner recommended that the city add a 2nd dumpster for 90 days to help with the overflow during the holidays. Councilor Tanner asked if the dumpster could be moved across the street to the Rock School due to the library traffic. Mayor Sanders stated he would locate the best place for it at the Rock School. Councilor Roberts asked if both the recycle trailers could be moved to the Rock School. Mayor Sanders answered, we could. Councilor Roberts suggested putting a sign on the dumpster asking people to breakdown their cardboard before putting it into the dumpster. Councilor Tanner stated she is proud of the example our citizens have set by not putting household garbage in the dumpster, which is a problem our sister cities have had. Mayor Sanders stated Council has received three post annexation zoning cases, recommended favorably, from the Planning Commission. Mayor Sander suspended rules for a Public Hearing on the following cases: 5278 Willow Ridge Lane & 5897 Pendleton Circle; 5801, 5805, & 5809 Osage Lane; Emerald Valley Estates 1st Sector. Mayor Sanders explained when we annex property we then have to rezone the property from Jefferson County zoning to City of Pinson zoning, we convert from County to City equivalent. Mayor Sanders stated, “Let the record reflect no one presented comment for these three zoning cases. Mayor Sanders reinstated rules. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, located at 5278 Willow Ridge Lane and 5897 Pendleton Circle from Jefferson County zoning R2 to City of Pinson zoning RM. Councilor Tanner duly seconded the motion. Councilor Churchwell duly seconded the motion. Old Business: Mayor Sanders mentioned that Mrs. Ross from Goodwyn/Mills/Cawood would be at our December 19, 2013, meeting for our input on the Park, and the Auditors will be here with their audit report. Mayor Sanders mentioned that He has been approached by Innsbrooke Homeowners Association about leasing Lot 11 from the City to construct a sign on. Mayor Sanders added that Attorney Black is working on a lease. New Business: Mayor Sanders suspended rules and introduced April Wallace, Library Director. Mrs. Wallace reported on the Libraries yearly statistics. Mrs. Wallace stated regarding circulation, in 2012-34,000; in 2013-59,570. Regarding holdings in 2012 there were 5752 items in the library as of 2013 we have added over 4000 to put our holdings at just under 10,000 as of September 30, 2013. Mrs. Wallace added that part of the increase was a $10,000 grant for children’s books. Mrs. Wallace reported in 2012 there were 48 programs with 1000 in attendance and in 2013 there were 101 programs with over 3000 in attendance. Mrs. Wallace mentioned when the library opened in 2012 there were 22,000 visitors and in 2013 there have been 32,000 visitors. Public Comment: Pat Wise, Main Street. Asked when the bids would be taken for trash pickup. Mayor Sanders stated it would be after the first of the year. Councilor Churchwell offered a motion to enter executive session to discuss trade and commerce. Councilor McCain duly seconded the motion. Mayor Sanders, I provide certification in regard to trade and commerce that it would be detrimental if items were discussed in open forum.
